66 AN ACT
77 relating to health benefit coverage for chemical dependency.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1368.004(a), Insurance Code, is amended
1010 to read as follows:
1111 (a) A group health benefit plan shall provide coverage for
1212 the necessary care and treatment of chemical dependency, including
1313 outpatient rehabilitation.
1414 SECTION 2. Chapter 1368, Insurance Code, is amended by
1515 adding Section 1368.009 to read as follows:
1616 Sec. 1368.009. PROHIBITED CONSEQUENCE OF CLAIMS. An
1717 employer that provides group health benefit coverage subject to
1818 this chapter may not terminate an employee solely based on the
1919 employee filing a claim for the benefits.
2020 SECTION 3. This Act applies only to a health benefit plan
2121 that is delivered, issued for delivery, or renewed on or after
2222 January 1, 2020.
2323 SECTION 4. This Act takes effect September 1, 2019.
