55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to establishing an advisory board to study surface water
88 and groundwater interaction.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Advisory board" means the Surface Water and
1212 Groundwater Interaction Advisory Board.
1313 (2) "Development board" means the Texas Water
1414 Development Board.
1515 SECTION 2. SURFACE WATER AND GROUNDWATER INTERACTION
1616 ADVISORY BOARD ESTABLISHED. (a) The Surface Water and Groundwater
1717 Interaction Advisory Board is established and consists of nine
1818 persons as follows:
1919 (1) the executive administrator of the development
2020 board;
2121 (2) one person to represent the interests of the Texas
2222 Commission on Environmental Quality, recommended by the Texas
2323 Commission on Environmental Quality and appointed jointly by the
2424 chairs of the house natural resources committee and the senate
2525 water and rural affairs committee;
2626 (3) one person to represent the interests of river
2727 authorities, recommended by the Texas Commission on Environmental
2828 Quality and appointed jointly by the chairs of the house natural
2929 resources committee and the senate water and rural affairs
3030 committee;
3131 (4) one person to represent the interests of
3232 groundwater conservation districts, recommended by the Texas
3333 Commission on Environmental Quality and appointed jointly by the
3434 chairs of the house natural resources committee and the senate
3535 water and rural affairs committee;
3636 (5) two persons with academic or specialist knowledge
3737 in the area of surface water and groundwater interaction, with one
3838 appointed by the chair of the house natural resources committee and
3939 another appointed by the chair of the senate water and rural affairs
4040 committee;
4141 (6) the chair of the house natural resources
4242 committee;
4343 (7) the chair of the senate water and rural affairs
4444 committee; and
4545 (8) one person from the office of the governor,
4646 appointed by the governor.
4747 (b) The executive administrator of the development board
4848 serves as the chair of the advisory board.
4949 SECTION 3. SURFACE WATER AND GROUNDWATER INTERACTION STUDY.
5050 (a) The advisory board shall study:
5151 (1) the extent to which surface water and groundwater
5252 interact in this state;
5353 (2) challenges arising in this state from the
5454 interaction of surface water and groundwater; and
5555 (3) approaches to mitigating challenges arising in
5656 this state from the interaction of surface water and groundwater.
5757 (b) In conducting the study under this section, the advisory
5858 board shall consult with:
5959 (1) the Texas Commission on Environmental Quality;
6060 (2) groundwater conservation districts; and
6161 (3) river authorities.
6262 SECTION 4. STUDY REPORT; EXPIRATION OF ACT. (a) The
6363 advisory board shall deliver to the governor, the lieutenant
6464 governor, the speaker of the house of representatives, and each
6565 member of the legislature a report on the determinations of the
6666 advisory board based on the study conducted under Section 3 of this
6767 Act not later than December 1, 2020. The advisory board shall
6868 deliver to the governor, the lieutenant governor, the speaker of
6969 the house of representatives, or a member of the legislature
7070 related information on request.
7171 (b) The advisory board is abolished and this Act expires
7272 January 1, 2021.
7373 SECTION 5. EFFECTIVE DATE. This Act takes effect
7474 immediately if it receives a vote of two-thirds of all the members
7575 elected to each house, as provided by Section 39, Article III, Texas
7676 Constitution. If this Act does not receive the vote necessary for
7777 immediate effect, this Act takes effect September 1, 2019.
