44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the prosecution of the criminal offense of organized
77 retail theft.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 31.16(b), Penal Code, is amended to read
1010 as follows:
1111 (b) A person commits an offense if, with the intent to
1212 facilitate the redistribution of retail merchandise, the person
1313 [intentionally] conducts, promotes, or facilitates an activity in
1414 which the person receives, possesses, conceals, stores, barters,
1515 sells, or disposes of:
1616 (1) stolen retail merchandise; or
1717 (2) merchandise explicitly represented to the person
1818 as being stolen retail merchandise.
1919 SECTION 2. The change in law made by this Act applies only
2020 to an offense committed on or after the effective date of this Act.
2121 An offense committed before the effective date of this Act is
2222 governed by the law in effect on the date the offense was committed,
2323 and the former law is continued in effect for that purpose. For
2424 purposes of this section, an offense was committed before the
2525 effective date of this Act if any element of the offense occurred
2626 before that date.
2727 SECTION 3. This Act takes effect September 1, 2019.
