7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Chapter 251.001(16), Elections Code, is amended |
---|
9 | 9 | | to read as follows: |
---|
10 | 10 | | (16) "Political advertising" means a communication |
---|
11 | 11 | | supporting or opposing a candidate for nomination or election to a |
---|
12 | 12 | | public office or office of a political party, a political party, a |
---|
13 | 13 | | public officer, or a measure, including a communication that |
---|
14 | 14 | | references the position of a candidate or officeholder on a measure |
---|
15 | 15 | | if the communication is made with a principal intent of positively |
---|
16 | 16 | | or negatively influencing the public's perception of the candidate |
---|
17 | 17 | | or officeholder, that: |
---|
18 | 18 | | (A) in return for consideration, is published in |
---|
19 | 19 | | a newspaper, magazine, or other periodical or is broadcast by radio |
---|
20 | 20 | | or television; or |
---|
21 | 21 | | (B) appears: |
---|
22 | 22 | | (i) in a pamphlet, circular, flier, |
---|
23 | 23 | | billboard or other sign, bumper sticker, or similar form of written |
---|
24 | 24 | | communication; or |
---|
25 | 25 | | (ii) on an Internet website. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2019. |
