10 | 18 | | CHAPTER 3986. NORTH CELINA MUNICIPAL MANAGEMENT DISTRICT NO. 3 |

11 | 19 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
12 | 20 | | Sec. 3986.0101. DEFINITIONS. In this chapter: |
---|
13 | 21 | | (1) "Board" means the district's board of directors. |
---|
14 | 22 | | (2) "City" means the City of Celina. |
---|
15 | 23 | | (3) "Director" means a board member. |
---|
16 | 24 | | (4) "District" means the North Celina Municipal |
---|
17 | 25 | | Management District No. 3. |
---|
18 | 26 | | Sec. 3986.0102. NATURE OF DISTRICT. The North Celina |
---|
19 | 27 | | Municipal Management District No. 3 is a special district created |
---|
20 | 28 | | under Section 59, Article XVI, Texas Constitution. |
---|
21 | 29 | | Sec. 3986.0103. PURPOSE; DECLARATION OF INTENT. (a) The |
---|
22 | 30 | | creation of the district is essential to accomplish the purposes of |
---|
23 | 31 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
24 | 32 | | Texas Constitution, and other public purposes stated in this |
---|
25 | 33 | | chapter. |
---|
26 | 34 | | (b) By creating the district and in authorizing the city and |
---|
27 | 35 | | other political subdivisions to contract with the district, the |
---|
28 | 36 | | legislature has established a program to accomplish the public |
---|
29 | 37 | | purposes set out in Section 52-a, Article III, Texas Constitution. |
---|
30 | 38 | | (c) The creation of the district is necessary to promote, |
---|
31 | 39 | | develop, encourage, and maintain employment, commerce, |
---|
32 | 40 | | transportation, housing, tourism, recreation, the arts, |
---|
33 | 41 | | entertainment, economic development, safety, and the public |
---|
34 | 42 | | welfare in the district. |
---|
35 | 43 | | (d) This chapter and the creation of the district may not be |
---|
36 | 44 | | interpreted to relieve the city from providing the level of |
---|
37 | 45 | | services provided as of the effective date of the Act enacting this |
---|
38 | 46 | | chapter to the area in the district. The district is created to |
---|
39 | 47 | | supplement and not to supplant city services provided in the |
---|
40 | 48 | | district. |
---|
41 | 49 | | Sec. 3986.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. |
---|
42 | 50 | | (a) All land and other property included in the district will |
---|
43 | 51 | | benefit from the improvements and services to be provided by the |
---|
44 | 52 | | district under powers conferred by Sections 52 and 52-a, Article |
---|
45 | 53 | | III, and Section 59, Article XVI, Texas Constitution, and other |
---|
46 | 54 | | powers granted under this chapter. |
---|
47 | 55 | | (b) The district is created to serve a public use and |
---|
48 | 56 | | benefit. |
---|
49 | 57 | | (c) The creation of the district is in the public interest |
---|
50 | 58 | | and is essential to further the public purposes of: |
---|
51 | 59 | | (1) developing and diversifying the economy of the |
---|
52 | 60 | | state; |
---|
53 | 61 | | (2) eliminating unemployment and underemployment; and |
---|
54 | 62 | | (3) developing or expanding transportation and |
---|
55 | 63 | | commerce. |
---|
56 | 64 | | (d) The district will: |
---|
57 | 65 | | (1) promote the health, safety, and general welfare of |
---|
58 | 66 | | residents, employers, potential employees, employees, visitors, |
---|
59 | 67 | | and consumers in the district, and of the public; |
---|
60 | 68 | | (2) provide needed funding for the district to |
---|
61 | 69 | | preserve, maintain, and enhance the economic health and vitality of |
---|
62 | 70 | | the district territory as a community and business center; |
---|
63 | 71 | | (3) promote the health, safety, welfare, and enjoyment |
---|
64 | 72 | | of the public by providing pedestrian ways and by landscaping and |
---|
65 | 73 | | developing certain areas in the district, which are necessary for |
---|
66 | 74 | | the restoration, preservation, and enhancement of scenic beauty; |
---|
67 | 75 | | and |
---|
68 | 76 | | (4) provide for the construction of water, wastewater, |
---|
69 | 77 | | drainage, road, and recreational facilities for the district. |
---|
70 | 78 | | (e) Pedestrian ways along or across a street, whether at |
---|
71 | 79 | | grade or above or below the surface, and street lighting, street |
---|
