6	6	AN ACT
7	7	relating to establishing an advisory board to study surface water
8	8	and groundwater interaction.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. DEFINITIONS. In this Act:
11	11	(1) "Advisory board" means the Surface Water and
12	12	Groundwater Interaction Advisory Board.
13	13	(2) "Development board" means the Texas Water
14	14	Development Board.
15	15	SECTION 2. SURFACE WATER AND GROUNDWATER INTERACTION
16	16	ADVISORY BOARD ESTABLISHED. (a) The Surface Water and Groundwater
17	17	Interaction Advisory Board is established and consists of nine
18	18	persons as follows:
19	19	(1) the executive administrator of the development
20	20	board;
21	21	(2) one person to represent the interests of the Texas
22	22	Commission on Environmental Quality, recommended by the Texas
23	23	Commission on Environmental Quality and appointed jointly by the
24	24	chairs of the house natural resources committee and the senate
25	25	water and rural affairs committee;
26	26	(3) one person to represent the interests of river
27	27	authorities, recommended by the Texas Commission on Environmental
28	28	Quality and appointed jointly by the chairs of the house natural
29	29	resources committee and the senate water and rural affairs
30	30	committee;
31	31	(4) one person to represent the interests of
32	32	groundwater conservation districts, recommended by the Texas
33	33	Commission on Environmental Quality and appointed jointly by the
34	34	chairs of the house natural resources committee and the senate
35	35	water and rural affairs committee;
36	36	(5) two persons with academic or specialist knowledge
37	37	in the area of surface water and groundwater interaction, with one
38	38	appointed by the chair of the house natural resources committee and
39	39	another appointed by the chair of the senate water and rural affairs
40	40	committee;
41	41	(6) the chair of the house natural resources
42	42	committee;
43	43	(7) the chair of the senate water and rural affairs
44	44	committee; and
45	45	(8) one person from the office of the governor,
46	46	appointed by the governor.
47	47	(b) The executive administrator of the development board
48	48	serves as the chair of the advisory board.
49	49	SECTION 3. SURFACE WATER AND GROUNDWATER INTERACTION STUDY.
50	50	(a) The advisory board shall study:
51	51	(1) the extent to which surface water and groundwater
52	52	interact in this state;
53	53	(2) challenges arising in this state from the
54	54	interaction of surface water and groundwater; and
55	55	(3) approaches to mitigating challenges arising in
56	56	this state from the interaction of surface water and groundwater.
57	57	(b) In conducting the study under this section, the advisory
58	58	board shall consult with:
59	59	(1) the Texas Commission on Environmental Quality;
60	60	(2) groundwater conservation districts; and
61	61	(3) river authorities.
62	62	SECTION 4. STUDY REPORT; EXPIRATION OF ACT. (a) The
63	63	advisory board shall deliver to the governor, the lieutenant
64	64	governor, the speaker of the house of representatives, and each
65	65	member of the legislature a report on the determinations of the
66	66	advisory board based on the study conducted under Section 3 of this
67	67	Act not later than December 1, 2020. The advisory board shall
68	68	deliver to the governor, the lieutenant governor, the speaker of
69	69	the house of representatives, or a member of the legislature
70	70	related information on request.
71	71	(b) The advisory board is abolished and this Act expires
72	72	January 1, 2021.
73	73	SECTION 5. EFFECTIVE DATE. This Act takes effect
74	74	immediately if it receives a vote of two-thirds of all the members
75	75	elected to each house, as provided by Section 39, Article III, Texas
76	76	Constitution. If this Act does not receive the vote necessary for
77	77	immediate effect, this Act takes effect September 1, 2019.
