411 relating to the creation of the SH130 Municipal Management District
512 No. 1; providing authority to issue bonds; providing authority to
613 impose assessments, fees, and taxes.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Subtitle C, Title 4, Special District Local Laws
916 Code, is amended by adding Chapter 3971 to read as follows:
1017 CHAPTER 3971. SH130 MUNICIPAL MANAGEMENT DISTRICT NO. 1
1118 SUBCHAPTER A. GENERAL PROVISIONS
1219 Sec. 3971.0101. DEFINITIONS. In this chapter:
1320 (1) "Board" means the district's board of directors.
1421 (2) "City" means the City of Austin.
1522 (3) "Director" means a board member.
1623 (4) "District" means the SH130 Municipal Management
1724 District No. 1.
1825 Sec. 3971.0102. NATURE OF DISTRICT. The district is a
1926 special district created under Section 59, Article XVI, Texas
2027 Constitution.
2128 Sec. 3971.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2229 creation of the district is essential to accomplish the purposes of
2330 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2431 Texas Constitution, and other public purposes stated in this
2532 chapter.
2633 (b) By creating the district and in authorizing the city and
2734 other political subdivisions to contract with the district, the
2835 legislature has established a program to accomplish the public
2936 purposes set out in Section 52-a, Article III, Texas Constitution.
3037 (c) The creation of the district is necessary to promote,
3138 develop, encourage, and maintain employment, commerce,
3239 transportation, housing, tourism, recreation, the arts,
3340 entertainment, economic development, safety, and the public
3441 welfare in the district.
3542 (d) This chapter and the creation of the district may not be
3643 interpreted to relieve the city from providing the level of
3744 services provided as of the effective date of the Act enacting this
3845 chapter to the area in the district. The district is created to
3946 supplement and not to supplant city services provided in the
4047 district.
4148 Sec. 3971.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4249 (a) All land and other property included in the district will
4350 benefit from the improvements and services to be provided by the
4451 district under powers conferred by Sections 52 and 52-a, Article
4552 III, and Section 59, Article XVI, Texas Constitution, and other
4653 powers granted under this chapter.
4754 (b) The district is created to serve a public use and
4855 benefit.
4956 (c) The creation of the district is in the public interest
5057 and is essential to further the public purposes of:
5158 (1) developing and diversifying the economy of the
5259 state;
5360 (2) eliminating unemployment and underemployment; and
5461 (3) developing or expanding transportation and
5562 commerce.
5663 (d) The district will:
5764 (1) promote the health, safety, and general welfare of
5865 residents, employers, potential employees, employees, visitors,
5966 and consumers in the district, and of the public;
6067 (2) provide needed funding for the district to
6168 preserve, maintain, and enhance the economic health and vitality of
6269 the district territory as a community and business center;
6370 (3) promote the health, safety, welfare, and enjoyment
6471 of the public by providing pedestrian ways and by landscaping and
6572 developing certain areas in the district, which are necessary for
6673 the restoration, preservation, and enhancement of scenic beauty;
6774 and
6875 (4) provide for water, wastewater, drainage, road, and
6976 recreational facilities for the district.
7077 (e) Pedestrian ways along or across a street, whether at
7178 grade or above or below the surface, and street lighting, street
7279 landscaping, parking, and street art objects are parts of and
7380 necessary components of a street and are considered to be a street
7481 or road improvement.
7582 (f) The district will not act as the agent or
7683 instrumentality of any private interest even though the district
7784 will benefit many private interests as well as the public.
7885 Sec. 3971.0105. INITIAL DISTRICT TERRITORY. (a) The
7986 district is initially composed of the territory described by
8087 Section 2 of the Act enacting this chapter.
8188 (b) The boundaries and field notes contained in Section 2 of
8289 the Act enacting this chapter form a closure. A mistake in the
8390 field notes or in copying the field notes in the legislative process
8491 does not affect the district's:
8592 (1) organization, existence, or validity;
8693 (2) right to issue any type of bonds for the purposes
8794 for which the district is created or to pay the principal of and
8895 interest on the bonds;
8996 (3) right to impose or collect an assessment or tax; or
9097 (4) legality or operation.
