8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 1368.004(a), Insurance Code, is amended | |
10 | 10 | to read as follows: | |
11 | 11 | (a) A group health benefit plan shall provide coverage for | |
12 | 12 | the necessary care and treatment of chemical dependency, including | |
13 | 13 | outpatient rehabilitation. | |
14 | 14 | SECTION 2. Chapter 1368, Insurance Code, is amended by | |
15 | 15 | adding Section 1368.009 to read as follows: | |
16 | 16 | Sec. 1368.009. PROHIBITED CONSEQUENCE OF CLAIMS. An | |
17 | 17 | employer that provides group health benefit coverage subject to | |
18 | 18 | this chapter may not terminate an employee solely based on the | |
19 | 19 | employee filing a claim for the benefits. | |
20 | 20 | SECTION 3. This Act applies only to a health benefit plan | |
21 | 21 | that is delivered, issued for delivery, or renewed on or after | |
22 | 22 | January 1, 2020. | |
23 | 23 | SECTION 4. This Act takes effect September 1, 2019. |
