4	10		AN ACT
5	11		relating to the authority of the Texas Facilities Commission over
6	12		certain real property owned by the state.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 2166.052, Government Code, is amended by
9	15		amending Subsection (b) and adding Subsections (d), (e), (f), (g),
10	16		(h), and (i) to read as follows:
11	17		(b) The commission may not sell or otherwise dispose of real
12	18		property of the state except:
13	19		(1) for real property located in the Capitol Complex,
14	20		by specific authority:
15	21		(A) [(1)] granted by the legislature if the
16	22		legislature is in session; or
17	23		(B) [(2)] granted jointly by the governor and the
18	24		Legislative Budget Board if the legislature is not in session; or
19	25		(2) for real property of the state other than the
20	26		property described by Subdivision (1):
21	27		(A) by specific authority granted by the
22	28		legislature if the legislature is in session; or
23	29		(B) subject to Subsection (e), through formal
24	30		notification to the governor and the Legislative Budget Board if
25	31		the legislature is not in session.
26	32		(d) When considering a sale of real property of the state
27	33		subject to Subsection (b)(2), the commission shall submit a formal
28	34		notification of the intent to sell the property to:
29	35		(1) the governor;
30	36		(2) the Legislative Budget Board; and
31	37		(3) each state senator and representative in whose
32	38		district the property is located.
33	39		(e) The governor may disapprove the sale of real property of
34	40		the state subject to Subsection (b)(2) by providing written notice
35	41		of the disapproval to the commission not later than the 90th day
36	42		after the date the governor receives the formal notification
37	43		required by Subsection (d).
38	44		(f) On request by the commission, the General Land Office
39	45		shall negotiate and close a sale of real property of the state under
40	46		this section on behalf of the commission using procedures
41	47		established in Section 31.158(c), Natural Resources Code, except
42	48		the land office is not required to offer the School Land Board the
43	49		first option to purchase the real property.
44	50		(g) Each transfer of an interest in real property of the
45	51		state under this section must be made by an instrument signed by the
46	52		executive director of the commission and the governor.
47	53		(h) The proceeds from the sale, lease, or other disposition
48	54		of real property of the state under this section shall be deposited
49	55		to the Texas capital trust fund established under Chapter 2201 and
50	56		dedicated to the acquisition, construction, repair, and
51	57		improvement of state facilities. Before depositing proceeds in the
52	58		fund, the commission may recover from the proceeds all amounts
53	59		spent by the commission for management, acquisition, and
54	60		disposition expenses.
55	61		(i) Sections 403.095 and 2201.003(b) do not apply to
56	62		proceeds deposited in the Texas capital trust fund in accordance
57	63		with this section.
58	64		SECTION 2. This Act takes effect September 1, 2019.
