| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 87.121, Election Code, is amended by |
|---|
| 10 | 12 | | amending Subsections (g) and (h) and adding Subsection (i) to read |
|---|
| 11 | 13 | | as follows: |

| 12 | 14 | | (g) Information on the roster for a person who votes an |
|---|
| 13 | 15 | | early voting ballot by personal appearance shall be made available |
|---|
| 14 | 16 | | for public inspection as provided by Subsection (i) not later than |
|---|
| 15 | 17 | | 11 a.m. [the beginning of regular business hours] on the day after |
|---|
| 16 | 18 | | the date the information is entered on the roster under Subsection |
|---|
| 17 | 19 | | (c). |

| 18 | 20 | | (h) Information on the roster for a person who votes an |
|---|
| 19 | 21 | | early voting ballot by mail shall be made available for public |
|---|
| 20 | 22 | | inspection as provided by Subsection (i) not later than 11 a.m. on |
|---|
| 21 | 23 | | the day following the day the early voting clerk receives a ballot |
|---|
| 22 | 24 | | voted by mail. |

| 23 | 25 | | (i) The information under Subsections (g) and (h) must be |
|---|
| 24 | 26 | | made available: |
|---|
| 25 | 27 | | (1) for an election in which the county clerk is the |
|---|
| 26 | 28 | | early voting clerk: |

| 27 | 29 | | (A) on the publicly accessible Internet website |
|---|
| 28 | 30 | | of the county; or |
|---|
| 29 | 31 | | (B) if the county does not maintain a website, on |
|---|
| 30 | 32 | | the bulletin board used for posting notice of meetings of the |
|---|
| 31 | 33 | | commissioners court; or |
|---|
| 32 | 34 | | (2) for an election not described by Subdivision (1): |
|---|
| 33 | 35 | | (A) on the publicly accessible Internet website |
|---|
| 34 | 36 | | of the authority ordering the election; or |
|---|
| 35 | 37 | | (B) if the authority ordering the election does |
|---|
| 36 | 38 | | not maintain a website, on the bulletin board used for posting |
|---|
| 37 | 39 | | notice of meetings of the governing body of the authority. |
|---|
| 38 | 40 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 39 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 44 | | Act takes effect September 1, 2019. |
