55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the standard service retirement annuity for certain
88 members of the elected class of the Employees Retirement System of
99 Texas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 814.103, Government Code, is amended to
1212 read as follows:
1313 Sec. 814.103. SERVICE RETIREMENT BENEFITS FOR ELECTED CLASS
1414 SERVICE. (a) Except as provided by Subsections [Subsection] (b)
1515 and (c), the standard service retirement annuity for service
1616 credited in the elected class of membership is an amount equal to
1717 the number of years of service credit in that class, times two
1818 percent of the state salary, excluding longevity pay payable under
1919 Section 659.0445 and as adjusted from time to time, being paid a
2020 district judge.
2121 (b) The standard service retirement annuity for service
2222 credited in the elected class computed under Subsection (a) may not
2323 exceed at any time 100 percent of the state salary being paid a
2424 district judge.
2525 (c) The standard service retirement annuity for service
2626 credited in the elected class of membership all of which was earned
2727 as a member of the legislature is an amount equal to the number of
2828 years of service credit in that class, times two percent of the
2929 state salary being paid a member of the legislature under Section
3030 24, Article III, Texas Constitution.
3131 SECTION 2. The change in law made by this Act applies only
3232 to the standard service retirement annuity for a person who is first
3333 eligible to become a member of the elected class on or after
3434 September 1, 2019. A person who is first eligible to become a
3535 member of the elected class before the effective date of this Act is
3636 governed by the law in effect immediately before the effective date
3737 of this Act, and the former law is continued in effect for that
3838 purpose.
3939 SECTION 3. This Act takes effect September 1, 2019.