9198 Sec. 3971.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9299 All or any part of the area of the district is eligible to be
93100 included in:
94101 (1) a tax increment reinvestment zone created under
95102 Chapter 311, Tax Code; or
96103 (2) a tax abatement reinvestment zone created under
97104 Chapter 312, Tax Code.
98105 Sec. 3971.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
99106 DISTRICTS LAW. Except as otherwise provided by this chapter,
100107 Chapter 375, Local Government Code, applies to the district.
101108 Sec. 3971.0108. CONSTRUCTION OF CHAPTER. This chapter
102109 shall be liberally construed in conformity with the findings and
103110 purposes stated in this chapter.
104111 SUBCHAPTER B. BOARD OF DIRECTORS
105112 Sec. 3971.0201. GOVERNING BODY; TERMS. (a) The district is
106113 governed by a board of five elected directors who serve staggered
107114 terms of four years.
108115 (b) Directors are elected in the manner provided by
109116 Subchapter D, Chapter 49, Water Code.
110117 Sec. 3971.0202. COMPENSATION; EXPENSES. (a) The district
111118 may compensate each director in an amount not to exceed $150 for
112119 each board meeting. The total amount of compensation for each
113120 director in one year may not exceed $7,200.
114121 (b) A director is entitled to reimbursement for necessary
115122 and reasonable expenses incurred in carrying out the duties and
116123 responsibilities of the board.
117124 Sec. 3971.0203. INITIAL DIRECTORS. (a) The initial board

133140 SUBCHAPTER C. POWERS AND DUTIES
134141 Sec. 3971.0301. GENERAL POWERS AND DUTIES. The district
135142 has the powers and duties necessary to accomplish the purposes for
136143 which the district is created.
137144 Sec. 3971.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
138145 district, using any money available to the district for the
139146 purpose, may provide, design, construct, acquire, improve,
140147 relocate, operate, maintain, or finance an improvement project or
141148 service authorized under this chapter or Chapter 375, Local
142149 Government Code.
143150 (b) The district may contract with a governmental or private
144151 entity to carry out an action under Subsection (a).
145152 (c) The implementation of a district project or service is a
146153 governmental function or service for the purposes of Chapter 791,
147154 Government Code.
148155 Sec. 3971.0303. NONPROFIT CORPORATION. (a) The board by
149156 resolution may authorize the creation of a nonprofit corporation to
150157 assist and act for the district in implementing a project or
151158 providing a service authorized by this chapter.
152159 (b) The nonprofit corporation:
153160 (1) has each power of and is considered to be a local
154161 government corporation created under Subchapter D, Chapter 431,
155162 Transportation Code; and
156163 (2) may implement any project and provide any service
157164 authorized by this chapter.
158165 (c) The board shall appoint the board of directors of the
159166 nonprofit corporation. The board of directors of the nonprofit
160167 corporation shall serve in the same manner as the board of directors
161168 of a local government corporation created under Subchapter D,
162169 Chapter 431, Transportation Code, except that a board member is not
163170 required to reside in the district.
164171 Sec. 3971.0304. LAW ENFORCEMENT SERVICES. To protect the
165172 public interest, the district may contract with a qualified party,
166173 including the city, to provide law enforcement services in the
167174 district for a fee.
168175 Sec. 3971.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
169176 The district may join and pay dues to a charitable or nonprofit
170177 organization that performs a service or provides an activity
171178 consistent with the furtherance of a district purpose.
172179 Sec. 3971.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
173180 district may engage in activities that accomplish the economic
174181 development purposes of the district.
175182 (b) The district may establish and provide for the
176183 administration of one or more programs to promote state or local
177184 economic development and to stimulate business and commercial
178185 activity in the district, including programs to:
179186 (1) make loans and grants of public money; and
180187 (2) provide district personnel and services.
