---|
13 | 13 | | Code, is amended by adding Chapter 7813 to read as follows: |
---|
14 | 14 | | CHAPTER 7813. CLEAR CREEK WATERSHED REGIONAL FLOOD CONTROL DISTRICT |
---|
15 | 15 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
16 | 16 | | Sec. 7813.0101. DEFINITIONS. In this chapter: |
---|
17 | 17 | | (1) "Board" means the board of directors of the |
---|
18 | 18 | | district. |
---|
19 | 19 | | (2) "Director" means a member of the board. |
---|
20 | 20 | | (3) "District" means the Clear Creek Watershed |
---|
21 | 21 | | Regional Flood Control District. |
---|
22 | 22 | | Sec. 7813.0102. NATURE OF DISTRICT. (a) The district is a |
---|
23 | 23 | | conservation and reclamation district and flood control district as |
---|
24 | 24 | | provided by this chapter. |
---|
25 | 25 | | (b) The creation of the district is essential to accomplish |
---|
26 | 26 | | the purposes of Section 59, Article XVI, Texas Constitution. |
---|
27 | 27 | | Sec. 7813.0103. INITIAL DISTRICT TERRITORY. (a) The |
---|
28 | 28 | | district is initially composed of the territory described by |
---|
29 | 29 | | Section 2 of the Act enacting this chapter. |
---|
30 | 30 | | (b) The boundaries and field notes contained in Section 2 of |
---|
31 | 31 | | the Act enacting this chapter form a closure. A mistake made in the |
---|
32 | 32 | | field notes or in copying the field notes in the legislative process |
---|
33 | 33 | | does not affect the district's: |
---|
34 | 34 | | (1) organization, existence, or validity; |
---|
35 | 35 | | (2) right to issue any type of bond for the purposes |
---|
36 | 36 | | for which the district is created or to pay the principal of and |
---|
37 | 37 | | interest on a bond; |
---|
38 | 38 | | (3) right to impose a tax; or |
---|
39 | 39 | | (4) legality or operation. |
---|
40 | 40 | | Sec. 7813.0104. CONFLICTS OF LAW. This chapter prevails |
---|
41 | 41 | | over any provision of general law, including a provision of Chapter |
---|
42 | 42 | | 56 or 57, Water Code, that is in conflict or is inconsistent with |
---|
43 | 43 | | this chapter. |
---|
44 | 44 | | SUBCHAPTER A-1. TEMPORARY PROVISIONS |
---|
45 | 45 | | Sec. 7813.0121. TEMPORARY DIRECTORS. As soon as |
---|
46 | 46 | | practicable after the effective date of the Act enacting this |
---|
47 | 47 | | chapter, the temporary directors of the district shall be appointed |
---|
48 | 48 | | as follows: |
---|
49 | 49 | | (1) the commissioners courts of Brazoria and Harris |
---|
50 | 50 | | Counties shall each appoint one director to serve a term that |
---|
51 | 51 | | expires September 30, 2021; and |
---|
52 | 52 | | (2) the commissioners courts of Fort Bend, Galveston, |
---|
53 | 53 | | and Harris Counties shall each appoint one director to serve a term |
---|
54 | 54 | | that expires September 30, 2023. |
---|
55 | 55 | | Sec. 7813.0122. CONFIRMATION ELECTION REQUIRED. The |
---|
56 | 56 | | temporary directors shall hold an election to confirm the creation |
---|
57 | 57 | | of the district as provided by Section 49.102, Water Code. |
---|
58 | 58 | | Sec. 7813.0123. EXPIRATION. This subchapter expires |
---|
59 | 59 | | December 31, 2024. |
---|
60 | 60 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
61 | 61 | | Sec. 7813.0201. GOVERNING BODY; TERMS. (a) The district is |
---|
62 | 62 | | governed by a board of five appointed directors. |
---|
63 | 63 | | (b) Except as provided by Section 7813.0121, directors |
---|
64 | 64 | | serve staggered four-year terms. |
---|
65 | 65 | | Sec. 7813.0202. APPOINTMENT OF DIRECTORS; VACANCY. (a) |
---|
66 | 66 | | The directors are appointed as follows: |
---|
67 | 67 | | (1) one director appointed by the commissioners court |
---|
68 | 68 | | of Brazoria County; |
---|
69 | 69 | | (2) one director appointed by the commissioners court |
---|
70 | 70 | | of Fort Bend County; |
---|
71 | 71 | | (3) one director appointed by the commissioners court |
---|
72 | 72 | | of Galveston County; and |
---|
73 | 73 | | (4) two directors appointed by the commissioners court |
---|
74 | 74 | | of Harris County. |
---|
75 | 75 | | (b) On the expiration of a director's term, the |
---|
76 | 76 | | commissioners court that appointed the director shall appoint a |
---|
77 | 77 | | successor. |
---|
78 | 78 | | (c) If a vacancy occurs during a director's term, the |
---|
79 | 79 | | commissioners court that appointed the director shall appoint a |
---|
80 | 80 | | person to serve as director for the remainder of the term. |
---|
81 | 81 | | Sec. 7813.0203. COMPENSATION OF DIRECTORS. (a) |
---|
82 | 82 | | Notwithstanding Section 49.060, Water Code, a director is not |
---|
83 | 83 | | entitled to receive compensation for service on the board. |
