9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 2306.6710(f), Government Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (f) In evaluating the level of community support for an | |
13 | 13 | application under Subsection (b)(1)(J), the department shall | |
14 | 14 | award: | |
15 | 15 | (1) positive points for positive written statements | |
16 | 16 | received, unless a resolution is voted on and approved in support of | |
17 | 17 | the application under Subsection (b)(1)(B); | |
18 | 18 | (2) negative points for negative written statements | |
19 | 19 | received; and | |
20 | 20 | (3) zero points for neutral statements received. | |
21 | 21 | SECTION 2. The change in law made by this Act applies only | |
22 | 22 | to an application for low income housing tax credits that is | |
23 | 23 | submitted to the Texas Department of Housing and Community Affairs | |
24 | 24 | during an application cycle that is based on the 2020 qualified | |
25 | 25 | allocation plan or a subsequent plan adopted by the governing board | |
26 | 26 | of the department. An application that is submitted during an | |
27 | 27 | application cycle that is based on an earlier qualified allocation | |
28 | 28 | plan is governed by the law in effect on the date the application | |
29 | 29 | cycle began, and the former law is continued in effect for that | |
30 | 30 | purpose. | |
31 | 31 | SECTION 3. This Act takes effect September 1, 2019. |