181188 (c) The district may create economic development programs
182189 and exercise the economic development powers provided to
183190 municipalities by:
184191 (1) Chapter 380, Local Government Code; and
185192 (2) Subchapter A, Chapter 1509, Government Code.
186193 Sec. 3971.0307. PARKING FACILITIES. (a) The district may
187194 acquire, lease as lessor or lessee, construct, develop, own,
188195 operate, and maintain parking facilities or a system of parking
189196 facilities, including lots, garages, parking terminals, or other
190197 structures or accommodations for parking motor vehicles off the
191198 streets and related appurtenances.
192199 (b) The district's parking facilities serve the public
193200 purposes of the district and are owned, used, and held for a public
194201 purpose even if leased or operated by a private entity for a term of
195202 years.
196203 (c) The district's parking facilities are parts of and
197204 necessary components of a street and are considered to be a street
198205 or road improvement.
199206 (d) The development and operation of the district's parking
200207 facilities may be considered an economic development program.
201208 Sec. 3971.0308. ADDING OR EXCLUDING LAND. The district may
202209 add or exclude land in the manner provided by Subchapter J, Chapter
203210 49, Water Code, or by Subchapter H, Chapter 54, Water Code.
204211 Sec. 3971.0309. DISBURSEMENTS AND TRANSFERS OF MONEY. The
205212 board by resolution shall establish the number of directors'
206213 signatures and the procedure required for a disbursement or
207214 transfer of district money.
208215 Sec. 3971.0310. NO EMINENT DOMAIN POWER. The district may
209216 not exercise the power of eminent domain.
210217 SUBCHAPTER D. ASSESSMENTS
211218 Sec. 3971.0401. PETITION REQUIRED FOR FINANCING SERVICES
212219 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
213220 service or improvement project with assessments under this chapter
214221 unless a written petition requesting that service or improvement
215222 has been filed with the board.
216223 (b) A petition filed under Subsection (a) must be signed by
217224 the owners of a majority of the assessed value of real property in
218225 the district subject to assessment according to the most recent
219226 certified tax appraisal roll for the county.
220227 Sec. 3971.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
221228 The board by resolution may impose and collect an assessment for any
222229 purpose authorized by this chapter in all or any part of the
223230 district.
224231 (b) An assessment, a reassessment, or an assessment
225232 resulting from an addition to or correction of the assessment roll
226233 by the district, penalties and interest on an assessment or
227234 reassessment, an expense of collection, and reasonable attorney's
228235 fees incurred by the district:
229236 (1) are a first and prior lien against the property
230237 assessed;
231238 (2) are superior to any other lien or claim other than
232239 a lien or claim for county, school district, or municipal ad valorem
233240 taxes; and
234241 (3) are the personal liability of and a charge against
235242 the owners of the property even if the owners are not named in the
236243 assessment proceedings.
237244 (c) The lien is effective from the date of the board's
238245 resolution imposing the assessment until the date the assessment is
239246 paid. The board may enforce the lien in the same manner that the
240247 board may enforce an ad valorem tax lien against real property.
241248 (d) The board may make a correction to or deletion from the
242249 assessment roll that does not increase the amount of assessment of
243250 any parcel of land without providing notice and holding a hearing in
244251 the manner required for additional assessments.
245252 SUBCHAPTER E. TAXES AND BONDS
246253 Sec. 3971.0501. TAX ELECTION REQUIRED. The district must
247254 hold an election in the manner provided by Chapter 49, Water Code,
248255 or, if applicable, Chapter 375, Local Government Code, to obtain
249256 voter approval before the district may impose an ad valorem tax.
250257 Sec. 3971.0502. OPERATION AND MAINTENANCE TAX. (a) If
251258 authorized by a majority of the district voters voting at an
252259 election under Section 3971.0501, the district may impose an
253260 operation and maintenance tax on taxable property in the district
254261 in the manner provided by Section 49.107, Water Code, for any
255262 district purpose, including to:
256263 (1) maintain and operate the district;
257264 (2) construct or acquire improvements; or
258265 (3) provide a service.