---|
84 | 84 | | (b) A director may be reimbursed for actual district travel |
---|
85 | 85 | | expenses. |
---|
86 | 86 | | Sec. 7813.0204. GENERAL MANAGER BOND. (a) The general |
---|
87 | 87 | | manager of the district shall execute a bond that is: |
---|
88 | 88 | | (1) in an amount set by the board; |
---|
89 | 89 | | (2) payable to the district; and |
---|
90 | 90 | | (3) conditioned on the general manager's faithful |
---|
91 | 91 | | performance of the general manager's duties. |
---|
92 | 92 | | (b) The district shall pay for the bond described by |
---|
93 | 93 | | Subsection (a). |
---|
94 | 94 | | Sec. 7813.0205. DISTRICT ENGINEER. (a) The board shall |
---|
95 | 95 | | appoint a professional civil engineer as the district engineer. |
---|
96 | 96 | | (b) The district engineer shall execute a bond that is: |
---|
97 | 97 | | (1) in an amount set by the board; |
---|
98 | 98 | | (2) payable to the district; and |
---|
99 | 99 | | (3) conditioned on the faithful performance of the |
---|
100 | 100 | | district engineer's duties. |
---|
101 | 101 | | (c) The district shall pay for the bond described by |
---|
102 | 102 | | Subsection (b). |
---|
103 | 103 | | (d) The board shall determine the compensation and terms of |
---|
104 | 104 | | employment for the district engineer. |
---|
105 | 105 | | Sec. 7813.0206. BOND FOR EMPLOYEE RESPONSIBLE FOR MONEY. |
---|
106 | 106 | | (a) The board shall require an employee who collects, pays, or |
---|
107 | 107 | | handles district money to provide a good and sufficient bond that |
---|
108 | 108 | | is: |
---|
109 | 109 | | (1) in an amount sufficient to safeguard the district; |
---|
110 | 110 | | (2) payable to the district; and |
---|
111 | 111 | | (3) conditioned on: |
---|
112 | 112 | | (A) the faithful performance of the employee's |
---|
113 | 113 | | duties; and |
---|
114 | 114 | | (B) accounting for all district money and |
---|
115 | 115 | | property under the employee's control. |
---|
116 | 116 | | (b) The district shall pay for the bond described by |
---|
117 | 117 | | Subsection (a). |
---|
118 | 118 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
119 | 119 | | Sec. 7813.0301. FLOOD CONTROL DISTRICT POWERS AND DUTIES. |
---|
120 | 120 | | The district may exercise the rights, powers, privileges, and |
---|
121 | 121 | | functions provided by Section 59, Article XVI, Texas Constitution, |
---|
122 | 122 | | Chapters 49, 56, and 57, Water Code, and this chapter. |
---|
123 | 123 | | Sec. 7813.0302. LOCAL COOPERATION. The district shall |
---|
124 | 124 | | cooperate with other political subdivisions in order to provide |
---|
125 | 125 | | uniform flood prevention programs and planning. |
---|
126 | 126 | | Sec. 7813.0303. FLOOD CONTROL AND DRAINAGE PLAN. (a) The |
---|
127 | 127 | | district shall develop a flood control and drainage plan for all |
---|
128 | 128 | | land in the district, including the main channel and all |
---|
129 | 129 | | tributaries of Clear Creek. |
---|
130 | 130 | | (b) The board shall direct the district engineer to prepare |
---|
131 | 131 | | a flood control and drainage plan that provides for: |
---|
132 | 132 | | (1) control and abatement of flood water and other |
---|
133 | 133 | | excess water; and |
---|
134 | 134 | | (2) reclamation and drainage of land in the district. |
---|
135 | 135 | | (c) The district engineer shall file the completed plan with |
---|
136 | 136 | | the board and the commissioners court of each county that appoints a |
---|
137 | 137 | | director. |
---|
138 | 138 | | (d) In preparing the plan, the district engineer may: |
---|
139 | 139 | | (1) exercise the powers and shall exercise the duties |
---|
140 | 140 | | provided by Sections 56.022 and 56.023, Water Code; and |
---|
141 | 141 | | (2) consider and use all or part of any previously |
---|
142 | 142 | | prepared flood control and drainage plan that covers any area in the |
---|
143 | 143 | | district. |
---|
144 | 144 | | Sec. 7813.0304. FLOOD CONTROL AND DRAINAGE PLAN; NOTICE AND |
---|
145 | 145 | | HEARING. (a) On receipt of the completed flood control and |
---|
146 | 146 | | drainage plan, the board shall schedule a public hearing to |
---|
147 | 147 | | consider adoption of the plan. The board must publish notice of the |
---|
148 | 148 | | hearing at least once in a newspaper with general circulation in the |
---|
149 | 149 | | district not later than the 30th day before the date of the hearing. |
---|
150 | 150 | | (b) At the hearing, any person who resides or owns property |
---|
151 | 151 | | in the district or a political subdivision located wholly or partly |
---|
