410 AN ACT
511 relating to the application for and expiration of a license to carry
612 a handgun.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Sections 411.1741(a) and (b), Government Code,
915 are amended to read as follows:
1016 (a) When a person applies for an original or renewal license
1117 to carry a [concealed] handgun under this subchapter, the person
1218 may make a voluntary contribution in any amount to the fund for
1319 veterans' assistance established by Section 434.017.
1420 (b) The department shall:
1521 (1) include space on the first page of each
1622 application for an original or renewal license to carry a
1723 [concealed] handgun that allows a person applying for an original
1824 or renewal license to carry a [concealed] handgun to indicate the
1925 amount that the person is voluntarily contributing to the fund; and
2026 (2) provide an opportunity for the person to
2127 contribute to the fund during the application process for an
2228 original or renewal license to carry a [concealed] handgun on the
2329 department's Internet website.
2430 SECTION 2. The heading to Section 411.181, Government Code,
2531 is amended to read as follows:
2632 Sec. 411.181. NOTICE OF CHANGE OF INFORMATION; DUPLICATE
2733 LICENSE [ADDRESS OR NAME].
2834 SECTION 3. Section 411.181, Government Code, is amended by
2935 adding Subsection (a-1) to read as follows:
3036 (a-1) If a license holder whose license will expire under
3137 Section 411.183(a)(1)(B) or (b)(1)(B) is granted an extension for
3238 the license holder's lawful presence in the United States as
3339 determined by the United States agency responsible for citizenship
3440 and immigration in compliance with federal law, the license holder
3541 may apply to the department for a duplicate license with an updated
3642 expiration date by providing to the department the person's license
3743 number and evidence of the extension. The duplicate license must
3844 provide for an expiration date, calculated in accordance with
3945 Section 411.183(a) or (b), as applicable, that takes into account
4046 the extension of the period for which the license holder may be
4147 lawfully present in the United States.
4248 SECTION 4. Sections 411.183(a), (b), and (c), Government
4349 Code, are amended to read as follows:
4450 (a) A license issued under this subchapter expires on:
4551 (1) the earlier of:
4652 (A) the first birthday of the license holder
4753 occurring after the fourth anniversary of the date of issuance; or
4854 (B) the expiration of the license holder's lawful
4955 presence in the United States as determined by the United States
5056 agency responsible for citizenship and immigration in compliance
5157 with federal law; or
5258 (2) the first anniversary of the date of issuance, if
5359 there is no definite expiration date for the applicant's lawful
5460 presence in the United States.
5561 (b) A renewed license expires on:
5662 (1) the earlier of:
5763 (A) the license holder's birthdate, five years
5864 after the date of the expiration of the previous license; or
5965 (B) the expiration of the license holder's lawful
6066 presence in the United States as determined by the United States
6167 agency responsible for citizenship and immigration in compliance
6268 with federal law; or
6369 (2) the first anniversary of the date of renewal, if
6470 there is no definite expiration date for the applicant's lawful
6571 presence in the United States.
6672 (c) Except as otherwise provided by Section 411.181(a-1), a
6773 [A] duplicate license expires on the date the license that was
6874 duplicated would have expired.
6975 SECTION 5. The changes in law made by this Act apply only to
7076 an application for an original, renewal, or duplicate license to
7177 carry a handgun submitted on or after the effective date of this
7278 Act. An application submitted before the effective date of this Act
7379 is governed by the law in effect on the date the application was
7480 submitted, and the former law is continued in effect for that
7581 purpose.
7682 SECTION 6. This Act takes effect September 1, 2019.
