88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 157.021, Local Government Code, is
1010 amended to read as follows:
1111 Sec. 157.021. HOURS OF WORK OF COUNTY EMPLOYEES. (a) The
1212 [In a county with a population of 355,000 or more, the]
1313 commissioners court of a county may adopt and enforce uniform rules
1414 on the hours of work of department heads, assistants, deputies, and
1515 other employees whose compensation is set or approved by the court.
1616 (b) The commissioners court of a [any] county may adopt and
1717 enforce uniform rules on overtime and compensatory time for
1818 department heads, assistants, deputies, and other employees whose
1919 compensation is set or approved by the commissioners court. The
2020 rules may:
2121 (1) prohibit unbudgeted overtime, except when the
2222 commissioners court or an elected county or district officer
2323 declares an emergency; and
2424 (2) require that emergency overtime be reported to the
2525 county auditor and the commissioners court.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2019.