152 | 152 | | in the district may appear before the board and comment for or |
---|
153 | 153 | | against all or part of the plan. |
---|
154 | 154 | | Sec. 7813.0305. FLOOD CONTROL AND DRAINAGE PLAN; ADOPTION. |
---|
155 | 155 | | (a) After holding the public hearing required by Section 7813.0304, |
---|
156 | 156 | | the board shall issue its findings and decision. |
---|
157 | 157 | | (b) If the board finds that the flood control and drainage |
---|
158 | 158 | | plan requires changes before it can be adopted, the board shall |
---|
159 | 159 | | direct the district engineer to make the necessary changes. The |
---|
160 | 160 | | district engineer shall make the changes and resubmit the plan to |
---|
161 | 161 | | the board. |
---|
162 | 162 | | (c) Without further public hearing, the board may continue |
---|
163 | 163 | | to direct the district engineer to make changes to the plan until |
---|
164 | 164 | | the board finds the plan acceptable for adoption. |
---|
165 | 165 | | (d) If the board finds the plan acceptable for adoption, the |
---|
166 | 166 | | board shall submit the plan to the commissioners court of each |
---|
167 | 167 | | county that appoints a director. The commissioners courts may |
---|
168 | 168 | | consider the plan and recommend changes to the plan. |
---|
169 | 169 | | (e) If the board and commissioners courts cannot agree on |
---|
170 | 170 | | changes to the plan, the board shall submit the provisions in the |
---|
171 | 171 | | plan that are in dispute to the district engineer for resolution of |
---|
172 | 172 | | the dispute. |
---|
173 | 173 | | (f) Not earlier than the 30th day after the date the plan is |
---|
174 | 174 | | submitted to the commissioners courts, the board shall adopt the |
---|
175 | 175 | | plan as revised to reflect all necessary changes. |
---|
176 | 176 | | Sec. 7813.0306. FLOOD CONTROL AND DRAINAGE PLAN; |
---|
177 | 177 | | AMENDMENTS. After adopting the flood control and drainage plan, |
---|
178 | 178 | | the board may amend the flood control and drainage plan as necessary |
---|
179 | 179 | | to accomplish the purpose stated in Section 7813.0303. |
---|
180 | 180 | | Sec. 7813.0307. FLOOD CONTROL AND DRAINAGE PLAN; |
---|
181 | 181 | | IMPLEMENTATION. (a) In accordance with the flood control and |
---|
182 | 182 | | drainage plan, the district shall: |
---|
183 | 183 | | (1) construct improvements on the main channel of |
---|
184 | 184 | | Clear Creek that will lessen and control flooding; |
---|
185 | 185 | | (2) prevent or remove deposits of silt and remove |
---|
186 | 186 | | natural or artificial obstructions from the main channel of Clear |
---|
187 | 187 | | Creek; |
---|
188 | 188 | | (3) conduct flood-control-related maintenance on the |
---|
189 | 189 | | main channel of Clear Creek; and |
---|
190 | 190 | | (4) approve and coordinate all flood control |
---|
191 | 191 | | improvements and maintenance located in the district. |
---|
192 | 192 | | (b) Under a written agreement with a political subdivision |
---|
193 | 193 | | that is subject to the flood control and drainage plan, the district |
---|
194 | 194 | | may construct improvements on any watercourse or land in the |
---|
195 | 195 | | district to: |
---|
196 | 196 | | (1) lessen and control flooding; |
---|
197 | 197 | | (2) prevent or remove deposits of silt and remove |
---|
198 | 198 | | natural or artificial obstructions from any watercourse; or |
---|
199 | 199 | | (3) conduct flood-control-related maintenance on any |
---|
200 | 200 | | watercourse. |
---|
201 | 201 | | Sec. 7813.0308. CONSTRUCTION OF IMPROVEMENTS. (a) The |
---|
202 | 202 | | district may only construct improvements compatible with the flood |
---|
203 | 203 | | control and drainage plan. |
---|
204 | 204 | | (b) Only the district may construct improvements or perform |
---|
205 | 205 | | maintenance on the main channel of Clear Creek. The district may |
---|
206 | 206 | | contract for the construction and maintenance of improvements to |
---|
207 | 207 | | the main channel of Clear Creek. The district is responsible for |
---|
208 | 208 | | assuring that all construction and maintenance is done in |
---|
209 | 209 | | conformance with the flood control and drainage plan. |
---|
210 | 210 | | (c) Other political subdivisions than the district may |
---|
211 | 211 | | construct improvements and perform maintenance on lands draining |
---|
212 | 212 | | into Clear Creek or its tributaries, including detention |
---|
213 | 213 | | structures, and channels other than the main channel of Clear |
---|
214 | 214 | | Creek. The district may construct improvements and perform |
---|
