55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to performance incentive funding for certain medical
88 schools based on public health impact.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1111 amended by adding Section 61.0597 to read as follows:
1212 Sec. 61.0597. MEDICAL SCHOOL PERFORMANCE INCENTIVE
1313 FUNDING. (a) In this section, "medical school" means a medical
1414 school that is part of The University of Texas System, the Texas
1515 Tech University System, The Texas A&M University System, or the
1616 University of North Texas System, or the Baylor College of
1717 Medicine.
1818 (b) In consultation with the Health and Human Services
1919 Commission, the board with the assistance of the advisory committee
2020 appointed under Subsection (e) biennially shall develop a plan for
2121 distributing performance incentive funds appropriated for that
2222 purpose for the next state fiscal biennium to medical schools based
2323 on each medical school's success in improving the delivery of
2424 health services and improving health conditions of persons in the
2525 service region of the medical school.
2626 (c) A plan developed under this section must:
2727 (1) define the geographic service region for each
2828 medical school so that all the territory of this state is included
2929 in a service region; and
3030 (2) include recommendations for the performance
3131 measures and related formulas on which distributions to medical
3232 schools of any performance incentive funds appropriated by the
3333 legislature for the next state fiscal biennium would be based.
3434 (d) In defining the service region for a medical school
3535 under Subsection (c)(1), the board:
3636 (1) shall attempt to include areas that:
3737 (A) are in geographic proximity to the medical
3838 school; and
3939 (B) benefit from being served by the medical
4040 school; and
4141 (2) may establish a single region for two or more
4242 medical schools if the board determines that the medical schools
4343 serve primarily the same areas.
4444 (e) The board shall establish an advisory committee to
4545 assist the board in administering this section. Membership on the
4646 committee must:
4747 (1) to the greatest extent practicable, reflect a
4848 balanced representation of:
4949 (A) the geographic regions of this state; and
5050 (B) municipalities and counties in this state of
5151 high, medium, and low population; and
5252 (2) include:
5353 (A) members appointed by the governor,
5454 lieutenant governor, and speaker of the house of representatives;
5555 (B) members who are medical professionals,
5656 including nurses, nurse practitioners, mental health providers,
5757 pediatricians, primary care physicians, and public school nurses;
5858 and
5959 (C) members who represent the interests of senior
6060 citizens, veterans, children, the adult criminal justice and
6161 juvenile justice communities, the health insurance industry, the
6262 health care free market, public and private hospitals, and
6363 charitable foundations with a presence in health care.
6464 (f) The chair of each standing legislative committee with
6565 primary jurisdiction over criminal justice, juvenile justice,
6666 public health, appropriations, health and human services, county
6767 affairs, or higher education, as determined by the presiding
6868 officer of each house, serves as an ex officio member of the
6969 advisory committee appointed under Subsection (e).
7070 (g) The members of the advisory committee appointed under
7171 Subsection (e) serve without compensation but shall be reimbursed
7272 by the board for actual expenses incurred in the performance of
7373 duties as members of the committee.
7474 (h) Not later than November 1 of each even-numbered year,
7575 the board shall submit the plan developed for the next state fiscal
7676 biennium under this section to the legislature. The legislature
7777 may appropriate performance incentive funds for distribution to
7878 medical schools for the next fiscal biennium based on the plan.
7979 SECTION 2. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2019.
