55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to housing discrimination under the Texas Fair Housing
88 Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 301, Property Code, is
1111 amended by adding Section 301.028 to read as follows:
1212 Sec. 301.028. CERTAIN CONDUCT PROHIBITED. A person may not
1313 interfere, coerce, intimidate, retaliate against, or harass any
1414 person who:
1515 (1) exercises a right or protection granted under this
1616 chapter; or
1717 (2) encourages another person to exercise a right or
1818 protection granted under this chapter.
1919 SECTION 2. Section 301.041, Property Code, is amended to
2020 read as follows:
2121 Sec. 301.041. CERTAIN SALES AND RENTALS EXEMPTED. (a)
2222 Sections 301.021, 301.023, 301.024, and 301.025 do [Subchapter B
2323 does] not apply to:
2424 (1) the sale or rental of a single-family house sold or
2525 rented by the owner if:
2626 (A) the owner does not:
2727 (i) own more than three single-family
2828 houses at any one time; or
2929 (ii) own any interest in, nor is there owned
3030 or reserved on the person's behalf, under any express or voluntary
3131 agreement, title to or any right to any part of the proceeds from
3232 the sale or rental of more than three single-family houses at any
3333 one time; and
3434 (B) the house is sold or rented without:
3535 (i) the use of the sales or rental
3636 facilities or services of a broker, agent, or salesperson licensed
3737 under Chapter 1101, Occupations Code, or of an employee or agent of
3838 a licensed broker, agent, or salesperson, or the facilities or
3939 services of any person in the business of selling or renting a
4040 dwelling [the owner of a dwelling designed or intended for
4141 occupancy by five or more families]; or
4242 (ii) the publication, posting, or mailing
4343 of a notice, statement, or advertisement prohibited by Section
4444 301.022; or
4545 (2) the sale or rental of the rooms or units in a
4646 dwelling containing living quarters occupied by or intended to be
4747 occupied by not more than four families living independently of
4848 each other, if the owner maintains and occupies one of the living
4949 quarters as the owner's residence.
5050 (b) The exemption in Subsection (a)(1) applies only to one
5151 sale [or rental] in a 24-month period if the owner was not the most
5252 recent resident of the house at the time of the sale [or rental].
5353 (c) Subsection (a) does not prohibit the use of attorneys,
5454 escrow agents, abstractors, title companies, and other
5555 professional assistants necessary to transfer title.
5656 (d) For purposes of Subsection (a), a person is in the
5757 business of selling or renting a dwelling if:
5858 (1) the person has, within the preceding year,
5959 participated as the seller or landlord in three or more
6060 transactions involving the sale or rental of a dwelling or any
6161 interest in a dwelling;
6262 (2) the person has, within the preceding year,
6363 participated in two or more transactions, other than transactions
6464 involving the person's own dwelling, as an agent providing sales or
6565 rental facilities or services involving the sale or rental of a
6666 dwelling or any interest in a dwelling; or
6767 (3) the person is the owner of a dwelling designed or
6868 intended for occupancy by, or that is occupied by, five or more
6969 families.
7070 SECTION 3. Subchapter G, Chapter 301, Property Code, is
7171 amended by adding Section 301.134 to read as follows:
7272 Sec. 301.134. CONCILIATION AGREEMENT ENFORCEMENT. The
7373 commission may review a respondent's compliance with the terms of a
7474 conciliation agreement entered into under this chapter. If the
7575 commission has reasonable cause to believe that a respondent has
7676 breached a conciliation agreement, the commission shall refer the
7777 matter to the attorney general with a recommendation for the
7878 attorney general to file in accordance with this subchapter a civil
7979 action to enforce the agreement.
8080 SECTION 4. This Act takes effect September 1, 2019.