215 | 215 | | maintenance under this subsection under an agreement with the |
---|
216 | 216 | | applicable political subdivision. |
---|
217 | 217 | | Sec. 7813.0309. PERMIT REQUIRED FOR ACTIVITY AFFECTING |
---|
218 | 218 | | FLOOD CONTROL OR DRAINAGE. (a) Except as provided by Subsection |
---|
219 | 219 | | (b), a person may not engage in an activity that will affect flood |
---|
220 | 220 | | control or drainage in the district without obtaining a permit from |
---|
221 | 221 | | the board. |
---|
222 | 222 | | (b) After notice and hearing, the board may adopt a rule or |
---|
223 | 223 | | issue an order that exempts a specified activity from obtaining a |
---|
224 | 224 | | permit under this section. The board may exempt an activity only if |
---|
225 | 225 | | the board, after consultation with the district engineer, finds |
---|
226 | 226 | | that the activity will have at most a minimal effect on flood |
---|
227 | 227 | | control and drainage. |
---|
228 | 228 | | Sec. 7813.0310. NOTICE OF ACTIVITIES AFFECTING FLOOD |
---|
229 | 229 | | CONTROL OR DRAINAGE. (a) A person that plans to engage in an |
---|
230 | 230 | | activity that will affect flood control or drainage in the district |
---|
231 | 231 | | shall submit written notice to the board of the intent to engage in |
---|
232 | 232 | | the activity, accompanied by plans, specifications, and other |
---|
233 | 233 | | information relating to the activity. |
---|
234 | 234 | | (b) A person shall submit the notice and other information |
---|
235 | 235 | | required by Subsection (a) in the form and time period provided by |
---|
236 | 236 | | board rules. |
---|
237 | 237 | | Sec. 7813.0311. CONSIDERATION OF ACTIVITY BY DISTRICT |
---|
238 | 238 | | ENGINEER. (a) On receiving notice of a proposed activity under |
---|
239 | 239 | | Section 7813.0310, the board shall submit the notice and other |
---|
240 | 240 | | information to the district engineer for consideration. |
---|
241 | 241 | | (b) The district engineer shall examine the notice and other |
---|
242 | 242 | | information to determine: |
---|
243 | 243 | | (1) the effect of the proposed activity on flood |
---|
244 | 244 | | control and drainage in the district; and |
---|
245 | 245 | | (2) whether the proposed activity is compatible with |
---|
246 | 246 | | the flood control and drainage plan. |
---|
247 | 247 | | (c) The district engineer shall consult with the person |
---|
248 | 248 | | submitting the notice and information and suggest changes in the |
---|
249 | 249 | | proposed plans and specifications for the activity necessary to |
---|
250 | 250 | | make the activity compatible with the flood control and drainage |
---|
251 | 251 | | plan. |
---|
252 | 252 | | (d) If the district engineer and the person proposing an |
---|
253 | 253 | | activity agree to plans and specifications for the activity that |
---|
254 | 254 | | are compatible with the flood control and drainage plan as |
---|
255 | 255 | | determined by the district engineer, the district engineer shall |
---|
256 | 256 | | recommend that the board issue a permit authorizing the activity. |
---|
257 | 257 | | If the district engineer and the person proposing an activity |
---|
258 | 258 | | cannot agree, the district engineer shall recommend that the board |
---|
259 | 259 | | decline to issue a permit authorizing the activity. The district |
---|
260 | 260 | | engineer's recommendation shall be included in a brief written |
---|
261 | 261 | | report to the board stating the district engineer's reasons for the |
---|
262 | 262 | | recommendation. |
---|
263 | 263 | | Sec. 7813.0312. BOARD CONSIDERATION AND ACTION. (a) On |
---|
264 | 264 | | receiving the district engineer's report under Section |
---|
265 | 265 | | 7813.0311(d), the board may issue a permit without giving notice or |
---|
266 | 266 | | holding a public hearing to consider the issuance. |
---|
267 | 267 | | (b) After consideration of the district engineer's report, |
---|
268 | 268 | | the board may deny issuance of a permit only if the board gives |
---|
269 | 269 | | notice and holds a public hearing in accordance with the district's |
---|
270 | 270 | | rules to consider the issuance of the permit. After conducting the |
---|
271 | 271 | | hearing, the board shall issue a written decision granting or |
---|
272 | 272 | | denying the permit or granting the permit subject to specific |
---|
273 | 273 | | requirements. The decision must state the findings of the board in |
---|
274 | 274 | | making the decision. |
---|
275 | 275 | | Sec. 7813.0313. OBSTRUCTIONS AND STRUCTURES. (a) A person |
---|
276 | 276 | | may not place an obstruction or construct or alter a structure that |
