| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 24.07, Alcoholic Beverage Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 24.07. WHEN LICENSE ALSO HELD: HOURS OF SALE, ETC. A |
|---|
| 12 | 12 | | holder of a wine only package store permit who also holds a retail |
|---|
| 13 | 13 | | dealer's off-premise license for the same location may remain open |
|---|
| 14 | 14 | | and sell ale, wine, vinous liquors, and beer, for off-premises |
|---|
| 15 | 15 | | consumption only, on any day and during the same hours as those |
|---|
| 16 | 16 | | prescribed for the sale of beer under Section 105.05 [that the |
|---|
| 17 | 17 | | holder of a wine and beer retailer's permit may sell ale, beer, and |
|---|
| 18 | 18 | | wine], except that the permit holder [he] may not sell wine or |
|---|
| 19 | 19 | | vinous liquor containing more than 17 percent alcohol by volume on a |
|---|
| 20 | 20 | | Sunday or after 10 p.m. on any day. |

| 21 | 21 | | SECTION 2. Section 105.04, Alcoholic Beverage Code, is |
|---|
| 22 | 22 | | amended to read as follows: |
|---|
| 23 | 23 | | Sec. 105.04. HOURS OF SALE: WINE AND BEER RETAILER. The |
|---|
| 24 | 24 | | hours of sale and delivery for alcoholic beverages sold under a wine |
|---|
| 25 | 25 | | and beer retailer's permit or a wine and beer retailer's off-premise |
|---|
| 26 | 26 | | permit are the same as those prescribed for the sale of beer under |
|---|
| 27 | 27 | | Section 105.05 [of this code, except that no sale shall be allowed |
|---|
| 28 | 28 | | between 2 a.m. and noon on Sunday]. |
|---|
| 29 | 29 | | SECTION 3. Section 105.05(b), Alcoholic Beverage Code, is |
|---|
| 30 | 30 | | amended to read as follows: |
|---|
| 31 | 31 | | (b) A person may sell, offer for sale, or deliver beer |
|---|
| 32 | 32 | | between 7 a.m. and midnight on any day except Sunday. On Sunday a |
|---|
| 33 | 33 | | person [he] may sell beer between midnight and 1:00 a.m. and between |
|---|
| 34 | 34 | | noon and midnight, except that: |
|---|
| 35 | 35 | | (1) permittees or licensees authorized to sell for |
|---|
| 36 | 36 | | on-premise consumption may sell beer between 10:00 a.m. and noon if |
|---|
| 37 | 37 | | the beer is served to a customer during the service of food to the |
|---|
| 38 | 38 | | customer; and |
|---|
| 39 | 39 | | (2) holders of a retail dealer's on-premise license or |
|---|
| 40 | 40 | | a retail dealer's off-premise license may also sell beer for |
|---|
| 41 | 41 | | off-premise consumption between 10:00 a.m. and noon. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2019. |
