6	6	AN ACT
7	7	relating to prohibiting the use of photographic traffic signal
8	8	enforcement systems.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. The heading to Chapter 707, Transportation Code,
11	11	is amended to read as follows:
12	12	CHAPTER 707. PHOTOGRAPHIC TRAFFIC SIGNAL
13	13	ENFORCEMENT SYSTEM PROHIBITED
14	14	SECTION 2. Chapter 707, Transportation Code, is amended by
15	15	adding Sections 707.020, 707.021, and 707.022 to read as follows:
16	16	Sec. 707.020. PHOTOGRAPHIC TRAFFIC SIGNAL ENFORCEMENT
17	17	SYSTEM PROHIBITED. (a) Notwithstanding any other law, a local
18	18	authority may not implement or operate a photographic traffic
19	19	signal enforcement system with respect to a highway or street under
20	20	the jurisdiction of the authority.
21	21	(b) The attorney general shall enforce this section.
22	22	Sec. 707.021. USE OF EVIDENCE FROM PHOTOGRAPHIC TRAFFIC
23	23	SIGNAL ENFORCEMENT SYSTEM PROHIBITED. Notwithstanding any other
24	24	law, a local authority may not issue a civil or criminal charge or
25	25	citation for an offense or violation based on a recorded image
26	26	produced by a photographic traffic signal enforcement system.
27	27	Sec. 707.022. SCHOOL BUS USE EXCEPTED. This chapter does
28	28	not apply to a photographic traffic signal enforcement system that
29	29	is capable of taking photographic or digital images of vehicles
30	30	that pass a school bus if:
31	31	(1) the system is used only for the prosecution of a
32	32	criminal offense; and
33	33	(2) a person who is cited for a criminal offense as a
34	34	result of evidence obtained by the system is authorized to contest
35	35	the citation in court.
36	36	SECTION 3. Section 27.031(a), Government Code, is amended
37	37	to read as follows:
38	38	(a) In addition to the jurisdiction and powers provided by
39	39	the constitution and other law, the justice court has original
40	40	jurisdiction of:
41	41	(1) civil matters in which exclusive jurisdiction is
42	42	not in the district or county court and in which the amount in
43	43	controversy is not more than $10,000, exclusive of interest;
44	44	(2) cases of forcible entry and detainer; and
45	45	(3) foreclosure of mortgages and enforcement of liens
46	46	on personal property in cases in which the amount in controversy is
47	47	otherwise within the justice court's jurisdiction[; and
48	48	[(4) cases arising under Chapter 707, Transportation
49	49	Code, outside a municipality's territorial limits].
50	50	SECTION 4. Section 780.003(b), Health and Safety Code, is
51	51	amended to read as follows:
52	52	(b) The account is composed of money deposited to the credit
53	53	of the account under the [Sections 542.406 and 707.008,]
54	54	Transportation Code[,] and under Section 780.002 of this code.
55	55	SECTION 5. Section 133.004, Local Government Code, as
56	56	amended by Chapters 718 (H.B. 2359), 1027 (H.B. 1623), and 1149
57	57	(S.B. 1119), Acts of the 80th Legislature, Regular Session, 2007,
58	58	is reenacted and amended to read as follows:
59	59	Sec. 133.004. CIVIL FEES. This chapter applies to the
60	60	following civil fees:
61	61	(1) the consolidated fee on filing in district court
62	62	imposed under Section 133.151;
63	63	(2) the filing fee in district court for basic civil
64	64	legal services for indigents imposed under Section 133.152;
65	65	(3) the filing fee in courts other than district court
66	66	for basic civil legal services for indigents imposed under Section
67	67	133.153;
68	68	(4) the filing fees for the judicial fund imposed in
69	69	certain statutory county courts under Section 51.702, Government
70	70	Code;
71	71	(5) the filing fees for the judicial fund imposed in
72	72	certain county courts under Section 51.703, Government Code;
73	73	(6) the filing fees for the judicial fund imposed in
74	74	statutory probate courts under Section 51.704, Government Code;
75	75	(7) fees collected under Section 118.015;
76	76	(8) marriage license fees for the family trust fund
77	77	collected under Section 118.018;
78	78	(9) marriage license or declaration of informal
79	79	marriage fees for the child abuse and neglect prevention trust fund
80	80	account collected under Section 118.022; and
81	81	(10) the filing fee for the judicial fund imposed in
82	82	district court, statutory county court, and county court under
83	83	Section 133.154[; and
84	84	[(11) the portion of the civil or administrative
85	85	penalty described by Section 542.406(c)(1), Transportation Code,
86	86	imposed by a local authority to enforce compliance with the
87	87	instructions of a traffic-control signal;
88	88	[(11) the portion of the civil or administrative
89	89	penalty described by Section 707.008(a)(1), Transportation Code,
90	90	imposed by a local authority to enforce compliance with the
91	91	instructions of a traffic-control signal].
92	92	SECTION 6. The following are repealed:
93	93	(1) Section 29.003(g), Government Code;
94	94	(2) Sections 542.405, 542.406, and 544.012,
95	95	Transportation Code; and
96	96	(3) Sections 707.001(2), 707.002, 707.0021, 707.003,
97	97	707.004, 707.005, 707.006, 707.007, 707.008, 707.009, 707.010,
98	98	707.011, 707.012, 707.013, 707.014, 707.015, 707.016, 707.017,
99	99	707.018, and 707.019, Transportation Code.
100	100	SECTION 7. This Act takes effect immediately if it receives
101	101	a vote of two-thirds of all the members elected to each house, as
102	102	provided by Section 39, Article III, Texas Constitution. If this
103	103	Act does not receive the vote necessary for immediate effect, this
104	104	Act takes effect September 1, 2019.