---|
277 | 277 | | affects flood control or drainage on land in the district if the |
---|
278 | 278 | | obstruction or structure is not compatible with the flood control |
---|
279 | 279 | | and drainage plan and the district has not issued a permit for the |
---|
280 | 280 | | activity. |
---|
281 | 281 | | (b) After notice and hearing, the board may issue an order |
---|
282 | 282 | | directing a person to remove or make changes to an obstruction or |
---|
283 | 283 | | structure constructed after adoption of the flood control and |
---|
284 | 284 | | drainage plan as necessary to comply with the plan. |
---|
285 | 285 | | Sec. 7813.0314. INJUNCTIVE RELIEF. If a person engages in |
---|
286 | 286 | | an activity that will affect flood control or drainage in the |
---|
287 | 287 | | district without a permit or places an obstruction or constructs or |
---|
288 | 288 | | alters a structure in violation of an order issued by the board |
---|
289 | 289 | | under Section 7813.0313, the board may sue in a district court in |
---|
290 | 290 | | any county in which the activity is occurring or an obstruction is |
---|
291 | 291 | | built for injunctive relief to restrain the person from continuing |
---|
292 | 292 | | the violation or to require the person to remove an obstruction or |
---|
293 | 293 | | structure. |
---|
294 | 294 | | Sec. 7813.0315. CIVIL PENALTY. (a) A person who violates |
---|
295 | 295 | | Section 7813.0309 or 7813.0313 or any order issued by the board |
---|
296 | 296 | | under Section 7813.0309 or 7813.0313 is subject to a civil penalty |
---|
297 | 297 | | of not less than $100 or more than $1,000 for each violation or each |
---|
298 | 298 | | day of a continuing violation. |
---|
299 | 299 | | (b) If a suit is filed under this section to recover a civil |
---|
300 | 300 | | penalty, the court may include in any final judgment in favor of the |
---|
301 | 301 | | district an award to cover court costs and reasonable attorney's |
---|
302 | 302 | | fees. |
---|
303 | 303 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS |
---|
304 | 304 | | Sec. 7813.0401. ELECTIONS REGARDING TAXES OR BONDS. (a) |
---|
305 | 305 | | The district may issue, without an election, bonds and other |
---|
306 | 306 | | obligations secured by revenue other than ad valorem taxes. |
---|
307 | 307 | | (b) The district must hold an election in the manner |
---|
308 | 308 | | provided by Chapters 49 and 57, Water Code, to obtain voter approval |
---|
309 | 309 | | before the district may impose an ad valorem tax or issue bonds |
---|
310 | 310 | | payable from ad valorem taxes. |
---|
311 | 311 | | Sec. 7813.0402. OPERATION AND MAINTENANCE TAX. (a) If |
---|
312 | 312 | | authorized at an election held under Section 7813.0401, the |
---|
313 | 313 | | district may impose an operation and maintenance tax on taxable |
---|
314 | 314 | | property in the district in accordance with Section 49.107, Water |
---|
315 | 315 | | Code. |
---|
316 | 316 | | (b) The board shall determine the tax rate. The rate may not |
---|
317 | 317 | | exceed the rate approved at the election. |
---|
318 | 318 | | Sec. 7813.0403. BUDGET. (a) The board shall adopt an |
---|
319 | 319 | | annual budget containing a complete financial statement of the |
---|
320 | 320 | | district. |
---|
321 | 321 | | (b) The board shall conduct a public hearing on the proposed |
---|
322 | 322 | | budget on a date set by the board after August 15 and before the |
---|
323 | 323 | | imposition of district taxes. The board shall give public notice of |
---|
324 | 324 | | the hearing by publication in a newspaper of general circulation in |
---|
325 | 325 | | the district at least 15 days before the date of the hearing. |
---|
326 | 326 | | SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS |
---|
327 | 327 | | Sec. 7813.0501. AUTHORITY TO ISSUE BONDS AND OTHER |
---|
328 | 328 | | OBLIGATIONS. The district may issue bonds or other obligations |
---|
329 | 329 | | payable wholly or partly from ad valorem taxes, impact fees, |
---|
330 | 330 | | revenue, contract payments, grants, or other district money, or any |
---|
331 | 331 | | combination of those sources, to pay for any authorized district |
---|
332 | 332 | | purpose. |
---|
333 | 333 | | Sec. 7813.0502. TAXES FOR BONDS. At the time the district |
---|
334 | 334 | | issues bonds payable wholly or partly from ad valorem taxes, the |
---|
335 | 335 | | board shall provide for the annual imposition of a continuing |
---|
336 | 336 | | direct ad valorem tax, without limit as to rate or amount, while all |
---|
337 | 337 | | or part of the bonds are outstanding as required and in the manner |
---|

