| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Subtitle A, Title 3, Occupations Code, is |
|---|
| 9 | 15 | | amended by adding Chapter 113 to read as follows: |
|---|
| 10 | 16 | | CHAPTER 113. MENTAL HEALTH TELEMEDICINE AND TELEHEALTH SERVICES |
|---|
| 11 | 17 | | Sec. 113.001. DEFINITIONS. The definitions provided by |
|---|
| 12 | 18 | | Section 111.001 apply to this chapter. |
|---|
| 13 | 19 | | Sec. 113.002. PATIENT LOCATED OUTSIDE OF STATE. |
|---|
| 14 | 20 | | Notwithstanding any other law, a health professional may provide a |
|---|
| 15 | 21 | | mental health service that is within the scope of the |
|---|
| 16 | 22 | | professional's license, certification, or authorization through |
|---|
| 17 | 23 | | the use of a telemedicine medical service or a telehealth service to |
|---|
| 18 | 24 | | a patient who is located outside of this state, subject to any |
|---|
| 19 | 25 | | applicable regulation of the jurisdiction in which the patient is |
|---|
| 20 | 26 | | located. |

| 21 | 27 | | SECTION 2. This Act takes effect September 1, 2019. |
