55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to positions designated as exempt from sheriff's
88 department civil service systems in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 158.038, Local Government Code, is
1111 amended by amending Subsections (b), (c), and (d) and adding
1212 Subsections (c-1) and (e) to read as follows:
1313 (b) The sheriff of a county with a population of [3.3
1414 million or] less than 900,000 may designate as exempt from the civil
1515 service system:
1616 (1) the position of chief deputy;
1717 (2) four positions of major deputy;
1818 (3) one or more positions in the office of
1919 departmental legal counsel; and
2020 (4) additional positions in the department; provided,
2121 however, that the sheriff may not designate as exempt a total of
2222 more than 12 [10] positions.
2323 (c) The sheriff of a county with a population of 900,000 or
2424 more [than 3.3 million] may designate as exempt from the civil
2525 service system:
2626 (1) the position of chief deputy;
2727 (2) one or more positions in the office of
2828 departmental legal counsel; and
2929 (3) additional positions in the department[, not to
3030 exceed 25 in number,] that have been:
3131 (A) determined by the civil service commission to
3232 be administrative or supervisory positions; or
3333 (B) designated by the sheriff as a specialist
3434 position[; provided, however, that the sheriff may not designate as
3535 exempt any position in the deputy classifications of captain or
3636 below. The designation of any such additional exempt position by
3737 the sheriff shall not diminish the number of positions within the
3838 deputy classifications of captain or below].
3939 (c-1) For exemptions under Subsection (c)(3):
4040 (1) the number of exemptions may not exceed:
4141 (A) 15 in a county with a population of 900,000 or
4242 more but less than 1.5 million;
4343 (B) 18 in a county with a population of 1.5
4444 million or more but less than 2 million;
4545 (C) 20 in a county with a population of 2 million
4646 or more but less than 2.5 million;
4747 (D) 25 in a county with a population of 2.5
4848 million or more but less than 3 million; and
4949 (E) 30 in a county with a population of 3 million
5050 or more;
5151 (2) the sheriff may not designate as exempt:
5252 (A) a position in the deputy classifications of
5353 captain or below in a county with a population of 3 million or more;
5454 or
5555 (B) a position in the deputy classifications of
5656 lieutenant or below in a county with a population of less than 3
5757 million; and
5858 (3) the designation of exempt positions may not reduce
5959 the number of positions within the deputy classifications:
6060 (A) of captain or below in a county with a
6161 population of 3 million or more; or
6262 (B) of sergeant or below in a county with a
6363 population of less than 3 million.
6464 (d) At the time a new sheriff takes office, an employee
6565 holding an exempt position may be transferred to the nonexempt
6666 position held by the employee immediately before being promoted to
6767 an exempt position. A person who was not an officer in the
6868 department when appointed to an exempt position may be transferred
6969 only to an entry level position within the pay grade of that exempt
7070 position in accordance with the system's civil service rules.
7171 (e) Not later than the 90th day after the date a sheriff
7272 designates a position as exempt under this section, an employee may
7373 request a transfer to the nonexempt position held by the employee
7474 before the employee's last promotion.
7575 SECTION 2. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2019.