259266 (b) The board shall determine the operation and maintenance
260267 tax rate. The rate may not exceed the rate approved at the
261268 election.
262269 Sec. 3971.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
263270 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
264271 terms determined by the board.
265272 (b) The district may issue bonds, notes, or other
266273 obligations payable wholly or partly from ad valorem taxes,
267274 assessments, impact fees, revenue, contract payments, grants, or
268275 other district money, or any combination of those sources of money,
269276 to pay for any authorized district purpose.
270277 (c) The limitation on the outstanding principal amount of
271278 bonds, notes, or other obligations provided by Section 49.4645,
272279 Water Code, does not apply to the district.
273280 Sec. 3971.0504. BONDS SECURED BY REVENUE OR CONTRACT
274281 PAYMENTS. The district may issue, without an election, bonds
275282 secured by:
276283 (1) revenue other than ad valorem taxes, including
277284 contract revenues; or
278285 (2) contract payments, provided that the requirements
279286 of Section 49.108, Water Code, have been met.
280287 Sec. 3971.0505. BONDS SECURED BY AD VALOREM TAXES;
281288 ELECTIONS. (a) If authorized at an election under Section
282289 3971.0501, the district may issue bonds payable from ad valorem
283290 taxes.
284291 (b) Section 375.243, Local Government Code, does not apply
285292 to the district.
286293 (c) At the time the district issues bonds payable wholly or
287294 partly from ad valorem taxes, the board shall provide for the annual
288295 imposition of a continuing direct annual ad valorem tax, without
289296 limit as to rate or amount, for each year that all or part of the
290297 bonds are outstanding as required and in the manner provided by
291298 Sections 54.601 and 54.602, Water Code.
292299 (d) All or any part of any facilities or improvements that
293300 may be acquired by a district by the issuance of its bonds may be
294301 submitted as a single proposition or as several propositions to be
295302 voted on at the election.
296303 Sec. 3971.0506. BONDS AND OTHER OBLIGATIONS FOR IMPROVEMENT
297304 UNDER AGREEMENT. If the improvements financed by an obligation
298305 will be conveyed to or operated and maintained by a municipality or
299306 retail utility provider pursuant to an agreement between the
300307 district and the municipality or retail utility provider entered
301308 into before the issuance of the obligation, the obligation may be in
302309 the form of bonds, notes, or other obligations payable wholly or
303310 partly from assessments, issued by public or private sale, in the
304311 manner provided by Subchapter A, Chapter 372, Local Government
305312 Code.
306313 Sec. 3971.0507. CONSENT OF MUNICIPALITY REQUIRED. (a) The
307314 board may not issue bonds until each municipality in whose
308315 corporate limits or extraterritorial jurisdiction the district is
309316 located has consented by ordinance or resolution to the creation of
310317 the district and to the inclusion of land in the district.
311318 (b) This section applies only to the district's first
312319 issuance of bonds payable from ad valorem taxes.
313320 SUBCHAPTER F. SALES AND USE TAX
314321 Sec. 3971.0601. APPLICABILITY OF CERTAIN TAX CODE
315322 PROVISIONS. (a) Chapter 321, Tax Code, governs the imposition,
316323 computation, administration, enforcement, and collection of the
317324 sales and use tax authorized by this subchapter except to the extent
318325 Chapter 321, Tax Code, is inconsistent with this chapter.
319326 (b) For the purposes of this subchapter, a reference in
320327 Chapter 321, Tax Code, to a municipality or the governing body of a
321328 municipality is a reference to the district or the board,
322329 respectively.
323330 Sec. 3971.0602. ELECTION; ADOPTION OF TAX. (a) The
324331 district may adopt a sales and use tax if:
325332 (1) the city consents to the adoption of the tax; and
326333 (2) the tax is authorized by a majority of the voters
327334 of the district voting at an election held for that purpose.
