66 AN ACT
77 relating to appropriations to and revenue of the Automobile
88 Burglary and Theft Prevention Authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 8, Article 4413(37),
1111 Revised Statutes, is amended to read as follows:
1212 Sec. 8. DEPOSIT AND USE OF APPROPRIATED FUNDS.
1313 SECTION 2. Section 8, Article 4413(37), Revised Statutes,
1414 is amended by adding Subsection (d) to read as follows:
1515 (d) On September 1 of each fiscal year, the comptroller
1616 shall deposit to the credit of the subaccount described by Section
1717 8A of this article:
1818 (1) an amount equal to the total amount appropriated
1919 for that fiscal year to the department for the purposes of this
2020 article; and
2121 (2) an additional amount equal to the estimated cost
2222 for that fiscal year of employee benefits of employees whose
2323 salaries or wages are paid from an appropriation for the purposes of
2424 this article.
2525 SECTION 3. Article 4413(37), Revised Statutes, is amended
2626 by adding Section 8A to read as follows:
2727 Sec. 8A. DEPOSIT AND APPROPRIATION OF REVENUE. All gifts,
2828 grants, and other revenue collected or received by the authority,
2929 including the fee described by Section 10(e) of this article, shall
3030 be deposited to the credit of a subaccount in the Texas Department
3131 of Motor Vehicles fund and may be appropriated only to the
3232 department for purposes of the authority under this article.
3333 SECTION 4. Section 10(e), Article 4413(37), Revised
3434 Statutes, is amended to read as follows:
3535 (e) The [Fifty percent of each] fee collected under
3636 Subsection (b) of this section shall be deposited to the credit of
3737 the subaccount described by Section 8A of this article and may be
3838 appropriated only to the department [authority] for [the] purposes
3939 of the authority under this article.
4040 SECTION 5. Section 1001.151(b), Transportation Code, is
4141 amended to read as follows:
4242 (b) Unless [Except as provided by Subsection (c), and
4343 unless] otherwise dedicated by the Texas Constitution, the fund
4444 consists of:
4545 (1) money appropriated by the legislature to the
4646 department;
4747 (2) money allocated to pay fund accounting costs and
4848 related liabilities of the fund;
4949 (3) gifts, grants, and donations received by the
5050 department;
5151 (4) money required by law to be deposited to the fund;
5252 (5) interest earned on money in the fund; and
5353 (6) other revenue received by the department.
5454 SECTION 6. Section 1001.152, Transportation Code, is
5555 amended to read as follows:
5656 Sec. 1001.152. USE OF MONEY IN FUND. Money that is required
5757 to be deposited in the state treasury to the credit of the Texas
5858 Department of Motor Vehicles fund may be used by the department
5959 only:
6060 (1) to support the department's operations and the
6161 administration and enforcement of the department's functions; [or]
6262 (2) to pay the accounting costs and related
6363 liabilities for the fund, including fringe benefits, workers'
6464 compensation, and unemployment compensation; or
6565 (3) for purposes of the Automobile Burglary and Theft
6666 Prevention Authority under Article 4413(37), Revised Statutes.
6767 SECTION 7. Section 1001.151(c), Transportation Code, is
6868 repealed.
6969 SECTION 8. This Act takes effect September 1, 2019.
