5 | 11 | | relating to certain distributions to the available school fund. |

6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 13 | | SECTION 1. Section 43.001(b), Education Code, is amended to |
---|
8 | 14 | | read as follows: |
---|
9 | 15 | | (b) The available school fund, which shall be apportioned |
---|
10 | 16 | | annually to each county according to its scholastic population, |
---|
11 | 17 | | consists of: |
---|
12 | 18 | | (1) the distributions to the fund from the permanent |
---|
13 | 19 | | school fund as provided by Sections [Section] 5(a) and (g), Article |
---|
14 | 20 | | VII, Texas Constitution; |
---|
15 | 21 | | (2) one-fourth of all revenue derived from all state |
---|
16 | 22 | | occupation taxes, exclusive of delinquencies and cost of |
---|
17 | 23 | | collection; |
---|
18 | 24 | | (3) one-fourth of revenue derived from state gasoline |
---|
19 | 25 | | and special fuels excise taxes as provided by law; and |
---|
20 | 26 | | (4) all other appropriations to the available school |
---|
21 | 27 | | fund made by the legislature for public school purposes. |

22 | 28 | | SECTION 2. Section 43.001(d), Education Code, as amended by |
---|
23 | 29 | | Chapters 581 (S.B. 810) and 705 (H.B. 3526), Acts of the 85th |
---|
24 | 30 | | Legislature, Regular Session, 2017, is reenacted and amended to |
---|
25 | 31 | | read as follows: |
---|
26 | 32 | | (d) Each biennium the State Board of Education shall set |
---|
27 | 33 | | aside an amount equal to 50 percent of the distribution for that |
---|
28 | 34 | | biennium from the permanent school fund to the available school |
---|
29 | 35 | | fund as provided by Sections [Section] 5(a) and (g), Article VII, |
---|
30 | 36 | | Texas Constitution, to be placed, subject to the General |
---|
31 | 37 | | Appropriations Act, in the state instructional materials and |
---|
32 | 38 | | technology fund established under Section 31.021. |
---|
33 | 39 | | SECTION 3. This Act takes effect January 1, 2020, but only |
---|
34 | 40 | | if the constitutional amendment proposed by the 86th Legislature, |
---|
35 | 41 | | Regular Session, 2019, providing for increased distributions to the |
---|
36 | 42 | | available school fund is approved by the voters. If that proposed |
---|
37 | 43 | | constitutional amendment is not approved by the voters, this Act |
---|
38 | 44 | | has no effect. |
