44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a limitation on the salary of certain administrative
77 public education employees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 11.201, Education Code, is amended by
1010 adding Subsection (b-1) to read as follows:
1111 (b-1) A school district may not employ a superintendent for
1212 an annual salary in an amount that is greater than 125 percent of
1313 the amount of the annual salary authorized by the legislature for
1414 the governor. For purposes of this subsection, a superintendent's
1515 annual salary does not include an amount paid by the district as:
1616 (1) a bonus; or
1717 (2) an allowance or stipend.
1818 SECTION 2. Section 8.004, Education Code, is amended to
1919 read as follows:
2020 (a) The regional education service center board of
2121 directors shall employ an executive director. The selection and
2222 dismissal of the executive director is subject to the approval of
2323 the commissioner. The executive director is the chief executive
2424 officer of the regional education service center and may employ
2525 personnel as necessary to carry out the functions of the center.
2626 (b) A regional education service center may not employ:
2727 (1) an executive director for an annual salary in an
2828 amount that is greater than 75 percent of the amount of the annual
2929 salary authorized by the legislature for the governor; and
3030 (2) an employee other than the executive director for
3131 an annual salary in an amount that is greater than 25 percent of the
3232 amount of the annual salary authorized by the legislature for the
3333 governor.
3434 SECTION 3. This Act applies to an employment contract that
3535 is entered into on or after September 1, 2019.
3636 An employment
3737 contract that is entered into before September 1, 2019, is governed
3838 by the law as it existed at the time the contract was entered into,
3939 and the former law remains in effect for that purpose.
4040 SECTION 4. This Act takes effect September 1, 2019.
