410 AN ACT
511 relating to the powers and duties of the Williamson County
612 Municipal Utility District No. 21; providing authority to issue
713 bonds; providing authority to impose a tax.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 8132.002, Special District Local Laws
1016 Code, is amended to read as follows:
1117 Sec. 8132.002. NATURE AND PURPOSES OF DISTRICT. (a) The
1218 district is a municipal utility district in Williamson County
1319 created under [and essential to accomplish the purposes of] Section
1420 59, Article XVI, Texas Constitution.
1521 (b) The district is created to accomplish the purposes of:
1622 (1) a municipal utility district as provided by
1723 general law and Section 59, Article XVI, Texas Constitution; and
1824 (2) Section 52, Article III, Texas Constitution, that
1925 relate to the construction, acquisition, improvement, operation,
2026 or maintenance of macadamized, graveled, or paved roads, or
2127 improvements, including storm drainage, in aid of those roads.
2228 SECTION 2. Subchapter C, Chapter 8132, Special District
2329 Local Laws Code, is amended by adding Sections 8132.104, 8132.105,
2430 8132.106, and 8132.107 to read as follows:
2531 Sec. 8132.104. GENERAL POWERS AND DUTIES. The district has
2632 the powers and duties necessary to accomplish the purposes for
2733 which the district is created.
2834 Sec. 8132.105. MUNICIPAL UTILITY DISTRICT POWERS AND
2935 DUTIES. The district has the powers and duties provided by the
3036 general law of this state, including Chapters 49 and 54, Water Code,
3137 applicable to municipal utility districts created under Section 59,
3238 Article XVI, Texas Constitution.
3339 Sec. 8132.106. AUTHORITY FOR ROAD PROJECTS. Under Section
3440 52, Article III, Texas Constitution, the district may design,
3541 acquire, construct, finance, issue bonds for, improve, operate,
3642 maintain, and convey to this state, a county, or a municipality for
3743 operation and maintenance macadamized, graveled, or paved roads, or
3844 improvements, including storm drainage, in aid of those roads.
3945 Sec. 8132.107. ROAD STANDARDS AND REQUIREMENTS. (a) A road
4046 project must meet all applicable construction standards, zoning and
4147 subdivision requirements, and regulations of each municipality in
4248 whose corporate limits or extraterritorial jurisdiction the road
4349 project is located.
4450 (b) If a road project is not located in the corporate limits
4551 or extraterritorial jurisdiction of a municipality, the road
4652 project must meet all applicable construction standards,
4753 subdivision requirements, and regulations of each county in which
4854 the road project is located.
4955 (c) If the state will maintain and operate the road, the
5056 Texas Transportation Commission must approve the plans and
5157 specifications of the road project.
5258 SECTION 3. Chapter 8132, Special District Local Laws Code,
5359 is amended by adding Subchapter E to read as follows:
5460 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
5561 Sec. 8132.201. AUTHORITY TO ISSUE BONDS AND OTHER
5662 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds or
5763 other obligations payable wholly or partly from ad valorem taxes,
5864 impact fees, revenue, contract payments, grants, or other district
5965 money, or any combination of those sources, to pay for a road
6066 project authorized by Section 8132.106.
6167 (b) The district may not issue bonds payable from ad valorem
6268 taxes to finance a road project unless the issuance is approved by a
6369 vote of a two-thirds majority of the district voters voting at an
6470 election held for that purpose.
6571 (c) At the time of issuance, the total principal amount of
6672 bonds or other obligations issued or incurred to finance road
6773 projects and payable from ad valorem taxes may not exceed
6874 one-fourth of the assessed value of the real property in the
6975 district.
7076 Sec. 8132.202. TAXES FOR BONDS. At the time the district
7177 issues bonds payable wholly or partly from ad valorem taxes, the
7278 board shall provide for the annual imposition of a continuing
7379 direct ad valorem tax, without limit as to rate or amount, while all
7480 or part of the bonds are outstanding as required and in the manner
7581 provided by Sections 54.601 and 54.602, Water Code.
7682 SECTION 4. The following provisions of the Special District
7783 Local Laws Code are repealed:
7884 (1) Section 8132.101;
7985 (2) Section 8132.102; and
8086 (3) Section 8132.103.
8187 SECTION 5. (a) The legal notice of the intention to
8288 introduce this Act, setting forth the general substance of this
8389 Act, has been published as provided by law, and the notice and a
8490 copy of this Act have been furnished to all persons, agencies,
8591 officials, or entities to which they are required to be furnished
8692 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
8793 Government Code.
8894 (b) The governor, one of the required recipients, has
8995 submitted the notice and Act to the Texas Commission on
9096 Environmental Quality.
9197 (c) The Texas Commission on Environmental Quality has filed
9298 its recommendations relating to this Act with the governor, the
9399 lieutenant governor, and the speaker of the house of
94100 representatives within the required time.
95101 (d) All requirements of the constitution and laws of this
96102 state and the rules and procedures of the legislature with respect
97103 to the notice, introduction, and passage of this Act are fulfilled
98104 and accomplished.
99105 SECTION 6. This Act takes effect immediately if it receives
100106 a vote of two-thirds of all the members elected to each house, as
101107 provided by Section 39, Article III, Texas Constitution. If this
102108 Act does not receive the vote necessary for immediate effect, this
103109 Act takes effect September 1, 2019.
