410 AN ACT
511 relating to the provision of mental health services through a
612 telemedicine medical service or telehealth service.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subtitle A, Title 3, Occupations Code, is
915 amended by adding Chapter 113 to read as follows:
1016 CHAPTER 113. MENTAL HEALTH TELEMEDICINE AND TELEHEALTH SERVICES
1117 Sec. 113.001. DEFINITIONS. The definitions provided by
1218 Section 111.001 apply to this chapter.
1319 Sec. 113.002. PATIENT LOCATED OUTSIDE OF STATE.
1420 Notwithstanding any other law, a health professional may provide a
1521 mental health service that is within the scope of the
1622 professional's license, certification, or authorization through
1723 the use of a telemedicine medical service or a telehealth service to
1824 a patient who is located outside of this state, subject to any
1925 applicable regulation of the jurisdiction in which the patient is
2026 located.
2127 SECTION 2. This Act takes effect September 1, 2019.
