| 5 | 13 | | relating to reciprocity agreements between certain air ambulance |
|---|
| 6 | 14 | | companies operating a subscription program. |
|---|
| 7 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 16 | | SECTION 1. Section 773.011, Health and Safety Code, is |
|---|
| 9 | 17 | | amended by amending Subsections (b) and (e) and adding Subsection |
|---|
| 10 | 18 | | (d-1) to read as follows: |
|---|
| 11 | 19 | | (b) The executive commissioner shall adopt rules |
|---|
| 12 | 20 | | establishing minimum standards for the creation and operation of a |
|---|
| 13 | 21 | | subscription program. The rules must: |
|---|
| 14 | 22 | | (1) ensure the protection of public health and safety; |
|---|
| 15 | 23 | | (2) ensure compliance with federal laws and rules |
|---|
| 16 | 24 | | related to air ambulance subscription program services; and |
|---|
| 17 | 25 | | (3) establish minimum standards and objectives for the |
|---|
| 18 | 26 | | delivery of air ambulance emergency medical services provided in |
|---|
| 19 | 27 | | accordance with a reciprocity agreement entered into under |
|---|
| 20 | 28 | | Subsection (d-1). |
|---|
| 21 | 29 | | (d-1) To ensure maximum geographic coverage for patients |
|---|
| 22 | 30 | | covered under a subscription program, an air ambulance company that |
|---|
| 23 | 31 | | operates a subscription program shall, in accordance with executive |
|---|
| 24 | 32 | | commissioner rules, enter into a reciprocity agreement with each |
|---|
| 25 | 33 | | other air ambulance company that operates a subscription program in |
|---|
| 26 | 34 | | the same service delivery area. |
|---|
| 27 | 35 | | (e) The Insurance Code does not apply to a subscription |
|---|
| 28 | 36 | | program established or a reciprocity agreement entered into under |
|---|
| 29 | 37 | | this section. |
|---|
| 30 | 38 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 31 | 39 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 32 | 40 | | Services Commission shall adopt rules necessary to implement |
|---|
| 33 | 41 | | Section 773.011, Health and Safety Code, as amended by this Act. |
|---|
| 34 | 42 | | SECTION 3. This Act takes effect January 1, 2020. |