328335 (b) Subject to city consent under Subsection (a), the board
329336 by order may call an election to authorize the adoption of the sales
330337 and use tax. The election may be held on any uniform election date
331338 and in conjunction with any other district election.
332339 (c) The district shall provide notice of the election and
333340 shall hold the election in the manner prescribed by Section
334341 3971.0501.
335342 (d) The ballot shall be printed to provide for voting for or
336343 against the proposition: "Authorization of a sales and use tax in
337344 the SH130 Municipal Management District No. 1 at a rate not to
338345 exceed ____ percent" (insert rate of one or more increments of
339346 one-eighth of one percent).
340347 Sec. 3971.0603. SALES AND USE TAX RATE. (a) Not later than
341348 the 10th day after the date the results are declared of an election
342349 held under Section 3971.0602 at which the voters authorized
343350 imposition of a tax, the board shall provide by resolution or order
344351 the initial rate of the tax, which must be in one or more increments
345352 of one-eighth of one percent.
346353 (b) After the authorization of a tax under Section
347354 3971.0602, the board may decrease the rate of the tax by one or more
348355 increments of one-eighth of one percent.
349356 (c) The board may not decrease the rate of the tax if the
350357 decrease would impair the repayment of any outstanding debt or
351358 obligation payable from the tax.
352359 (d) The initial rate of the tax or any rate resulting from
353360 subsequent decreases may not exceed the lesser of:
354361 (1) the maximum rate authorized at the election held
355362 under Section 3971.0602; or
356363 (2) a rate that, when added to the rates of all sales
357364 and use taxes imposed by other political subdivisions with
358365 territory in the district, would result in the maximum combined
359366 rate prescribed by Section 321.101(f), Tax Code, at any location in
360367 the district.
361368 Sec. 3971.0604. NOTIFICATION OF RATE CHANGE. The board
362369 shall notify the comptroller of any changes made to the tax rate
363370 under this subchapter in the same manner the municipal secretary
364371 provides notice to the comptroller under Section 321.405(b), Tax
365372 Code.
366373 Sec. 3971.0605. USE OF REVENUE. Revenue from the sales and
367374 use tax imposed under this subchapter is for the use and benefit of
368375 the district and may be used for any district purpose. The district
369376 may pledge all or part of the revenue to the payment of bonds,
370377 notes, or other obligations, and that pledge of revenue may be in
371378 combination with other revenue, including tax revenue, available to
372379 the district.
373380 Sec. 3971.0606. ABOLITION OF TAX. (a) Except as provided
374381 by Subsection (b), the board may abolish the tax imposed under this
375382 subchapter without an election.
376383 (b) The board may not abolish the tax imposed under this
377384 subchapter if the district has any outstanding debt or obligation
378385 secured by the tax, and repayment of the debt or obligation would be
379386 impaired by the abolition of the tax.
380387 (c) If the board abolishes the tax, the board shall notify
381388 the comptroller of that action in the same manner the municipal
382389 secretary provides notice to the comptroller under Section
383390 321.405(b), Tax Code.
384391 (d) If the board abolishes the tax or decreases the tax rate
385392 to zero, a new election to authorize a sales and use tax must be held
386393 under Section 3971.0602 before the district may subsequently impose
387394 the tax.
388395 SUBCHAPTER G. HOTEL OCCUPANCY TAX
389396 Sec. 3971.0701. DEFINITION. In this subchapter, "hotel"
390397 has the meaning assigned by Section 156.001, Tax Code.
391398 Sec. 3971.0702. APPLICABILITY OF CERTAIN TAX CODE
392399 PROVISIONS. (a) For the purposes of this subchapter:
393400 (1) a reference in Chapter 352, Tax Code, to a county
394401 is a reference to the district; and
395402 (2) a reference in Chapter 352, Tax Code, to the
396403 commissioners court is a reference to the board.