348 | 348 | | the construction of an improvement identified in the flood control |
---|
349 | 349 | | and drainage plan. The district shall provide the proceeds from the |

350 | 350 | | bonds to the local political subdivision for the construction of |

351 | 351 | | the improvement, or, if the contract with the political subdivision |

352 | 352 | | requires the district to construct the improvements, the district |

353 | 353 | | shall use the proceeds for the required construction. Bonds issued |

354 | 354 | | under this section are subject to Subchapter F, Chapter 49, Water |
---|
355 | 355 | | Code, except that any provision associated with the imposition of |
---|
356 | 356 | | an ad valorem tax does not apply. |
---|
357 | 357 | | (b) A political subdivision located wholly or partly in the |
---|
358 | 358 | | district may enter into any contract with the district. The |
---|
359 | 359 | | political subdivision may pledge to the payment of the contract any |
---|
360 | 360 | | source of revenue available to the political subdivision, including |
---|
361 | 361 | | the imposition of ad valorem taxes, if the political subdivision |
---|
362 | 362 | | has the authority to impose those taxes. To the extent a political |
---|
363 | 363 | | subdivision pledges money to be derived from any of its own systems, |
---|
364 | 364 | | the payments constitute an operating expense of that system. |
---|
365 | 365 | | (c) The district may issue bonds supported by revenues under |

366 | 366 | | this section to finance all or part of the cost of construction of |

367 | 367 | | improvements under the flood control and drainage plan implemented |

472 | 472 | | SECTION 4. (a) If this Act does not receive a two-thirds |

475 | 475 | | this Act, is amended by adding Section 7813.0316 to read as follows: |

478 | 478 | | (b) This section is not intended to be an expression of a |

479 | 479 | | legislative interpretation of the requirements of Section 17(c), |

480 | 480 | | Article I, Texas Constitution. |

481 | 481 | | SECTION 5. This Act takes effect immediately if it receives |

482 | 482 | | a vote of two-thirds of all the members elected to each house, as |
---|
483 | 483 | | provided by Section 39, Article III, Texas Constitution. If this |

484 | 484 | | Act does not receive the vote necessary for immediate effect, this |