72 | 80 | | landscaping, parking, and street art objects are parts of and |
---|
73 | 81 | | necessary components of a street and are considered to be a street |
---|
74 | 82 | | or road improvement. |
---|
75 | 83 | | (f) The district will not act as the agent or |
---|
76 | 84 | | instrumentality of any private interest even though the district |
---|
77 | 85 | | will benefit many private interests as well as the public. |
---|
78 | 86 | | Sec. 3986.0105. INITIAL DISTRICT TERRITORY. (a) The |
---|
79 | 87 | | district is initially composed of the territory described by |
---|
80 | 88 | | Section 2 of the Act enacting this chapter. |
---|
81 | 89 | | (b) The boundaries and field notes contained in Section 2 of |
---|
82 | 90 | | the Act enacting this chapter form a closure. A mistake in the |
---|
83 | 91 | | field notes or in copying the field notes in the legislative process |
---|
84 | 92 | | does not affect the district's: |
---|
85 | 93 | | (1) organization, existence, or validity; |
---|
86 | 94 | | (2) right to issue any type of bonds for the purposes |
---|
87 | 95 | | for which the district is created or to pay the principal of and |
---|
88 | 96 | | interest on the bonds; |
---|
89 | 97 | | (3) right to impose or collect an assessment or tax; or |
---|
90 | 98 | | (4) legality or operation. |
---|
91 | 99 | | Sec. 3986.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES. |
---|
92 | 100 | | All or any part of the area of the district is eligible to be |
---|
93 | 101 | | included in: |
---|
94 | 102 | | (1) a tax increment reinvestment zone created under |
---|
95 | 103 | | Chapter 311, Tax Code; or |
---|
96 | 104 | | (2) a tax abatement reinvestment zone created under |
---|
97 | 105 | | Chapter 312, Tax Code. |
---|
98 | 106 | | Sec. 3986.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT |
---|
99 | 107 | | DISTRICTS LAW. Except as otherwise provided by this chapter, |
---|
100 | 108 | | Chapter 375, Local Government Code, applies to the district. |
---|
101 | 109 | | Sec. 3986.0108. CONSTRUCTION OF CHAPTER. This chapter |
---|
102 | 110 | | shall be liberally construed in conformity with the findings and |
---|
103 | 111 | | purposes stated in this chapter. |
---|
104 | 112 | | Sec. 3986.0109. COMPLIANCE WITH AND ENFORCEABILITY OF |
---|
105 | 113 | | MUNICIPAL CONSENT AGREEMENT, ORDINANCE, OR RESOLUTION. (a) The |
---|
106 | 114 | | district shall comply with all applicable requirements of any |
---|
107 | 115 | | ordinance or resolution that consents to the creation of the |
---|
108 | 116 | | district or to the inclusion of land in the district. |
---|
109 | 117 | | (b) Any agreement between the district and a municipality |
---|
110 | 118 | | related to the municipality's consent to the creation of the |
---|
111 | 119 | | district, including a development agreement, is valid and |
---|
112 | 120 | | enforceable. |
---|
113 | 121 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
114 | 122 | | Sec. 3986.0201. GOVERNING BODY; TERMS. (a) The district is |
---|
115 | 123 | | governed by a board of five directors who serve staggered terms of |
---|
116 | 124 | | four years. |
---|
117 | 125 | | (b) Four directors must be elected in the manner provided by |
---|
118 | 126 | | Subchapter D, Chapter 49, Water Code. |
---|
119 | 127 | | (c) One director must be appointed by the governing body of |
---|
120 | 128 | | the city from a list of persons recommended by the preceding board. |
---|
121 | 129 | | Sec. 3986.0202. COMPENSATION; EXPENSES. (a) The district |
---|
122 | 130 | | may compensate each elected director in an amount not to exceed $150 |
---|
123 | 131 | | for each board meeting. The total amount of compensation for each |
---|
124 | 132 | | director in one year may not exceed $7,200. |
---|
125 | 133 | | (b) An appointed director is not entitled to compensation |
---|
126 | 134 | | for service on the board. |
---|
127 | 135 | | (c) An elected or appointed director is entitled to |
---|
128 | 136 | | reimbursement for necessary and reasonable expenses incurred in |
---|
129 | 137 | | carrying out the duties and responsibilities of the board. |
---|
130 | 138 | | Sec. 3986.0203. INITIAL DIRECTORS. (a) The initial board |
---|
131 | 139 | | consists of the following directors: |
---|

---|
151 | 159 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
