10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 814.103, Government Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | Sec. 814.103. SERVICE RETIREMENT BENEFITS FOR ELECTED CLASS |
---|
14 | 14 | | SERVICE. (a) Except as provided by Subsections [Subsection] (b) |
---|
15 | 15 | | and (c), the standard service retirement annuity for service |
---|
16 | 16 | | credited in the elected class of membership is an amount equal to |
---|
17 | 17 | | the number of years of service credit in that class, times two |
---|
18 | 18 | | percent of the state salary, excluding longevity pay payable under |
---|
19 | 19 | | Section 659.0445 and as adjusted from time to time, being paid a |
---|
20 | 20 | | district judge. |
---|
21 | 21 | | (b) The standard service retirement annuity for service |
---|
22 | 22 | | credited in the elected class computed under Subsection (a) may not |
---|
23 | 23 | | exceed at any time 100 percent of the state salary being paid a |
---|
24 | 24 | | district judge. |
---|
25 | 25 | | (c) The standard service retirement annuity for service |
---|
26 | 26 | | credited in the elected class of membership all of which was earned |
---|
27 | 27 | | as a member of the legislature is an amount equal to the number of |
---|
28 | 28 | | years of service credit in that class, times two percent of the |
---|
29 | 29 | | state salary being paid a member of the legislature under Section |
---|
30 | 30 | | 24, Article III, Texas Constitution. |
---|
31 | 31 | | SECTION 2. The change in law made by this Act applies only |
---|
32 | 32 | | to the standard service retirement annuity for a person who is first |
---|
33 | 33 | | eligible to become a member of the elected class on or after |
---|
34 | 34 | | September 1, 2019. A person who is first eligible to become a |
---|
35 | 35 | | member of the elected class before the effective date of this Act is |
---|
36 | 36 | | governed by the law in effect immediately before the effective date |
---|
37 | 37 | | of this Act, and the former law is continued in effect for that |
---|
38 | 38 | | purpose. |
---|
39 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
