| 7 | 7 | | relating to exceptions from the requirement for a person under the |

| 8 | 8 | | direction or control of a local entity or campus police department |
|---|
| 9 | 9 | | to assist or cooperate with federal immigration officers. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 752.053(c), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (c) Notwithstanding Subsection (b)(3), a local entity or |
|---|
| 14 | 14 | | campus police department may prohibit persons who are employed by |
|---|
| 15 | 15 | | or otherwise under the direction or control of the entity or |
|---|
| 16 | 16 | | department from assisting or cooperating with a federal immigration |
|---|
| 17 | 17 | | officer if the assistance or cooperation occurs: |
|---|
| 18 | 18 | | (1) at a place of worship; |
|---|
| 19 | 19 | | (2) on the property of a school district, |
|---|
| 20 | 20 | | open-enrollment charter school, or private school; |
|---|
| 21 | 21 | | (3) at an institution of higher education; or |
|---|
| 22 | 22 | | (4) at a hospital, emergency clinic, outpatient |
|---|
| 23 | 23 | | clinic, birthing center, ambulatory surgical center, or other |
|---|
| 24 | 24 | | facility providing health care services. |

| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2019. |