397404 (b) Except as inconsistent with this subchapter, Subchapter
398405 A, Chapter 352, Tax Code, governs a hotel occupancy tax authorized
399406 by this subchapter, including the collection of the tax, subject to
400407 the limitations prescribed by Sections 352.002(b) and (c), Tax
401408 Code.
402409 Sec. 3971.0703. TAX AUTHORIZED; USE OF REVENUE. (a) The
403410 district may not impose a hotel occupancy tax unless the city
404411 consents to the imposition.
405412 (b) The district may impose the hotel occupancy tax for:
406413 (1) any purpose authorized under Chapter 351, Tax
407414 Code; or
408415 (2) the construction, operation, or maintenance of a
409416 sports-related facility of the district if the city is authorized
410417 to impose the tax under Section 351.002, Tax Code, for that purpose
411418 that:
412419 (A) has a notable impact on tourism and hotel
413420 activity; and
414421 (B) is available to the public.
415422 Sec. 3971.0704. TAX RATE. The amount of the hotel occupancy
416423 tax may not exceed seven percent of the price paid for a room in a
417424 hotel.
418425 Sec. 3971.0705. INFORMATION. The district may examine and
419426 receive information related to the imposition of hotel occupancy
420427 taxes to the same extent as if the district were a county.
421428 SUBCHAPTER I. DISSOLUTION
422429 Sec. 3971.0901. DISSOLUTION. (a) The board shall dissolve
423430 the district on written petition filed with the board by the owners
424431 of:
425432 (1) 66 percent or more of the assessed value of the
426433 property subject to assessment by the district based on the most
427434 recent certified county property tax rolls; or
428435 (2) 66 percent or more of the surface area of the
429436 district, excluding roads, streets, highways, utility
430437 rights-of-way, other public areas, and other property exempt from
431438 assessment by the district according to the most recent certified
432439 county property tax rolls.
433440 (b) The board by majority vote may dissolve the district at
434441 any time.
435442 (c) The district may not be dissolved by its board under
436443 Subsection (a) or (b) if the district:
437444 (1) has any outstanding debt until that debt has been
438445 repaid or defeased in accordance with the order or resolution
439446 authorizing the issuance of the debt;
440447 (2) has a contractual obligation to pay money until
441448 that obligation has been fully paid in accordance with the
442449 contract; or
443450 (3) owns, operates, or maintains public works,
444451 facilities, or improvements unless the district contracts with
445452 another person for the ownership and operation or maintenance of
446453 the public works, facilities, or improvements.
447454 (d) Sections 375.261, 375.262, and 375.264, Local
448455 Government Code, do not apply to the district.
449456 SECTION 2. The SH130 Municipal Management District No. 1
450457 initially includes all territory contained in the following area:
451458 Tract 1: Being a 23.92 acre tract or parcel of land, situated in the
452459 Oliver Buckman Survey, Number 40, Abstract 60, Travis County,
453460 Texas, and being the remainders of "Tract 1", a called 20.00 acre
454461 tract of land, "Tract 2", a called 5.00 acre tract of land and
455462 "Tract 3", a called 20.05 acre tract of land, all as conveyed to
456463 Hayes Modular Group, Inc., recorded in Document No. 2009120857,
457464 Official Public Records of Travis County, Texas, save and except
458465 that portion conveyed to the State of Texas in Document
459466 No. 2005052171, Official Public Records of Travis County, Texas,
460467 also being the remainder of that certain called 5.15 acre tract of
461468 land conveyed to Hayes Trucking Service, Inc., recorded in Document
462469 No. 2003226321, Official Public Records of Travis County, Texas,
463470 save and except that portion described in a Possession and Use
464471 Agreement for Transportation Purposes, recorded in Document
465472 No. 2006027200, Official Public Records of Travis County, Texas,

12591266 (b) The governor, one of the required recipients, has
12601267 submitted the notice and Act to the Texas Commission on

12621269 (c) The Texas Commission on Environmental Quality has filed
12631270 its recommendations relating to this Act with the governor,
12641271 lieutenant governor, and speaker of the house of representatives

12701277 SECTION 4. This Act takes effect immediately if it receives

12731280 Act does not receive the vote necessary for immediate effect, this
