| 8 | 8 | | photography of critical infrastructure. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 250, Local Government Code, is amended |
|---|
| 11 | 11 | | by adding Section 250.009 to read as follows: |
|---|
| 12 | 12 | | Sec. 250.009. PHOTOGRAPHY OF CRITICAL INFRASTRUCTURE. (a) |
|---|
| 13 | 13 | | In this section, "critical infrastructure" includes all public or |
|---|
| 14 | 14 | | private assets, systems, and functions vital to the security, |
|---|
| 15 | 15 | | governance, public health and safety, economy, or morale of the |
|---|
| 16 | 16 | | state or the nation. |
|---|
| 17 | 17 | | (b) A county by order or a municipality by ordinance may |
|---|
| 18 | 18 | | restrict photography of critical infrastructure. An order or |
|---|
| 19 | 19 | | ordinance adopted under this section must: |
|---|
| 20 | 20 | | (1) state the distance from which critical |
|---|
| 21 | 21 | | infrastructure may not be photographed; and |
|---|
| 22 | 22 | | (2) require notice of the photography restrictions be |
|---|
| 23 | 23 | | posted prominently and conspicuously in public areas around the |
|---|
| 24 | 24 | | critical infrastructure. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2019. |
