55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to civil liability for performing certain abortions;
88 providing civil penalties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 71.002, Civil Practice and Remedies
1111 Code, is amended by adding Subsection (f) to read as follows:
1212 (f) A person is liable for damages arising from a violation
1313 of Section 170.002(a), 171.043, 171.044, 171.102, or 171.152,
1414 Health and Safety Code.
1515 SECTION 2. Section 71.004(b), Civil Practice and Remedies
1616 Code, is amended to read as follows:
1717 (b) The surviving spouse, children, and parents of the
1818 deceased may bring the action or one or more of those individuals
1919 may bring the action for the benefit of all. A next friend may bring
2020 an action for damages under Section 71.002(f).
2121 SECTION 3. Chapter 170, Health and Safety Code, is amended
2222 by adding Section 170.003 to read as follows:
2323 Sec. 170.003. CIVIL PENALTY. (a) A person who violates
2424 Section 170.002(a) is liable to this state for a civil penalty of
2525 $30,000 for each violation.
2626 (b) The attorney general may sue to collect the penalty.
2727 (c) The attorney general shall file an action under this
2828 section in a district court in Travis County or the county in which
2929 the violation occurred.
3030 (d) The attorney general may recover reasonable expenses
3131 incurred in obtaining a civil penalty under this section, including
3232 court costs, attorney's fees, investigative costs, witness fees,
3333 and deposition expenses.
3434 SECTION 4. Subchapter C, Chapter 171, Health and Safety
3535 Code, is amended by adding Section 171.049 to read as follows:
3636 Sec. 171.049. CIVIL PENALTY. (a) A person who violates
3737 Section 171.043 or 171.044 is liable to this state for a civil
3838 penalty of $30,000 for each violation.
3939 (b) The attorney general may sue to collect the penalty.
4040 (c) The attorney general shall file an action under this
4141 section in a district court in Travis County or the county in which
4242 the violation occurred.
4343 (d) The attorney general may recover reasonable expenses
4444 incurred in obtaining a civil penalty under this section, including
4545 court costs, attorney's fees, investigative costs, witness fees,
4646 and deposition expenses.
4747 SECTION 5. Subchapter F, Chapter 171, Health and Safety
4848 Code, is amended by adding Section 171.1045 to read as follows:
4949 Sec. 171.1045. CIVIL PENALTY. (a) A person who violates
5050 Section 171.102 is liable to this state for a civil penalty of
5151 $30,000 for each violation.
5252 (b) The attorney general may sue to collect the penalty.
5353 (c) The attorney general shall file an action under this
5454 section in a district court in Travis County or the county in which
5555 the violation occurred.
5656 (d) The attorney general may recover reasonable expenses
5757 incurred in obtaining a civil penalty under this section, including
5858 court costs, attorney's fees, investigative costs, witness fees,
5959 and deposition expenses.
6060 SECTION 6. Subchapter G, Chapter 171, Health and Safety
6161 Code, is amended by adding Section 171.1535 to read as follows:
6262 Sec. 171.1535. CIVIL PENALTY. (a) A person who violates
6363 Section 171.152 is liable to this state for a civil penalty of
6464 $30,000 for each violation.
6565 (b) The attorney general may sue to collect the penalty.
6666 (c) The attorney general shall file an action under this
6767 section in a district court in Travis County or the county in which
6868 the violation occurred.
6969 (d) The attorney general may recover reasonable expenses
7070 incurred in obtaining a civil penalty under this section, including
7171 court costs, attorney's fees, investigative costs, witness fees,
7272 and deposition expenses.
7373 SECTION 7. The change in law made by this Act applies only
7474 to a cause of action that accrues on or after the effective date of
7575 this Act. A cause of action that accrues before the effective date
7676 of this Act is governed by the law applicable to the cause of action
7777 immediately before that date, and that law is continued in effect
7878 for that purpose.
7979 SECTION 8. The change in law made by this Act applies only
8080 to an abortion performed on or after the effective date of this Act.
8181 An abortion performed before the effective date of this Act is
8282 governed by the law in effect immediately before the effective date
8383 of this Act, and the former law is continued in effect for that
8484 purpose.
8585 SECTION 9. This Act takes effect September 1, 2019.
