410 AN ACT
511 relating to the powers and duties of the Rolling V Ranch Water
612 Control and Improvement District No. 1 of Wise County.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 9021.104, Special District Local Laws
915 Code, is amended by amending Subsections (a) and (b) and adding
1016 Subsections (e), (f), (g), (h), (i), and (j) to read as follows:
1117 (a) The district may be divided into two or more new
1218 districts only if the district:
1319 (1) has no outstanding bonded debt; and
1420 (2) is not imposing ad valorem taxes.
1521 (b) This chapter applies to any new district created by the
1622 division of the district, and a new district has all the powers and
1723 duties of the district. [The division procedure is prescribed by
1824 Sections 53.030 through 53.041, Water Code.]
1925 (e) The board, on its own motion or on receipt of a petition
2026 signed by the owner or owners of a majority of the assessed value of
2127 the real property in the district, may adopt an order dividing the
2228 district.
2329 (f) An order dividing the district must:
2430 (1) name each new district;
2531 (2) include the metes and bounds description of the
2632 territory of each new district;
2733 (3) appoint temporary directors for each new district;
2834 and
2935 (4) provide for the division of assets and liabilities
3036 between or among the new districts.
3137 (g) On or before the 30th day after the date of adoption of
3238 an order dividing the district, the district shall file the order
3339 with the Texas Commission on Environmental Quality and record the
3440 order in the real property records of each county in which the
3541 district is located.
3642 (h) Any new district created by the division of the district
3743 shall hold a confirmation and directors' election as required by
3844 Section 49.102, Water Code.
3945 (i) If the creation of the new district is confirmed, the
4046 new district shall provide the election date and results to the
4147 Texas Commission on Environmental Quality.
4248 (j) Any new district created by the division of the district
4349 must hold an election as required by this chapter to obtain voter
4450 approval before the district may impose a maintenance tax or issue
4551 bonds payable wholly or partly from ad valorem taxes.
4652 SECTION 2. Subchapter C, Chapter 9021, Special District
4753 Local Laws Code, is amended by adding Section 9021.105 to read as
4854 follows:
4955 Sec. 9021.105. LAW ENFORCEMENT SERVICES. To protect the
5056 public interest, the district may contract with a qualified party,
5157 including a county or a municipality, to provide law enforcement
5258 services in the district for a fee.
5359 SECTION 3. Subchapter D, Chapter 9021, Special District
5460 Local Laws Code, is amended by adding Section 9021.152 to read as
5561 follows:
5662 Sec. 9021.152. CONTRACT TAXES. In accordance with Section
5763 49.108, Water Code, the district may impose a tax other than an
5864 operation and maintenance tax and use the revenue derived from the
5965 tax to make payments under a contract after the provisions of the
6066 contract have been approved by a majority of the district voters
6167 voting at an election held for that purpose.
6268 SECTION 4. Section 9021.104(c), Special District Local Laws
6369 Code, is repealed.
6470 SECTION 5. (a) The legal notice of the intention to
6571 introduce this Act, setting forth the general substance of this
6672 Act, has been published as provided by law, and the notice and a
6773 copy of this Act have been furnished to all persons, agencies,
6874 officials, or entities to which they are required to be furnished
6975 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
7076 Government Code.
7177 (b) The governor, one of the required recipients, has
7278 submitted the notice and Act to the Texas Commission on
7379 Environmental Quality.
7480 (c) The Texas Commission on Environmental Quality has filed
7581 its recommendations relating to this Act with the governor,
7682 lieutenant governor, and speaker of the house of representatives
7783 within the required time.
7884 (d) All requirements of the constitution and laws of this
7985 state and the rules and procedures of the legislature with respect
8086 to the notice, introduction, and passage of this Act have been
8187 fulfilled and accomplished.
8288 SECTION 6. This Act takes effect September 1, 2019.
