| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 157.021, Local Government Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 157.021. HOURS OF WORK OF COUNTY EMPLOYEES. (a) The |
|---|
| 12 | 12 | | [In a county with a population of 355,000 or more, the] |
|---|
| 13 | 13 | | commissioners court of a county may adopt and enforce uniform rules |
|---|
| 14 | 14 | | on the hours of work of department heads, assistants, deputies, and |
|---|
| 15 | 15 | | other employees whose compensation is set or approved by the court. |
|---|
| 16 | 16 | | (b) The commissioners court of a [any] county may adopt and |
|---|
| 17 | 17 | | enforce uniform rules on overtime and compensatory time for |
|---|
| 18 | 18 | | department heads, assistants, deputies, and other employees whose |
|---|
| 19 | 19 | | compensation is set or approved by the commissioners court. The |
|---|
| 20 | 20 | | rules may: |
|---|
| 21 | 21 | | (1) prohibit unbudgeted overtime, except when the |
|---|
| 22 | 22 | | commissioners court or an elected county or district officer |
|---|
| 23 | 23 | | declares an emergency; and |
|---|
| 24 | 24 | | (2) require that emergency overtime be reported to the |
|---|
| 25 | 25 | | county auditor and the commissioners court. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2019. |
