| 12 | 11 | SECTION 1. Section 35.152, Utilities Code, is amended by | |
| 13 | 12 | adding Subsection (d) to read as follows: | |
| 14 | 13 | (d) Subsection (b) does not require a municipally owned | |
| 15 | 14 | utility or an electric cooperative that owns or operates electric | |
| 16 | 15 | energy storage equipment or facilities described by Subsection (a) | |
| 17 | 16 | to register as a power generation company under Section 39.351(a). | |
| 18 | 17 | SECTION 2. This Act takes effect September 1, 2019. |
