| 7 | 7 | | relating to an exemption for certain law enforcement and military |

| 8 | 8 | | personnel from the requirement to complete a hunter education |

| 9 | 9 | | program; authorizing a fee. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 62.014, Parks and Wildlife Code, is |
|---|
| 12 | 12 | | amended by amending Subsection (n) and adding Subsection (o) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (n) The following persons are exempt from any requirement to |
|---|
| 15 | 15 | | complete a hunter education course under this section: |
|---|
| 16 | 16 | | (1) an honorably discharged veteran of the United |
|---|
| 17 | 17 | | States armed forces who has achieved a basic rifle qualification or |
|---|
| 18 | 18 | | higher; |
|---|
| 19 | 19 | | (2) [or] a person who is on active duty as a member of |
|---|
| 20 | 20 | | the United States armed forces and has achieved a basic rifle |
|---|
| 21 | 21 | | qualification or higher; |
|---|
| 22 | 22 | | (3) [(2)] a person who is on active duty or has |
|---|
| 23 | 23 | | previously served as a member of the Texas Army National Guard, the |
|---|
| 24 | 24 | | Texas Air National Guard, or the Texas State Guard and has achieved |
|---|
| 25 | 25 | | a basic rifle qualification or higher; or |
|---|
| 26 | 26 | | (4) [(3)] a person who is serving or has previously |
|---|
| 27 | 27 | | served as a: |
|---|
| 28 | 28 | | (A) municipal police officer; |
|---|
| 29 | 29 | | (B) sheriff or deputy sheriff; |
|---|
| 30 | 30 | | (C) constable or deputy constable; |
|---|
| 31 | 31 | | (D) marshal or deputy marshal; |
|---|
| 32 | 32 | | (E) member of the Texas Rangers; or |
|---|
| 33 | 33 | | (F) member of the Texas Highway Patrol [peace |
|---|
| 34 | 34 | | officer described by Subdivision (1), (2), (3), or (4), Article |
|---|
| 35 | 35 | | 2.12, Code of Criminal Procedure]. |
|---|
| 36 | 36 | | (o) In addition to any administrative fee collected under |
|---|
| 37 | 37 | | Subsection (e), the commission may charge a reasonable fee to cover |
|---|
| 38 | 38 | | the administrative costs of processing the application for a |
|---|
| 39 | 39 | | license submitted by a person described by Subsection (n). Fees |
|---|
| 40 | 40 | | collected under this subsection shall be deposited to the credit of |
|---|
| 41 | 41 | | the game, fish, and water safety account. |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2019. |
