8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 1368.004, Insurance Code, is amended by | |
10 | 10 | adding Subsection (c) to read as follows: | |
11 | 11 | (c) A group health benefit plan shall provide coverage for | |
12 | 12 | an inpatient rehabilitation program for not less than 90 days to | |
13 | 13 | provide the necessary care and treatment of chemical dependency. | |
14 | 14 | SECTION 2. Section 1368.005(b), Insurance Code, is amended | |
15 | 15 | to read as follows: | |
16 | 16 | (b) A group health benefit plan may set dollar or, subject | |
17 | 17 | to Section 1368.004(c), durational limits for coverage required | |
18 | 18 | under this chapter that are less favorable than for coverage | |
19 | 19 | provided for physical illness generally under the plan if those | |
20 | 20 | limits are sufficient to provide appropriate care and treatment | |
21 | 21 | under the guidelines and standards adopted under Section 1368.007. | |
22 | 22 | If guidelines and standards adopted under Section 1368.007 are not | |
23 | 23 | in effect, the dollar and durational limits may not be less | |
24 | 24 | favorable than for physical illness generally. | |
25 | 25 | SECTION 3. This Act applies only to a health benefit plan | |
26 | 26 | that is delivered, issued for delivery, or renewed on or after | |
27 | 27 | January 1, 2020. | |
28 | 28 | SECTION 4. This Act takes effect September 1, 2019. |
