55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of the Environmental Task Force Advisory
88 Committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section:
1111 (1) "Advisory committee" means the Environmental Task
1212 Force Advisory Committee.
1313 (2) "Commission" means the Railroad Commission of
1414 Texas.
1515 (b) The Environmental Task Force Advisory Committee is
1616 composed of the following nine members appointed by the commission:
1717 (1) seven representatives of the oil and gas industry,
1818 including:
1919 (A) one owner or operator of a facility that
2020 handles oil and gas waste; and
2121 (B) one representative of producers of oil and
2222 gas;
2323 (2) an environmental engineer with experience related
2424 to environmental compliance; and
2525 (3) an attorney with experience in the implementation
2626 of environmental laws.
2727 (c) Members of the advisory committee hold office for terms
2828 of two years expiring February 1 of each odd-numbered year. A
2929 member is ineligible to serve more than two consecutive full terms.
3030 (d) The advisory committee shall select from its membership
3131 a presiding officer and a secretary to serve for one-year terms.
3232 (e) The advisory committee shall meet at least quarterly.
3333 (f) The advisory committee may hold public hearings, formal
3434 meetings, or work sessions. The advisory committee may not take
3535 formal action at a public hearing, formal meeting, or work session
3636 unless a quorum of the committee is present.
3737 (g) A member of the advisory committee is not entitled to
3838 receive compensation for service on the committee or reimbursement
3939 for expenses incurred in the performance of official duties as a
4040 member of the committee.
4141 (h) The advisory committee shall:
4242 (1) review the overall operation and structure of the
4343 commission's environmental regulatory functions and rules adopted
4444 by the commission to implement and enforce the commission's
4545 environmental regulatory functions, including rules related to:
4646 (A) any memorandum of understanding between the
4747 commission and the Texas Commission on Environmental Quality
4848 relating to the commission's environmental regulatory functions;
4949 and
5050 (B) the handling and disposal of oil and gas
5151 waste; and
5252 (2) provide recommendations to the commission for
5353 proposed changes to improve and add clarity to rules related to the
5454 commission's environmental regulatory functions.
5555 (i) The advisory committee may adopt rules, procedures, and
5656 policies as needed to administer this section and implement its
5757 responsibilities.
5858 (j) Chapter 2110, Government Code, does not apply to the
5959 size, composition, or duration of the advisory committee.
6060 (k) This section expires and the advisory committee is
6161 dissolved on September 1, 2023.
6262 SECTION 2. This Act takes effect September 1, 2019.
