| 7 | 7 | | relating to the relocation of certain licensed pawnshops. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 371.059(b), Finance Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (b) In a county with a population of 250,000 or more, the |
|---|
| 12 | 12 | | commissioner shall approve an application for: |
|---|
| 13 | 13 | | (1) an original license to operate a pawnshop at a |
|---|
| 14 | 14 | | facility that is not an existing licensed pawnshop at the time the |
|---|
| 15 | 15 | | application is filed if the proposed facility is not located within |
|---|
| 16 | 16 | | two miles of a licensed pawnshop; and |
|---|
| 17 | 17 | | (2) the relocation of a licensed pawnshop to a |
|---|
| 18 | 18 | | facility that [is not an existing licensed pawnshop] at the time the |
|---|
| 19 | 19 | | application is filed [if the facility where the pawnshop is to be |
|---|
| 20 | 20 | | relocated] is not located within one mile of a licensed pawnshop[; |
|---|
| 21 | 21 | | and |
|---|
| 22 | 22 | | [(3) the relocation of a licensed pawnshop if at the |
|---|
| 23 | 23 | | time the application is filed the pawnshop has been in operation at |
|---|
| 24 | 24 | | its current location for at least three years, and the facility |
|---|
| 25 | 25 | | where the pawnshop is to be relocated is either within one mile of |
|---|
| 26 | 26 | | its existing location or, if in excess of one mile from its existing |
|---|
| 27 | 27 | | location, not within one mile of another existing operating |
|---|
| 28 | 28 | | pawnshop]. |

| 29 | 29 | | SECTION 2. Section 371.059(c), Finance Code, is repealed. |
|---|
| 30 | 30 | | SECTION 3. Section 371.059, Finance Code, as amended by |
|---|
| 31 | 31 | | this Act, applies only to an application for the relocation of a |
|---|
| 32 | 32 | | pawnshop filed on or after the effective date of this Act. An |
|---|
| 33 | 33 | | application for the relocation of a pawnshop filed before the |
|---|
| 34 | 34 | | effective date of this Act is governed by the law in effect on the |
|---|
| 35 | 35 | | date the application was filed, and the former law is continued in |
|---|
| 36 | 36 | | effect for that purpose. |

| 37 | 37 | | SECTION 4. This Act takes effect September 1, 2019. |
