55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of a grant program and task force
88 relating to disaster issues affecting persons who are elderly and
99 persons with disabilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 418, Government Code, is amended by
1212 adding Subchapter F-1 to read as follows:
1313 SUBCHAPTER F-1. DISASTER ISSUES AFFECTING PERSONS WHO ARE ELDERLY
1414 AND PERSONS WITH DISABILITIES
1515 Sec. 418.131. DEFINITIONS. In this subchapter:
1616 (1) "Disability" means, with respect to an individual,
1717 a mental or physical impairment that substantially limits at least
1818 one major life activity of that individual.
1919 (2) "Task force" means the task force established
2020 under Section 418.132.
2121 Sec. 418.132. ESTABLISHMENT; PURPOSE. The task force on
2222 disaster issues affecting persons who are elderly and persons with
2323 disabilities is established to:
2424 (1) administer the grant program under Section
2525 418.134; and
2626 (2) study methods to more effectively:
2727 (A) assist persons who are elderly and persons
2828 with disabilities during a disaster or emergency evacuation; and
2929 (B) accommodate persons who are elderly and
3030 persons with disabilities in emergency shelters.
3131 Sec. 418.133. COMPOSITION. (a) The task force is composed
3232 of 11 members appointed by the governor, including:
3333 (1) three members who are first responders;
3434 (2) one member who represents municipalities;
3535 (3) one member who represents counties; and
3636 (4) six members who represent persons with
3737 disabilities, including one who represents persons who are blind,
3838 one who represents persons who are deaf, and one selected from a
3939 list provided by ADAPT of Texas.
4040 (b) A majority of the members appointed to the task force
4141 must be persons with disabilities or guardians of children with
4242 disabilities.
4343 (c) Members serve staggered six-year terms with the terms of
4444 three or four members expiring February 1 of each odd-numbered
4545 year.
4646 (d) The governor shall designate one member of the task
4747 force to serve as the presiding officer of the task force. The
4848 presiding officer serves in that capacity at the pleasure of the
4949 governor.
5050 Sec. 418.134. GRANT PROGRAM. (a) From funds appropriated
5151 for the purpose and gifts, grants, and donations accepted for the
5252 purpose, the division shall award grants as provided by this
5353 subchapter to provide financial support for:
5454 (1) activities that include persons who are elderly
5555 and persons with disabilities in the preparation for, response to,
5656 recovery from, and mitigation of disasters;
5757 (2) strategies and procedures that implement
5858 community-level practices that decrease deaths, injuries, and harm
5959 resulting from disasters to persons who are elderly and persons
6060 with disabilities;
6161 (3) the development of state and local policies that
6262 reinforce and promote the inclusion of persons who are elderly and
6363 persons with disabilities in community preparation for disasters;
6464 and
6565 (4) research related to disasters and persons who are
6666 elderly and persons with disabilities.
6767 (b) The task force shall review grant proposals and
6868 recommend grant recipients to the division. The division shall
6969 award grants based on those recommendations.
7070 (c) The division shall establish procedures to administer
7171 the grant program, including a procedure for the submission of a
7272 proposal.
7373 (d) The division shall enter into a contract with each grant
7474 recipient that includes performance requirements. The division
7575 shall monitor and enforce the terms of the contract. The contract
7676 must authorize the division to recoup grant money from a grant
7777 recipient for failure of the grant recipient to comply with the
7878 terms of the contract.
7979 (e) The division may solicit and accept gifts, grants, and
8080 donations from any source for the purpose of awarding grants under
8181 this section.
8282 Sec. 418.135. TASK FORCE STUDY. (a) The task force shall
8383 study methods to more effectively accommodate persons who are
8484 elderly and persons with disabilities during a disaster or
8585 emergency evacuation. The study must examine and make
8686 recommendations on:
8787 (1) the provision of informational materials to
8888 persons who are elderly and persons with disabilities before a
8989 disaster occurs on disaster or emergency evacuation;
9090 (2) the accessibility of transportation and medical
9191 supplies to persons who are elderly and persons with disabilities
9292 during a disaster;
9393 (3) different solutions for accommodating persons who
9494 are elderly and persons with disabilities during a disaster or
9595 emergency evacuation of a rural or urban area;
9696 (4) the ability to effectively communicate with
9797 persons who are elderly and persons with disabilities during a
9898 disaster; and
9999 (5) the availability of volunteers to assist persons
100100 who are elderly and persons with disabilities during an emergency
101101 evacuation.
102102 (b) The task force shall develop and submit a written report
103103 of the study and recommendations developed by the task force to the
104104 governor, the lieutenant governor, the speaker of the house of
105105 representatives, and each member of the legislature not later than
106106 December 1, 2020.
107107 (c) This section expires June 1, 2021.
108108 SECTION 2. This Act takes effect September 1, 2019.
