A BILL TO BE ENTITLED
AN ACT
relating to the standing of municipalities in certain civil
actions.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 30, Civil Practice and Remedies Code, is
amended by adding Section 30.022 to read as follows:
Sec. 30.022. STANDING OF MUNICIPALITIES IN CERTAIN ACTIONS.
A municipality has standing to bring or intervene in a civil action
if the intervention is necessary to protect or defend the rights of
a resident of the municipality. This section applies regardless of
whether the party opposing the municipal resident is located
outside of the municipality.
SECTION 2. Section 30.022, Civil Practice and Remedies
Code, as added by this Act, applies only to an action filed on or
after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2019.
