55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authority of counties and municipalities to limit the
88 photography of critical infrastructure.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 250, Local Government Code, is amended
1111 by adding Section 250.009 to read as follows:
1212 Sec. 250.009. PHOTOGRAPHY OF CRITICAL INFRASTRUCTURE. (a)
1313 In this section, "critical infrastructure" includes all public or
1414 private assets, systems, and functions vital to the security,
1515 governance, public health and safety, economy, or morale of the
1616 state or the nation.
1717 (b) A county by order or a municipality by ordinance may
1818 restrict photography of critical infrastructure. An order or
1919 ordinance adopted under this section must:
2020 (1) state the distance from which critical
2121 infrastructure may not be photographed; and
2222 (2) require notice of the photography restrictions be
2323 posted prominently and conspicuously in public areas around the
2424 critical infrastructure.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
