| 5 | 11 | | relating to the authority of the Collingsworth County Hospital |
|---|
| 6 | 12 | | District to take certain actions regarding district property. |

| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 1014.107, Special District Local Laws |
|---|
| 9 | 15 | | Code, is amended to read as follows: |
|---|
| 10 | 16 | | Sec. 1014.107. DISTRICT PROPERTY, FACILITIES, AND |
|---|
| 11 | 17 | | EQUIPMENT [BUILDINGS]. (a) The board shall determine: |
|---|
| 12 | 18 | | (1) the type, number, and location of buildings or |
|---|
| 13 | 19 | | other facilities required to maintain an adequate hospital system; |
|---|
| 14 | 20 | | and |
|---|
| 15 | 21 | | (2) the type of equipment necessary for hospital care. |
|---|
| 16 | 22 | | (b) The board may: |
|---|
| 17 | 23 | | (1) acquire by purchase, lease, or lease to purchase |
|---|
| 18 | 24 | | or may construct, repair, or renovate property, including |
|---|
| 19 | 25 | | facilities or equipment, for use in the district's hospital system; |
|---|
| 20 | 26 | | and |
|---|
| 21 | 27 | | (2) mortgage or pledge the property as security for |
|---|
| 22 | 28 | | the purchase price. |
|---|
| 23 | 29 | | (c) The board may lease, sell, or otherwise dispose of all |
|---|
| 24 | 30 | | or part of the district's property for the district, including |
|---|
| 25 | 31 | | facilities or equipment, to a public or private entity. |
|---|
| 26 | 32 | | SECTION 2. Subchapter C, Chapter 1014, Special District |
|---|
| 27 | 33 | | Local Laws Code, is amended by adding Section 1014.113 to read as |
|---|
| 28 | 34 | | follows: |
|---|
| 29 | 35 | | Sec. 1014.113. OPERATING AND MANAGEMENT CONTRACTS. |
|---|
| 30 | 36 | | Notwithstanding any other provision of this chapter, the district, |
|---|
| 31 | 37 | | through its board, may contract with any person to manage or operate |
|---|
| 32 | 38 | | a district facility. |
|---|
| 33 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 43 | | Act takes effect September 1, 2019. |
