| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 284, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 284.0703 to read as follows: |
|---|
| 12 | 12 | | Sec. 284.0703. METHOD OF SENDING INVOICE OR NOTICE. As |
|---|
| 13 | 13 | | authorized under Section 322.008(d)(2), Business & Commerce Code, a |
|---|
| 14 | 14 | | county may provide an invoice or notice required under this chapter |
|---|
| 15 | 15 | | to be sent by first class mail instead as an electronic record: |
|---|
| 16 | 16 | | (1) if the recipient of the information agrees to the |
|---|
| 17 | 17 | | transmission of the information as an electronic record; and |
|---|
| 18 | 18 | | (2) on terms acceptable to the recipient. |
|---|
| 19 | 19 | | SECTION 2. Section 370.177, Transportation Code, is amended |
|---|
| 20 | 20 | | by adding Subsection (n) to read as follows: |
|---|
| 21 | 21 | | (n) As authorized under Section 322.008(d)(2), Business & |
|---|
| 22 | 22 | | Commerce Code, an authority may provide an invoice or notice |
|---|
| 23 | 23 | | required under this section to be sent by first class mail instead |
|---|
| 24 | 24 | | as an electronic record: |
|---|
| 25 | 25 | | (1) if the recipient of the information agrees to the |
|---|
| 26 | 26 | | transmission of the information as an electronic record; and |
|---|
| 27 | 27 | | (2) on terms acceptable to the recipient. |

| 28 | 28 | | SECTION 3. Subchapter C, Chapter 372, Transportation Code, |
|---|
| 29 | 29 | | is amended by adding Section 372.116 to read as follows: |
|---|
| 30 | 30 | | Sec. 372.116. METHOD OF SENDING INVOICE OR NOTICE. As |
|---|
| 31 | 31 | | authorized under Section 322.008(d)(2), Business & Commerce Code, a |
|---|
| 32 | 32 | | toll project entity may provide an invoice or notice required under |
|---|
| 33 | 33 | | this subchapter to be sent by first class mail instead as an |
|---|
| 34 | 34 | | electronic record: |
|---|
| 35 | 35 | | (1) if the recipient of the information agrees to the |
|---|
| 36 | 36 | | transmission of the information as an electronic record; and |
|---|
| 37 | 37 | | (2) on terms acceptable to the recipient. |
|---|
| 38 | 38 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 39 | 39 | | to the collection of a toll incurred on or after the effective date |
|---|
| 40 | 40 | | of this Act. The collection of a toll incurred before the effective |
|---|
| 41 | 41 | | date of this Act is governed by the law in effect immediately before |
|---|
| 42 | 42 | | the effective date of this Act, and that law is continued in effect |
|---|
| 43 | 43 | | for that purpose. |
|---|
| 44 | 44 | | SECTION 5. This Act takes effect September 1, 2019. |
