55 AN ACT
66 Relating to political advertising.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 251.001(16), Elections Code, is amended
99 to read as follows:
1010 (16) "Political advertising" means a communication
1111 supporting or opposing a candidate for nomination or election to a
1212 public office or office of a political party, a political party, a
1313 public officer, or a measure, including a communication that
1414 references the position of a candidate or officeholder on a measure
1515 if the communication is made with a principal intent of positively
1616 or negatively influencing the public's perception of the candidate
1717 or officeholder, that:
1818 (A) in return for consideration, is published in
1919 a newspaper, magazine, or other periodical or is broadcast by radio
2020 or television; or
2121 (B) appears:
2222 (i) in a pamphlet, circular, flier,
2323 billboard or other sign, bumper sticker, or similar form of written
2424 communication; or
2525 (ii) on an Internet website.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2019.
