86 AN ACT
97 relating to the disclosure of public money spent by certain
108 political subdivisions for lobbying activities in a comprehensive
119 annual financial report.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Chapter 140, Local Government Code, is amended
1412 by adding Section 140.012 to read as follows:
1513 Sec. 140.012. DISCLOSURE IN FINANCIAL REPORT OF AMOUNTS
1614 SPENT ON LOBBYING ACTIVITIES. (a) This section applies only to:
1715 (1) a political subdivision that imposes a tax; or
1816 (2) a regional mobility authority, toll road
1917 authority, or transit authority.
2018 (b) A political subdivision or authority that uses any
21- public money to influence or attempt to influence the outcome of any
22- legislation pending before the legislature must disclose on any
23- comprehensive annual financial report required to be prepared by
24- the political subdivision or authority the total amount spent
25- during the fiscal year to compensate persons required to register
26- as a lobbyist under Chapter 305, Government Code, to influence the
19+ public money to directly or indirectly influence or attempt to
20+ influence the outcome of any legislation pending before the
21+ legislature must disclose on any comprehensive annual financial
22+ report required to be prepared by the political subdivision or
23+ authority:
24+ (1) the total amount spent during the fiscal year to
25+ directly or indirectly influence or attempt to influence the
26+ outcome of legislation; and
27+ (2) each person required to register as a lobbyist
28+ under Chapter 305, Government Code, who was compensated by the
29+ political subdivision or authority during the fiscal year to
30+ directly or indirectly influence or attempt to influence the
2731 outcome of legislation.
2832 (c) Subsection (b) does not require a political subdivision
2933 or authority to prepare a separate comprehensive annual financial
3034 report for the disclosures under that subsection.
3135 SECTION 2. Section 140.012, Local Government Code, as added
3236 by this Act, applies only to a fiscal year of an entity required to
3337 file a report that begins on or after the effective date of this
3438 Act.
3539 SECTION 3. This Act takes effect immediately if it receives
3640 a vote of two-thirds of all the members elected to each house, as
3741 provided by Section 39, Article III, Texas Constitution. If this
3842 Act does not receive the vote necessary for immediate effect, this
3943 Act takes effect September 1, 2019.
