410 AN ACT
511 relating to the authority of the Texas Facilities Commission over
612 certain real property owned by the state.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 2166.052, Government Code, is amended by
915 amending Subsection (b) and adding Subsections (d), (e), (f), (g),
1016 (h), and (i) to read as follows:
1117 (b) The commission may not sell or otherwise dispose of real
1218 property of the state except:
1319 (1) for real property located in the Capitol Complex,
1420 by specific authority:
1521 (A) [(1)] granted by the legislature if the
1622 legislature is in session; or
1723 (B) [(2)] granted jointly by the governor and the
1824 Legislative Budget Board if the legislature is not in session; or
1925 (2) for real property of the state other than the
2026 property described by Subdivision (1):
2127 (A) by specific authority granted by the
2228 legislature if the legislature is in session; or
2329 (B) subject to Subsection (e), through formal
2430 notification to the governor and the Legislative Budget Board if
2531 the legislature is not in session.
2632 (d) When considering a sale of real property of the state
2733 subject to Subsection (b)(2), the commission shall submit a formal
2834 notification of the intent to sell the property to:
2935 (1) the governor;
3036 (2) the Legislative Budget Board; and
3137 (3) each state senator and representative in whose
3238 district the property is located.
3339 (e) The governor may disapprove the sale of real property of
3440 the state subject to Subsection (b)(2) by providing written notice
3541 of the disapproval to the commission not later than the 90th day
3642 after the date the governor receives the formal notification
3743 required by Subsection (d).
3844 (f) On request by the commission, the General Land Office
3945 shall negotiate and close a sale of real property of the state under
4046 this section on behalf of the commission using procedures
4147 established in Section 31.158(c), Natural Resources Code, except
4248 the land office is not required to offer the School Land Board the
4349 first option to purchase the real property.
4450 (g) Each transfer of an interest in real property of the
4551 state under this section must be made by an instrument signed by the
4652 executive director of the commission and the governor.
4753 (h) The proceeds from the sale, lease, or other disposition
4854 of real property of the state under this section shall be deposited
4955 to the Texas capital trust fund established under Chapter 2201 and
5056 dedicated to the acquisition, construction, repair, and
5157 improvement of state facilities. Before depositing proceeds in the
5258 fund, the commission may recover from the proceeds all amounts
5359 spent by the commission for management, acquisition, and
5460 disposition expenses.
5561 (i) Sections 403.095 and 2201.003(b) do not apply to
5662 proceeds deposited in the Texas capital trust fund in accordance
5763 with this section.
5864 SECTION 2. This Act takes effect September 1, 2019.
