66 AN ACT
77 relating to the electronic transmission of an invoice or notice of
88 toll nonpayment by a toll project entity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 284, Transportation Code,
1111 is amended by adding Section 284.0703 to read as follows:
1212 Sec. 284.0703. METHOD OF SENDING INVOICE OR NOTICE. As
1313 authorized under Section 322.008(d)(2), Business & Commerce Code, a
1414 county may provide an invoice or notice required under this chapter
1515 to be sent by first class mail instead as an electronic record:
1616 (1) if the recipient of the information agrees to the
1717 transmission of the information as an electronic record; and
1818 (2) on terms acceptable to the recipient.
1919 SECTION 2. Section 370.177, Transportation Code, is amended
2020 by adding Subsection (n) to read as follows:
2121 (n) As authorized under Section 322.008(d)(2), Business &
2222 Commerce Code, an authority may provide an invoice or notice
2323 required under this section to be sent by first class mail instead
2424 as an electronic record:
2525 (1) if the recipient of the information agrees to the
2626 transmission of the information as an electronic record; and
2727 (2) on terms acceptable to the recipient.
2828 SECTION 3. Subchapter C, Chapter 372, Transportation Code,
2929 is amended by adding Section 372.116 to read as follows:
3030 Sec. 372.116. METHOD OF SENDING INVOICE OR NOTICE. As
3131 authorized under Section 322.008(d)(2), Business & Commerce Code, a
3232 toll project entity may provide an invoice or notice required under
3333 this subchapter to be sent by first class mail instead as an
3434 electronic record:
3535 (1) if the recipient of the information agrees to the
3636 transmission of the information as an electronic record; and
3737 (2) on terms acceptable to the recipient.
3838 SECTION 4. The change in law made by this Act applies only
3939 to the collection of a toll incurred on or after the effective date
4040 of this Act. The collection of a toll incurred before the effective
4141 date of this Act is governed by the law in effect immediately before
4242 the effective date of this Act, and that law is continued in effect
4343 for that purpose.
4444 SECTION 5. This Act takes effect September 1, 2019.