152 | 160 | | Sec. 3986.0301. GENERAL POWERS AND DUTIES. The district |
---|
153 | 161 | | has the powers and duties necessary to accomplish the purposes for |
---|
154 | 162 | | which the district is created. |
---|
155 | 163 | | Sec. 3986.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The |
---|
156 | 164 | | district, using any money available to the district for the |
---|
157 | 165 | | purpose, may provide, design, construct, acquire, improve, |
---|
158 | 166 | | relocate, operate, maintain, or finance an improvement project or |
---|
159 | 167 | | service authorized under this chapter or Chapter 375, Local |
---|
160 | 168 | | Government Code. |
---|
161 | 169 | | (b) The district may contract with a governmental or private |
---|
162 | 170 | | entity to carry out an action under Subsection (a). |
---|
163 | 171 | | (c) The implementation of a district project or service is a |
---|
164 | 172 | | governmental function or service for the purposes of Chapter 791, |
---|
165 | 173 | | Government Code. |
---|
166 | 174 | | Sec. 3986.0303. NONPROFIT CORPORATION. (a) The board by |
---|
167 | 175 | | resolution may authorize the creation of a nonprofit corporation to |
---|
168 | 176 | | assist and act for the district in implementing a project or |
---|
169 | 177 | | providing a service authorized by this chapter. |
---|
170 | 178 | | (b) The nonprofit corporation: |
---|
171 | 179 | | (1) has each power of and is considered to be a local |
---|
172 | 180 | | government corporation created under Subchapter D, Chapter 431, |
---|
173 | 181 | | Transportation Code; and |
---|
174 | 182 | | (2) may implement any project and provide any service |
---|
175 | 183 | | authorized by this chapter. |
---|
176 | 184 | | (c) The board shall appoint the board of directors of the |
---|
177 | 185 | | nonprofit corporation. The board of directors of the nonprofit |
---|
178 | 186 | | corporation shall serve in the same manner as the board of directors |
---|
179 | 187 | | of a local government corporation created under Subchapter D, |
---|
180 | 188 | | Chapter 431, Transportation Code, except that a board member is not |
---|
181 | 189 | | required to reside in the district. |
---|
182 | 190 | | Sec. 3986.0304. LAW ENFORCEMENT SERVICES. To protect the |
---|
183 | 191 | | public interest, the district may contract with a qualified party, |
---|
184 | 192 | | including the city, to provide law enforcement services in the |
---|
185 | 193 | | district for a fee. |
---|
186 | 194 | | Sec. 3986.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. |
---|
187 | 195 | | The district may join and pay dues to a charitable or nonprofit |
---|
188 | 196 | | organization that performs a service or provides an activity |
---|
189 | 197 | | consistent with the furtherance of a district purpose. |
---|
190 | 198 | | Sec. 3986.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The |
---|
191 | 199 | | district may engage in activities that accomplish the economic |
---|
192 | 200 | | development purposes of the district. |
---|
193 | 201 | | (b) The district may establish and provide for the |
---|
194 | 202 | | administration of one or more programs to promote state or local |
---|
195 | 203 | | economic development and to stimulate business and commercial |
---|
196 | 204 | | activity in the district, including programs to: |
---|
197 | 205 | | (1) make loans and grants of public money; and |
---|
198 | 206 | | (2) provide district personnel and services. |
---|
199 | 207 | | (c) The district may create economic development programs |
---|
200 | 208 | | and exercise the economic development powers provided to |
---|
201 | 209 | | municipalities by: |
---|
202 | 210 | | (1) Chapter 380, Local Government Code; and |
---|
203 | 211 | | (2) Subchapter A, Chapter 1509, Government Code. |
---|
204 | 212 | | Sec. 3986.0307. PARKING FACILITIES. (a) The district may |
---|
205 | 213 | | acquire, lease as lessor or lessee, construct, develop, own, |
---|
206 | 214 | | operate, and maintain parking facilities or a system of parking |
---|
207 | 215 | | facilities, including lots, garages, parking terminals, or other |
---|
208 | 216 | | structures or accommodations for parking motor vehicles off the |
---|
209 | 217 | | streets and related appurtenances. |
---|
210 | 218 | | (b) The district's parking facilities serve the public |
---|
