7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Sections 411.1741(a) and (b), Government Code, |
---|
9 | 15 | | are amended to read as follows: |
---|
10 | 16 | | (a) When a person applies for an original or renewal license |
---|
11 | 17 | | to carry a [concealed] handgun under this subchapter, the person |
---|
12 | 18 | | may make a voluntary contribution in any amount to the fund for |
---|
13 | 19 | | veterans' assistance established by Section 434.017. |
---|
14 | 20 | | (b) The department shall: |
---|
15 | 21 | | (1) include space on the first page of each |
---|
16 | 22 | | application for an original or renewal license to carry a |
---|
17 | 23 | | [concealed] handgun that allows a person applying for an original |
---|
18 | 24 | | or renewal license to carry a [concealed] handgun to indicate the |
---|
19 | 25 | | amount that the person is voluntarily contributing to the fund; and |
---|
20 | 26 | | (2) provide an opportunity for the person to |
---|
21 | 27 | | contribute to the fund during the application process for an |
---|
22 | 28 | | original or renewal license to carry a [concealed] handgun on the |
---|
23 | 29 | | department's Internet website. |
---|
24 | 30 | | SECTION 2. The heading to Section 411.181, Government Code, |
---|
25 | 31 | | is amended to read as follows: |
---|
26 | 32 | | Sec. 411.181. NOTICE OF CHANGE OF INFORMATION; DUPLICATE |
---|
27 | 33 | | LICENSE [ADDRESS OR NAME]. |
---|
28 | 34 | | SECTION 3. Section 411.181, Government Code, is amended by |
---|
29 | 35 | | adding Subsection (a-1) to read as follows: |
---|
30 | 36 | | (a-1) If a license holder whose license will expire under |
---|
31 | 37 | | Section 411.183(a)(1)(B) or (b)(1)(B) is granted an extension for |
---|
32 | 38 | | the license holder's lawful presence in the United States as |
---|
33 | 39 | | determined by the United States agency responsible for citizenship |
---|
34 | 40 | | and immigration in compliance with federal law, the license holder |
---|
35 | 41 | | may apply to the department for a duplicate license with an updated |
---|
36 | 42 | | expiration date by providing to the department the person's license |
---|
37 | 43 | | number and evidence of the extension. The duplicate license must |
---|
38 | 44 | | provide for an expiration date, calculated in accordance with |
---|
39 | 45 | | Section 411.183(a) or (b), as applicable, that takes into account |
---|
40 | 46 | | the extension of the period for which the license holder may be |
---|
41 | 47 | | lawfully present in the United States. |
---|
42 | 48 | | SECTION 4. Sections 411.183(a), (b), and (c), Government |
---|
43 | 49 | | Code, are amended to read as follows: |
---|
44 | 50 | | (a) A license issued under this subchapter expires on: |
---|
45 | 51 | | (1) the earlier of: |
---|
46 | 52 | | (A) the first birthday of the license holder |
---|
47 | 53 | | occurring after the fourth anniversary of the date of issuance; or |
---|
48 | 54 | | (B) the expiration of the license holder's lawful |
---|
49 | 55 | | presence in the United States as determined by the United States |
---|
50 | 56 | | agency responsible for citizenship and immigration in compliance |
---|
51 | 57 | | with federal law; or |
---|
52 | 58 | | (2) the first anniversary of the date of issuance, if |
---|
53 | 59 | | there is no definite expiration date for the applicant's lawful |
---|
54 | 60 | | presence in the United States. |
---|
55 | 61 | | (b) A renewed license expires on: |
---|
56 | 62 | | (1) the earlier of: |
---|
57 | 63 | | (A) the license holder's birthdate, five years |
---|
58 | 64 | | after the date of the expiration of the previous license; or |
---|
59 | 65 | | (B) the expiration of the license holder's lawful |
---|
60 | 66 | | presence in the United States as determined by the United States |
---|
61 | 67 | | agency responsible for citizenship and immigration in compliance |
---|
62 | 68 | | with federal law; or |
---|
63 | 69 | | (2) the first anniversary of the date of renewal, if |
---|
64 | 70 | | there is no definite expiration date for the applicant's lawful |
---|
65 | 71 | | presence in the United States. |
---|
66 | 72 | | (c) Except as otherwise provided by Section 411.181(a-1), a |
---|
67 | 73 | | [A] duplicate license expires on the date the license that was |
---|
68 | 74 | | duplicated would have expired. |
---|
69 | 75 | | SECTION 5. The changes in law made by this Act apply only to |
---|
70 | 76 | | an application for an original, renewal, or duplicate license to |
---|
71 | 77 | | carry a handgun submitted on or after the effective date of this |
---|
72 | 78 | | Act. An application submitted before the effective date of this Act |
---|
73 | 79 | | is governed by the law in effect on the date the application was |
---|
74 | 80 | | submitted, and the former law is continued in effect for that |
---|
75 | 81 | | purpose. |
---|
76 | 82 | | SECTION 6. This Act takes effect September 1, 2019. |
