4	10		AN ACT
5	11		relating to the powers and duties of the Rolling V Ranch Water
6	12		Control and Improvement District No. 1 of Wise County.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 9021.104, Special District Local Laws
9	15		Code, is amended by amending Subsections (a) and (b) and adding
10	16		Subsections (e), (f), (g), (h), (i), and (j) to read as follows:
11	17		(a) The district may be divided into two or more new
12	18		districts only if the district:
13	19		(1) has no outstanding bonded debt; and
14	20		(2) is not imposing ad valorem taxes.
15	21		(b) This chapter applies to any new district created by the
16	22		division of the district, and a new district has all the powers and
17	23		duties of the district. [The division procedure is prescribed by
18	24		Sections 53.030 through 53.041, Water Code.]
19	25		(e) The board, on its own motion or on receipt of a petition
20	26		signed by the owner or owners of a majority of the assessed value of
21	27		the real property in the district, may adopt an order dividing the
22	28		district.
23	29		(f) An order dividing the district must:
24	30		(1) name each new district;
25	31		(2) include the metes and bounds description of the
26	32		territory of each new district;
27	33		(3) appoint temporary directors for each new district;
28	34		and
29	35		(4) provide for the division of assets and liabilities
30	36		between or among the new districts.
31	37		(g) On or before the 30th day after the date of adoption of
32	38		an order dividing the district, the district shall file the order
33	39		with the Texas Commission on Environmental Quality and record the
34	40		order in the real property records of each county in which the
35	41		district is located.
36	42		(h) Any new district created by the division of the district
37	43		shall hold a confirmation and directors' election as required by
38	44		Section 49.102, Water Code.
39	45		(i) If the creation of the new district is confirmed, the
40	46		new district shall provide the election date and results to the
41	47		Texas Commission on Environmental Quality.
42	48		(j) Any new district created by the division of the district
43	49		must hold an election as required by this chapter to obtain voter
44	50		approval before the district may impose a maintenance tax or issue
45	51		bonds payable wholly or partly from ad valorem taxes.
46	52		SECTION 2. Subchapter C, Chapter 9021, Special District
47	53		Local Laws Code, is amended by adding Section 9021.105 to read as
48	54		follows:
49	55		Sec. 9021.105. LAW ENFORCEMENT SERVICES. To protect the
50	56		public interest, the district may contract with a qualified party,
51	57		including a county or a municipality, to provide law enforcement
52	58		services in the district for a fee.
53	59		SECTION 3. Subchapter D, Chapter 9021, Special District
54	60		Local Laws Code, is amended by adding Section 9021.152 to read as
55	61		follows:
56	62		Sec. 9021.152. CONTRACT TAXES. In accordance with Section
57	63		49.108, Water Code, the district may impose a tax other than an
58	64		operation and maintenance tax and use the revenue derived from the
59	65		tax to make payments under a contract after the provisions of the
60	66		contract have been approved by a majority of the district voters
61	67		voting at an election held for that purpose.
62	68		SECTION 4. Section 9021.104(c), Special District Local Laws
63	69		Code, is repealed.
64	70		SECTION 5. (a) The legal notice of the intention to
65	71		introduce this Act, setting forth the general substance of this
66	72		Act, has been published as provided by law, and the notice and a
67	73		copy of this Act have been furnished to all persons, agencies,
68	74		officials, or entities to which they are required to be furnished
69	75		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
70	76		Government Code.
71	77		(b) The governor, one of the required recipients, has
72	78		submitted the notice and Act to the Texas Commission on
73	79		Environmental Quality.
74	80		(c) The Texas Commission on Environmental Quality has filed
75	81		its recommendations relating to this Act with the governor,
76	82		lieutenant governor, and speaker of the house of representatives
77	83		within the required time.
78	84		(d) All requirements of the constitution and laws of this
79	85		state and the rules and procedures of the legislature with respect
80	86		to the notice, introduction, and passage of this Act have been
81	87		fulfilled and accomplished.
82	88		SECTION 6. This Act takes effect September 1, 2019.