211 | 219 | | purposes of the district and are owned, used, and held for a public |
---|
212 | 220 | | purpose even if leased or operated by a private entity for a term of |
---|
213 | 221 | | years. |
---|
214 | 222 | | (c) The district's parking facilities are parts of and |
---|
215 | 223 | | necessary components of a street and are considered to be a street |
---|
216 | 224 | | or road improvement. |
---|
217 | 225 | | (d) The development and operation of the district's parking |
---|
218 | 226 | | facilities may be considered an economic development program. |
---|
219 | 227 | | Sec. 3986.0308. ADDING OR EXCLUDING LAND. If the governing |
---|
220 | 228 | | body of the city approves an addition or exclusion of land by |
---|
221 | 229 | | affirmative vote, the district may add or exclude the land in the |
---|
222 | 230 | | manner provided by Subchapter J, Chapter 49, Water Code, or by |
---|
223 | 231 | | Subchapter H, Chapter 54, Water Code. The district may add land |
---|
224 | 232 | | only if the land is located in the city's corporate limits. |
---|
225 | 233 | | Sec. 3986.0309. DISBURSEMENTS AND TRANSFERS OF MONEY. The |
---|
226 | 234 | | board by resolution shall establish the number of directors' |
---|
227 | 235 | | signatures and the procedure required for a disbursement or |
---|
228 | 236 | | transfer of district money. |
---|
229 | 237 | | Sec. 3986.0310. DIVISION OF DISTRICT. (a) The district may |
---|
230 | 238 | | be divided into two or more new districts only if: |
---|
231 | 239 | | (1) the district has no outstanding bonded debt; |
---|
232 | 240 | | (2) the district is not imposing ad valorem taxes; and |
---|
233 | 241 | | (3) not more than four new districts are created by the |
---|
234 | 242 | | division. |
---|
235 | 243 | | (b) This chapter applies to any new district created by the |
---|
236 | 244 | | division of the district, and a new district has all the powers and |
---|
237 | 245 | | duties of the district. |
---|
238 | 246 | | (c) Any new district created by the division of the district |
---|
239 | 247 | | may not, at the time the new district is created, contain any land |
---|
240 | 248 | | outside the area described by Section 2 of the Act enacting this |
---|
241 | 249 | | chapter. |
---|
242 | 250 | | (d) The board, on its own motion or on receipt of a petition |
---|
243 | 251 | | signed by the owner or owners of a majority of the assessed value of |
---|
244 | 252 | | the real property in the district, may adopt an order dividing the |
---|
245 | 253 | | district. |
---|
246 | 254 | | (e) An order dividing the district must: |
---|
247 | 255 | | (1) name each new district; |
---|
248 | 256 | | (2) include the metes and bounds description of the |
---|
249 | 257 | | territory of each new district; |
---|
250 | 258 | | (3) appoint initial directors for each new district; |
---|
251 | 259 | | and |
---|
252 | 260 | | (4) provide for the division of assets and liabilities |
---|
253 | 261 | | between or among the new districts. |
---|
254 | 262 | | (f) On or before the 30th day after the date of adoption of |
---|
255 | 263 | | an order dividing the district, the district shall file the order |
---|
256 | 264 | | with the commission and record the order in the real property |
---|
257 | 265 | | records of each county in which the district is located. |
---|
258 | 266 | | (g) Municipal consent to the creation of the district and to |
---|
259 | 267 | | the inclusion of land in the district acts as municipal consent to |
---|
260 | 268 | | the creation of any new district created by the division of the |
---|
261 | 269 | | district and to the inclusion of land in the new district. |
---|
262 | 270 | | (h) A new district created by the division of the district |
---|
263 | 271 | | must hold an election as required by Section 3986.0501 to obtain |
---|
264 | 272 | | voter approval before the district may impose a maintenance tax or |
---|
265 | 273 | | issue bonds payable wholly or partly from ad valorem taxes. |
---|

674 | 677 | | SECTION 4. This Act takes effect immediately if it receives |

675 | 678 | | a vote of two-thirds of all the members elected to each house, as |

676 | 679 | | provided by Section 39, Article III, Texas Constitution. If this |

677 | 680 | | Act does not receive the vote necessary for immediate effect, this |
