55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an exemption for certain law enforcement and military
88 personnel from the requirement to complete a hunter education
99 program; authorizing a fee.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 62.014, Parks and Wildlife Code, is
1212 amended by amending Subsection (n) and adding Subsection (o) to
1313 read as follows:
1414 (n) The following persons are exempt from any requirement to
1515 complete a hunter education course under this section:
1616 (1) an honorably discharged veteran of the United
1717 States armed forces who has achieved a basic rifle qualification or
1818 higher;
1919 (2) [or] a person who is on active duty as a member of
2020 the United States armed forces and has achieved a basic rifle
2121 qualification or higher;
2222 (3) [(2)] a person who is on active duty or has
2323 previously served as a member of the Texas Army National Guard, the
2424 Texas Air National Guard, or the Texas State Guard and has achieved
2525 a basic rifle qualification or higher; or
2626 (4) [(3)] a person who is serving or has previously
2727 served as a:
2828 (A) municipal police officer;
2929 (B) sheriff or deputy sheriff;
3030 (C) constable or deputy constable;
3131 (D) marshal or deputy marshal;
3232 (E) member of the Texas Rangers; or
3333 (F) member of the Texas Highway Patrol [peace
3434 officer described by Subdivision (1), (2), (3), or (4), Article
3535 2.12, Code of Criminal Procedure].
3636 (o) In addition to any administrative fee collected under
3737 Subsection (e), the commission may charge a reasonable fee to cover
3838 the administrative costs of processing the application for a
3939 license submitted by a person described by Subsection (n). Fees
4040 collected under this subsection shall be deposited to the credit of
4141 the game, fish, and water safety account.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2019.
