| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Section 15.001(12), Water Code, is amended to | |
| 9 | 9 | read as follows: | |
| 10 | 10 | (12) "Nonborder colonia" means a residential | |
| 11 | 11 | community: | |
| 12 | 12 | (A) located in an unincorporated area of a | |
| 13 | 13 | county: | |
| 14 | 14 | (i | |
| 15 | 15 | ) all parts of which are at least 150 | |
| 16 | 16 | miles from the international border of this state; or | |
| 17 | 17 | (ii) has a population of 425,000 or more, is | |
| 18 | 18 | adjacent to a county with a population of 3.3 million or more, and | |
| 19 | 19 | contains a portion of the San Jacinto River; | |
| 20 | 20 | (B) in which water or wastewater services are | |
| 21 | 21 | inadequate to meet minimal needs of residential users as defined by | |
| 22 | 22 | board rules; | |
| 23 | 23 | (C) in which the average household income is less | |
| 24 | 24 | than the average household income for the county in which the | |
| 25 | 25 | community is located; and | |
| 26 | 26 | (D) that consists of 11 or more dwellings that | |
| 27 | 27 | are located in close proximity to each other in an area that may be | |
| 28 | 28 | described as a community or neighborhood. | |
| 29 | 29 | SECTION 2. This Act takes effect September 1, 2019. |
