66 AN ACT
77 relating to exceptions from the requirement for a person under the
88 direction or control of a local entity or campus police department
99 to assist or cooperate with federal immigration officers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 752.053(c), Government Code, is amended
1212 to read as follows:
1313 (c) Notwithstanding Subsection (b)(3), a local entity or
1414 campus police department may prohibit persons who are employed by
1515 or otherwise under the direction or control of the entity or
1616 department from assisting or cooperating with a federal immigration
1717 officer if the assistance or cooperation occurs:
1818 (1) at a place of worship;
1919 (2) on the property of a school district,
2020 open-enrollment charter school, or private school;
2121 (3) at an institution of higher education; or
2222 (4) at a hospital, emergency clinic, outpatient
2323 clinic, birthing center, ambulatory surgical center, or other
2424 facility providing health care services.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
