| 10 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 13 | | SECTION 1. Section 71.035, Government Code, is amended by |
|---|
| 12 | 14 | | adding Subsection (e) to read as follows: |
|---|
| 13 | 15 | | (e) In accordance with Subsection (b), the council shall |
|---|
| 14 | 16 | | request statistics related to: |
|---|
| 15 | 17 | | (1) reductions by courts of state jail felony |
|---|
| 16 | 18 | | punishment to misdemeanor punishment in accordance with Section |
|---|
| 17 | 19 | | 12.44, Penal Code, including: |
|---|
| 18 | 20 | | (A) the number and type of offenses for which a |
|---|
| 19 | 21 | | court sentenced a defendant under Section 12.44(a), Penal Code; and |
|---|
| 20 | 22 | | (B) the number and type of offenses for which a |
|---|
| 21 | 23 | | court authorized prosecution under Section 12.44(b), Penal Code; |
|---|
| 22 | 24 | | and |
|---|
| 23 | 25 | | (2) the number of defendants placed in a pretrial |
|---|
| 24 | 26 | | diversion or pretrial intervention program. |
|---|
| 25 | 27 | | SECTION 2. This Act takes effect September 1, 2019. |
