7 | 7 | | relating to the transfer of certain suits affecting the |

8 | 8 | | parent-child relationship. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 155.202(a), Family Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (a) If the basis of a motion to transfer a proceeding under |
---|
13 | 13 | | this subchapter is that the child resides in another county, the |
---|
14 | 14 | | court may deny the motion if it is shown that the child has resided |
---|
15 | 15 | | in that county for less than six months at the time the proceeding |
---|
16 | 16 | | is commenced unless the motion is filed pursuant to Section |
---|
17 | 17 | | 262.203(a-1). |

18 | 18 | | SECTION 2. Section 262.203, Family Code, is amended by |
---|
19 | 19 | | adding Subsection (a-1) to read as follows: |
---|
20 | 20 | | (a-1) On the court's own motion, the court in which a suit |
---|
21 | 21 | | under this chapter is filed may, in accordance with procedures |
---|
22 | 22 | | provided by Chapter 155, transfer the suit to a county where the |
---|
23 | 23 | | child has been placed by the department if the court finds that the |
---|
24 | 24 | | transfer is necessary for the convenience of the parties and in the |
---|
25 | 25 | | best interest of the child. |
---|
26 | 26 | | SECTION 3. The changes in law made by this Act apply to a |
---|
27 | 27 | | suit affecting the parent-child relationship filed on or after the |
---|
28 | 28 | | effective date of this Act. A suit affecting the parent-child |
---|
29 | 29 | | relationship filed before the effective date of this Act is |
---|
30 | 30 | | governed by the law in effect on the date the suit was filed, and the |
---|
31 | 31 | | former law is continued in effect for that purpose. |
---|
32 | 32 | | SECTION 4. This Act takes effect September 1, 2019. |
