55 AN ACT
66 relating to the issuance by the Railroad Commission of Texas of a
77 certificate of convenience and necessity for certain common carrier
88 pipelines.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter I, Chapter 111,
1111 Natural Resources Code, is amended to read as follows:
1212 SUBCHAPTER I. CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR
1313 CERTAIN COMMON CARRIER [COAL] PIPELINES
1414 SECTION 2. Section 111.301, Natural Resources Code, is
1515 amended to read as follows:
1616 Sec. 111.301. CERTIFICATE REQUIRED. A person that is a
1717 common carrier under Sections 111.002(1)-(6), or a common carrier
1818 of natural gas or other commodities under Section 2.105 of the
1919 Texas Business Organizations Code,[Subsection (5), Section 111.002
2020 of this code] must apply for and be issued a certificate of public
2121 convenience and necessity from the commission pursuant to the
2222 commission's authority to issue certificates under Section 111.302
2323 [of this code] if the commission finds after a hearing that the
2424 public convenience and necessity will be served by the construction
2525 and operation of the pipeline.
2626 SECTION 3. Sections 111.302(a), (c), and (d), Natural
2727 Resources Code, are amended to read as follows:
2828 (a) The commission is further authorized, empowered, and
2929 directed to issue certificates of public convenience and necessity
3030 to common carrier pipelines [transporting coal in whatever form or
3131 mixture for hire] in Texas if the commission finds that the public
3232 convenience and necessity will be served in that existing
3333 facilities will not be able to provide the transportation as
3434 economically or efficiently as the proposed pipeline.
3535 (c) The commission shall not issue a permit, certificate, or
3636 any authority to any common carrier [applicant] whose rates and
3737 charges are not regulated by government authority, either state or
3838 federal, and that state or federal regulations insure to the public
3939 [and to the ultimate electric consumer] that the contracts, rates,
4040 and charges shall be just and reasonable, nondiscriminatory, and
4141 offering no preference or advantage to any person, corporation,
4242 entity, or group.
4343 (d) The commission shall not issue a permit, certificate, or
4444 any authority for a common carrier pipeline [to any applicant whose
4545 pipeline transporting coal in whatever form] unless the pipeline
4646 [transporting coal in whatever form] is to be buried at least 36
4747 inches below the surface, except in such instances in which the
4848 commission specifically exempts the 36-inch depth requirement and
4949 unless the pipeline [transporting coal in whatever form] conforms
5050 to all applicable state or federal regulations concerning the
5151 operation, maintenance, and construction of that [same] pipeline.
5252 SECTION 4. Sections 111.303 and 111.305, Natural Resources
5353 Code, are amended to read as follows:
5454 Sec. 111.303. CERTIFICATION PROCEDURE. (a) A person that
5555 applies for a certificate of public convenience and necessity for a
5656 common carrier [The coal] pipeline under this subchapter
5757 [applicant] shall publish, in accordance with regulations
5858 promulgated by the commission and existing law, a notice that it has
5959 filed the [an] application [for a certificate of public convenience
6060 and necessity under this Act] in a newspaper of general circulation
6161 in each county in which the project will be located. The notice
6262 shall, among other things, specify to the extent practicable the
6363 land which would be subject to the power of eminent domain.
6464 (b) The commission shall then conduct public hearings in
6565 areas of the state along the prospective pipeline right-of-way as
6666 it shall determine shall be necessary to give all property owners
6767 identified by the common carrier along the proposed pipeline
6868 right-of-way an opportunity to be heard. The commission is vested
6969 with authority and discretion to alter the right-of-way to meet
7070 with local objections.
7171 Sec. 111.305. OTHER AGENCIES. (a) The commission shall
7272 seek and act on the recommendations of the Texas [Natural Resource
7373 Conservation] Commission on Environmental Quality, the Governor's
7474 Energy Advisory Council, or their successors responsible for
7575 environmental determinations and shall specify the proper use and
7676 disposal of nondischargeable water.
7777 (b) Neither the authority conveyed to the commission by this
7878 subchapter to issue certificates and to promulgate rules governing
7979 common carrier pipelines [transporting coal in whatever form] nor
8080 the powers and duties conveyed on those pipelines by this chapter
8181 shall affect, diminish, or othe
8282 rwise limit the jurisdiction and
8383 authority of the Texas Water Development Board and the Texas
8484 [Natural Resource Conservation] Commission on Environmental
8585 Quality to regulate by applicable rules the acquisition, use,
8686 control, disposition, and discharge of water or water rights in
8787 Texas.
8888 SECTION 5. Section 111.304, Natural Resources Code, is
8989 repealed.
9090 SECTION 6. This Act takes effect September 1, 2019.
