| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter E, Chapter 375, Local Government |
|---|
| 10 | 10 | | Code, is amended by adding Section 375.099 to read as follows: |
|---|
| 11 | 11 | | Sec. 375.099. COMMUNITY DEVELOPMENT IN CERTAIN COUNTIES. |

| 12 | 12 | | (a) |
|---|
| 13 | 13 | | This section applies only to a district in a county with a |
|---|
| 14 | 14 | | population of more than two million that is adjacent to another |
|---|
| 15 | 15 | | county with a population of more than one million. |
|---|
| 16 | 16 | | (b) The district may develop and administer a community and |
|---|
| 17 | 17 | | economic development program described by Section 381.004(b)(2), |
|---|
| 18 | 18 | | (5), (6), or (7) in the same manner as a commissioners court. |
|---|
| 19 | 19 | | (c) If the municipality creates a tax increment |
|---|
| 20 | 20 | | reinvestment zone under Chapter 311, Tax Code, the municipality, by |
|---|
| 21 | 21 | | contract with the district, may grant money deposited in the tax |
|---|
| 22 | 22 | | increment fund to the district to be used by the district for the |
|---|
| 23 | 23 | | purposes permitted for money granted to a corporation under Section |
|---|
| 24 | 24 | | 380.002(b), Local Government Code. |
|---|
| 25 | 25 | | (d) The district may require that a person who receives a |
|---|
| 26 | 26 | | financial incentive or benefit from the district for construction |
|---|
| 27 | 27 | | or the development of property in the district provide support for a |
|---|
| 28 | 28 | | community development project in the district. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2019. |
