7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Chapter 21, Acts of the 71st Legislature, 6th |
---|
9 | 15 | | Called Session, 1990, is amended by amending Section 5 and adding |
---|
10 | 16 | | Sections 6B, 6C, and 6D to read as follows: |
---|
11 | 17 | | Sec. 5. FINDING OF BENEFIT. (a) All of the land and other |
---|
12 | 18 | | property included within the boundaries of the district will be |
---|
13 | 19 | | benefited by the works and projects that are to be accomplished by |
---|
14 | 20 | | the district under powers conferred by Article XVI, Section 59, of |
---|
15 | 21 | | the Texas Constitution. The district is created to serve a public |
---|
16 | 22 | | use and benefit. |
---|
17 | 23 | | (b) The district is created to accomplish the purposes of: |
---|
18 | 24 | | (1) a municipal utility district and a water control |
---|
19 | 25 | | and improvement district as provided by general law and Section 59, |
---|
20 | 26 | | Article XVI, Texas Constitution; and |
---|
21 | 27 | | (2) Section 52, Article III, Texas Constitution, that |
---|
22 | 28 | | relate to the construction, acquisition, improvement, operation, |
---|
23 | 29 | | or maintenance of macadamized, graveled, or paved roads, or |
---|
24 | 30 | | improvements, including storm drainage, in aid of those roads. |
---|
25 | 31 | | Sec. 6B. AUTHORITY FOR ROAD PROJECTS. Under Section 52, |
---|
26 | 32 | | Article III, Texas Constitution, the district may design, acquire, |
---|
27 | 33 | | construct, finance, improve, operate, maintain, and convey to this |
---|
28 | 34 | | state, a county, or a municipality for operation and maintenance |
---|
29 | 35 | | macadamized, graveled, or paved roads, or improvements, including |
---|
30 | 36 | | storm drainage, in aid of those roads. |
---|
31 | 37 | | Sec. 6C. ROAD STANDARDS AND REQUIREMENTS. (a) A road |
---|
32 | 38 | | project must meet all applicable construction standards, zoning and |
---|
33 | 39 | | subdivision requirements, and regulations of each municipality in |
---|
34 | 40 | | whose corporate limits or extraterritorial jurisdiction the road |
---|
35 | 41 | | project is located. |
---|
36 | 42 | | (b) If a road project is not located in the corporate limits |
---|
37 | 43 | | or extraterritorial jurisdiction of a municipality, the road |
---|
38 | 44 | | project must meet all applicable construction standards, |
---|
39 | 45 | | subdivision requirements, and regulations of each county in which |
---|
40 | 46 | | the road project is located. |
---|
41 | 47 | | (c) If the state will maintain and operate the road, the |
---|
42 | 48 | | Texas Transportation Commission must approve the plans and |
---|
43 | 49 | | specifications of the road project. |
---|
44 | 50 | | Sec. 6D. APPOINTMENT OF ARCHITECTURAL COMMITTEE. (a) In |
---|
45 | 51 | | order to carry out the provisions of Section 54.237, Water Code, |
---|
46 | 52 | | except as provided by Subsection (b), the district may appoint an |
---|
47 | 53 | | architectural committee for a subdivision located wholly inside the |
---|
48 | 54 | | district that does not have an architectural committee or an area of |
---|
49 | 55 | | the district not located in a subdivision. |
---|
50 | 56 | | (b) The district may not appoint an architectural committee |
---|
51 | 57 | | for a subdivision for which the governing provisions prohibit the |
---|
52 | 58 | | appointment of an architectural committee by the district or |
---|
53 | 59 | | otherwise. |
---|
54 | 60 | | SECTION 2. (a) The legal notice of the intention to |
---|
55 | 61 | | introduce this Act, setting forth the general substance of this |
---|
56 | 62 | | Act, has been published as provided by law, and the notice and a |
---|
57 | 63 | | copy of this Act have been furnished to all persons, agencies, |
---|
58 | 64 | | officials, or entities to which they are required to be furnished |
---|
59 | 65 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
60 | 66 | | Government Code. |
---|
61 | 67 | | (b) The governor, one of the required recipients, has |
---|
62 | 68 | | submitted the notice and Act to the Texas Commission on |
---|
63 | 69 | | Environmental Quality. |
---|
64 | 70 | | (c) The Texas Commission on Environmental Quality has filed |
---|
65 | 71 | | its recommendations relating to this Act with the governor, the |
---|
66 | 72 | | lieutenant governor, and the speaker of the house of |
---|
67 | 73 | | representatives within the required time. |
---|
68 | 74 | | (d) All requirements of the constitution and laws of this |
---|
69 | 75 | | state and the rules and procedures of the legislature with respect |
---|
70 | 76 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
71 | 77 | | and accomplished. |
---|
72 | 78 | | SECTION 3. This Act takes effect September 1, 2019. |
