55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transfer of certain suits affecting the
88 parent-child relationship.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 155.202(a), Family Code, is amended to
1111 read as follows:
1212 (a) If the basis of a motion to transfer a proceeding under
1313 this subchapter is that the child resides in another county, the
1414 court may deny the motion if it is shown that the child has resided
1515 in that county for less than six months at the time the proceeding
1616 is commenced unless the motion is filed pursuant to Section
1717 262.203(a-1).
1818 SECTION 2. Section 262.203, Family Code, is amended by
1919 adding Subsection (a-1) to read as follows:
2020 (a-1) On the court's own motion, the court in which a suit
2121 under this chapter is filed may, in accordance with procedures
2222 provided by Chapter 155, transfer the suit to a county where the
2323 child has been placed by the department if the court finds that the
2424 transfer is necessary for the convenience of the parties and in the
2525 best interest of the child.
2626 SECTION 3. The changes in law made by this Act apply to a
2727 suit affecting the parent-child relationship filed on or after the
2828 effective date of this Act. A suit affecting the parent-child
2929 relationship filed before the effective date of this Act is
3030 governed by the law in effect on the date the suit was filed, and the
3131 former law is continued in effect for that purpose.
3232 SECTION 4. This Act takes effect September 1, 2019.
