9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to certain distributions to the available school fund.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 43.001(b), Education Code, is amended to
814 read as follows:
915 (b) The available school fund, which shall be apportioned
1016 annually to each county according to its scholastic population,
1117 consists of:
1218 (1) the distributions to the fund from the permanent
1319 school fund as provided by Sections [Section] 5(a) and (g), Article
1420 VII, Texas Constitution;
1521 (2) one-fourth of all revenue derived from all state
1622 occupation taxes, exclusive of delinquencies and cost of
1723 collection;
1824 (3) one-fourth of revenue derived from state gasoline
1925 and special fuels excise taxes as provided by law; and
2026 (4) all other appropriations to the available school
2127 fund made by the legislature for public school purposes.
2228 SECTION 2. Section 43.001(d), Education Code, as amended by
2329 Chapters 581 (S.B. 810) and 705 (H.B. 3526), Acts of the 85th
2430 Legislature, Regular Session, 2017, is reenacted and amended to
2531 read as follows:
2632 (d) Each biennium the State Board of Education shall set
2733 aside an amount equal to 50 percent of the distribution for that
2834 biennium from the permanent school fund to the available school
2935 fund as provided by Sections [Section] 5(a) and (g), Article VII,
3036 Texas Constitution, to be placed, subject to the General
3137 Appropriations Act, in the state instructional materials and
3238 technology fund established under Section 31.021.
3339 SECTION 3. This Act takes effect January 1, 2020, but only
3440 if the constitutional amendment proposed by the 86th Legislature,
3541 Regular Session, 2019, providing for increased distributions to the
3642 available school fund is approved by the voters. If that proposed
3743 constitutional amendment is not approved by the voters, this Act
3844 has no effect.
