| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Chapter 33, Insurance Code, is amended by adding | |
| 12 | 12 | Section 33.008 to read as follows: | |
| 13 | 13 | Sec. 33.008. PROHIBITED EMPLOYMENT. (a) An individual who | |
| 14 | 14 | served as commissioner or an employee of the department commits an | |
| 15 | 15 | offense if, before the second anniversary of the date the | |
| 16 | 16 | individual ceases to serve, the individual is employed by or under | |
| 17 | 17 | contract with: | |
| 18 | 18 | (1) a company regulated by the department; | |
| 19 | 19 | (2) an affiliate of a company regulated by the | |
| 20 | 20 | department; | |
| 21 | 21 | (3) an individual or entity representing a company | |
| 22 | 22 | regulated by the department; or | |
| 23 | 23 | (4) an association of which a company regulated by the | |
| 24 | 24 | department is a member. | |
| 25 | 25 | (b) An offense under this section is a Class A misdemeanor. | |
| 26 | 26 | SECTION 2. Section 33.008, Insurance Code, as added by this | |
| 27 | 27 | Act, applies only to an individual who ceases to serve the Texas | |
| 28 | 28 | Department of Insurance on or after the effective date of this Act. | |
| 29 | 29 | SECTION 3. This Act takes effect September 1, 2019. |
