66 AN ACT
77 relating to methods of calculating the minimum wage paid to an
88 employee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 62.051, Labor Code, is amended to read as
1111 follows:
1212 Sec. 62.051. MINIMUM WAGE. (a) Except as provided by
1313 Section 62.057, an employer shall pay to each employee who is not
1414 exempt under the federal Fair Labor Standards Act of 1938 (29 U.S.C.
1515 Section 201 et seq.) at least the federal minimum wage under Section
1616 6, Fair Labor Standards Act of 1938 (29 U.S.C. Section 206) for each
1717 hour the employee works.
1818 (b) For the purpose of calculating the minimum wage paid to
1919 an employee, an employer may not use a method that:
2020 (1) guarantees weekly pay for a variable number of
2121 hours; or
2222 (2) establishes a fixed salary for fluctuating hours
2323 in a workweek.
2424 SECTION 2. Section 62.151, Labor Code, is amended to read as
2525 follows:
2626 Sec. 62.151. PERSON COVERED BY FEDERAL ACT. A [This chapter
2727 and a] municipal ordinance or charter provision governing wages in
2828 private employment, other than wages under a public contract, does
2929 [do] not apply to a person covered by the Fair Labor Standards Act
3030 of 1938 (29 U.S.C. Section 201 et seq.).
3131 SECTION 3. This Act takes effect September 1, 2019.
