55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the system by which an application for a low income
88 housing tax credit is scored.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.6710(f), Government Code, is
1111 amended to read as follows:
1212 (f) In evaluating the level of community support for an
1313 application under Subsection (b)(1)(J), the department shall
1414 award:
1515 (1) positive points for positive written statements
1616 received, unless a resolution is voted on and approved in support of
1717 the application under Subsection (b)(1)(B);
1818 (2) negative points for negative written statements
1919 received; and
2020 (3) zero points for neutral statements received.
2121 SECTION 2. The change in law made by this Act applies only
2222 to an application for low income housing tax credits that is
2323 submitted to the Texas Department of Housing and Community Affairs
2424 during an application cycle that is based on the 2020 qualified
2525 allocation plan or a subsequent plan adopted by the governing board
2626 of the department. An application that is submitted during an
2727 application cycle that is based on an earlier qualified allocation
2828 plan is governed by the law in effect on the date the application
2929 cycle began, and the former law is continued in effect for that
3030 purpose.
3131 SECTION 3. This Act takes effect September 1, 2019.
