| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.02116 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.02116. PROCEDURE FOR IMPLEMENTING CHANGES TO |
|---|
| 13 | 13 | | PAYMENT RATES UNDER MEDICAID. Before implementing or approving a |
|---|
| 14 | 14 | | change to the fees, charges, and rates for payments under Medicaid, |
|---|
| 15 | 15 | | including under the Medicaid managed care program, the commission |
|---|
| 16 | 16 | | shall publish notice of the proposed change for public comment for a |
|---|
| 17 | 17 | | period of not less than 30 days. |
|---|
| 18 | 18 | | SECTION 2. The procedure for implementing changes to |
|---|
| 19 | 19 | | payment rates required by Section 531.02116, Government Code, as |
|---|
| 20 | 20 | | added by this Act, applies only to a change to a fee, charge, or rate |
|---|
| 21 | 21 | | that takes effect on or after January 1, 2020. |
|---|
| 22 | 22 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 23 | 23 | | a state agency determines that a waiver or authorization from a |
|---|
| 24 | 24 | | federal agency is necessary for implementation of that provision, |
|---|
| 25 | 25 | | the agency affected by the provision shall request the waiver or |
|---|
| 26 | 26 | | authorization and may delay implementing that provision until the |
|---|
| 27 | 27 | | waiver or authorization is granted. |
|---|
| 28 | 28 | | SECTION 4. This Act takes effect September 1, 2019. |
