55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to equalized education funding and mandate impact
88 statements for bills and resolutions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 314.004, Government Code,
1111 is amended to read as follows:
1212 Sec. 314.004. EQUALIZED EDUCATION FUNDING AND MANDATE
1313 IMPACT STATEMENT.
1414 SECTION 2. Section 314.004, Government Code, is amended by
1515 amending Subsections (a) and (b) and adding Subsection (d) to read
1616 as follows:
1717 (a) The board shall prepare for each bill or resolution that
1818 affects public education an equalized education funding and mandate
1919 impact statement.
2020 (b) The impact statement must evaluate the effect of the
2121 bill or resolution on:
2222 (1) all state equalized funding requirements and
2323 policies, including any reduction in the amount of state aid a
2424 school district would receive under the bill or resolution; and
2525 (2) if the bill or resolution proposes a mandate, the
2626 amount of additional:
2727 (A) revenue the bill or resolution would require
2828 a school district to expend to comply with the mandate; and
2929 (B) time the bill or resolution would require a
3030 school district employee or student to expend to comply with the
3131 mandate.
3232 (d) In this section, "mandate" means a statutory
3333 requirement proposed in a bill or resolution that requires a school
3434 district or an employee or student of a school district to
3535 establish, expand, or modify an activity in a way that requires the
3636 expenditure of revenue or time by the school district, employee, or
3737 student that would not have been required in the absence of the
3838 statutory requirement proposed in the bill or resolution.
3939 SECTION 3. This Act takes effect September 1, 2019.
