66 AN ACT
77 relating to health benefit coverage for chemical dependency.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1368.004, Insurance Code, is amended by
1010 adding Subsection (c) to read as follows:
1111 (c) A group health benefit plan shall provide coverage for
1212 an inpatient rehabilitation program for not less than 90 days to
1313 provide the necessary care and treatment of chemical dependency.
1414 SECTION 2. Section 1368.005(b), Insurance Code, is amended
1515 to read as follows:
1616 (b) A group health benefit plan may set dollar or, subject
1717 to Section 1368.004(c), durational limits for coverage required
1818 under this chapter that are less favorable than for coverage
1919 provided for physical illness generally under the plan if those
2020 limits are sufficient to provide appropriate care and treatment
2121 under the guidelines and standards adopted under Section 1368.007.
2222 If guidelines and standards adopted under Section 1368.007 are not
2323 in effect, the dollar and durational limits may not be less
2424 favorable than for physical illness generally.
2525 SECTION 3. This Act applies only to a health benefit plan
2626 that is delivered, issued for delivery, or renewed on or after
2727 January 1, 2020.
2828 SECTION 4. This Act takes effect September 1, 2019.
