6 | 6 | | relating to a limitation on the salary of certain administrative |
---|
7 | 7 | | public education employees. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 11.201, Education Code, is amended by |
---|
10 | 10 | | adding Subsection (b-1) to read as follows: |
---|
11 | 11 | | (b-1) A school district may not employ a superintendent for |
---|
12 | 12 | | an annual salary in an amount that is greater than 125 percent of |
---|
13 | 13 | | the amount of the annual salary authorized by the legislature for |
---|
14 | 14 | | the governor. For purposes of this subsection, a superintendent's |
---|
15 | 15 | | annual salary does not include an amount paid by the district as: |
---|
16 | 16 | | (1) a bonus; or |
---|
17 | 17 | | (2) an allowance or stipend. |
---|
18 | 18 | | SECTION 2. Section 8.004, Education Code, is amended to |
---|
19 | 19 | | read as follows: |
---|
20 | 20 | | (a) The regional education service center board of |
---|
21 | 21 | | directors shall employ an executive director. The selection and |
---|
22 | 22 | | dismissal of the executive director is subject to the approval of |
---|
23 | 23 | | the commissioner. The executive director is the chief executive |
---|
24 | 24 | | officer of the regional education service center and may employ |
---|
25 | 25 | | personnel as necessary to carry out the functions of the center. |
---|
26 | 26 | | (b) A regional education service center may not employ: |
---|
27 | 27 | | (1) an executive director for an annual salary in an |
---|
28 | 28 | | amount that is greater than 75 percent of the amount of the annual |
---|
29 | 29 | | salary authorized by the legislature for the governor; and |
---|
30 | 30 | | (2) an employee other than the executive director for |
---|
31 | 31 | | an annual salary in an amount that is greater than 25 percent of the |
---|
32 | 32 | | amount of the annual salary authorized by the legislature for the |
---|
33 | 33 | | governor. |
---|
34 | 34 | | SECTION 3. This Act applies to an employment contract that |
---|
35 | 35 | | is entered into on or after September 1, 2019. |
---|
36 | 36 | | An employment |
---|
37 | 37 | | contract that is entered into before September 1, 2019, is governed |
---|
38 | 38 | | by the law as it existed at the time the contract was entered into, |
---|
39 | 39 | | and the former law remains in effect for that purpose. |
---|
40 | 40 | | SECTION 4. This Act takes effect September 1, 2019. |
