| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 314.004, Government Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 314.004. EQUALIZED EDUCATION FUNDING AND MANDATE |
|---|
| 13 | 13 | | IMPACT STATEMENT. |
|---|
| 14 | 14 | | SECTION 2. Section 314.004, Government Code, is amended by |
|---|
| 15 | 15 | | amending Subsections (a) and (b) and adding Subsection (d) to read |
|---|
| 16 | 16 | | as follows: |
|---|
| 17 | 17 | | (a) The board shall prepare for each bill or resolution that |
|---|
| 18 | 18 | | affects public education an equalized education funding and mandate |
|---|
| 19 | 19 | | impact statement. |
|---|
| 20 | 20 | | (b) The impact statement must evaluate the effect of the |
|---|
| 21 | 21 | | bill or resolution on: |
|---|
| 22 | 22 | | (1) all state equalized funding requirements and |
|---|
| 23 | 23 | | policies, including any reduction in the amount of state aid a |
|---|
| 24 | 24 | | school district would receive under the bill or resolution; and |
|---|
| 25 | 25 | | (2) if the bill or resolution proposes a mandate, the |
|---|
| 26 | 26 | | amount of additional: |
|---|
| 27 | 27 | | (A) revenue the bill or resolution would require |
|---|
| 28 | 28 | | a school district to expend to comply with the mandate; and |
|---|
| 29 | 29 | | (B) time the bill or resolution would require a |
|---|
| 30 | 30 | | school district employee or student to expend to comply with the |
|---|
| 31 | 31 | | mandate. |
|---|
| 32 | 32 | | (d) In this section, "mandate" means a statutory |
|---|
| 33 | 33 | | requirement proposed in a bill or resolution that requires a school |
|---|
| 34 | 34 | | district or an employee or student of a school district to |
|---|
| 35 | 35 | | establish, expand, or modify an activity in a way that requires the |
|---|
| 36 | 36 | | expenditure of revenue or time by the school district, employee, or |
|---|
| 37 | 37 | | student that would not have been required in the absence of the |
|---|
| 38 | 38 | | statutory requirement proposed in the bill or resolution. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
