412 relating to the creation of the North Celina Municipal Management
513 District No. 3; providing authority to issue bonds; providing
614 authority to impose assessments, fees, and taxes.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. Subtitle C, Title 4, Special District Local Laws
917 Code, is amended by adding Chapter 3986 to read as follows:
1018 CHAPTER 3986. NORTH CELINA MUNICIPAL MANAGEMENT DISTRICT NO. 3
1119 SUBCHAPTER A. GENERAL PROVISIONS
1220 Sec. 3986.0101. DEFINITIONS. In this chapter:
1321 (1) "Board" means the district's board of directors.
1422 (2) "City" means the City of Celina.
1523 (3) "Director" means a board member.
1624 (4) "District" means the North Celina Municipal
1725 Management District No. 3.
1826 Sec. 3986.0102. NATURE OF DISTRICT. The North Celina
1927 Municipal Management District No. 3 is a special district created
2028 under Section 59, Article XVI, Texas Constitution.
2129 Sec. 3986.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2230 creation of the district is essential to accomplish the purposes of
2331 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2432 Texas Constitution, and other public purposes stated in this
2533 chapter.
2634 (b) By creating the district and in authorizing the city and
2735 other political subdivisions to contract with the district, the
2836 legislature has established a program to accomplish the public
2937 purposes set out in Section 52-a, Article III, Texas Constitution.
3038 (c) The creation of the district is necessary to promote,
3139 develop, encourage, and maintain employment, commerce,
3240 transportation, housing, tourism, recreation, the arts,
3341 entertainment, economic development, safety, and the public
3442 welfare in the district.
3543 (d) This chapter and the creation of the district may not be
3644 interpreted to relieve the city from providing the level of
3745 services provided as of the effective date of the Act enacting this
3846 chapter to the area in the district. The district is created to
3947 supplement and not to supplant city services provided in the
4048 district.
4149 Sec. 3986.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4250 (a) All land and other property included in the district will
4351 benefit from the improvements and services to be provided by the
4452 district under powers conferred by Sections 52 and 52-a, Article
4553 III, and Section 59, Article XVI, Texas Constitution, and other
4654 powers granted under this chapter.
4755 (b) The district is created to serve a public use and
4856 benefit.
4957 (c) The creation of the district is in the public interest
5058 and is essential to further the public purposes of:
5159 (1) developing and diversifying the economy of the
5260 state;
5361 (2) eliminating unemployment and underemployment; and
5462 (3) developing or expanding transportation and
5563 commerce.
5664 (d) The district will:
5765 (1) promote the health, safety, and general welfare of
5866 residents, employers, potential employees, employees, visitors,
5967 and consumers in the district, and of the public;
6068 (2) provide needed funding for the district to
6169 preserve, maintain, and enhance the economic health and vitality of
6270 the district territory as a community and business center;
6371 (3) promote the health, safety, welfare, and enjoyment
6472 of the public by providing pedestrian ways and by landscaping and
6573 developing certain areas in the district, which are necessary for
6674 the restoration, preservation, and enhancement of scenic beauty;
6775 and
6876 (4) provide for the construction of water, wastewater,
6977 drainage, road, and recreational facilities for the district.
7078 (e) Pedestrian ways along or across a street, whether at
7179 grade or above or below the surface, and street lighting, street
7280 landscaping, parking, and street art objects are parts of and
7381 necessary components of a street and are considered to be a street
7482 or road improvement.
7583 (f) The district will not act as the agent or
7684 instrumentality of any private interest even though the district
7785 will benefit many private interests as well as the public.
7886 Sec. 3986.0105. INITIAL DISTRICT TERRITORY. (a) The
7987 district is initially composed of the territory described by
8088 Section 2 of the Act enacting this chapter.
8189 (b) The boundaries and field notes contained in Section 2 of
8290 the Act enacting this chapter form a closure. A mistake in the
8391 field notes or in copying the field notes in the legislative process
8492 does not affect the district's:
8593 (1) organization, existence, or validity;
8694 (2) right to issue any type of bonds for the purposes
8795 for which the district is created or to pay the principal of and
8896 interest on the bonds;
8997 (3) right to impose or collect an assessment or tax; or
9098 (4) legality or operation.
9199 Sec. 3986.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
92100 All or any part of the area of the district is eligible to be
93101 included in:
94102 (1) a tax increment reinvestment zone created under
95103 Chapter 311, Tax Code; or
96104 (2) a tax abatement reinvestment zone created under
97105 Chapter 312, Tax Code.
98106 Sec. 3986.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
99107 DISTRICTS LAW. Except as otherwise provided by this chapter,
100108 Chapter 375, Local Government Code, applies to the district.
101109 Sec. 3986.0108. CONSTRUCTION OF CHAPTER. This chapter
102110 shall be liberally construed in conformity with the findings and
103111 purposes stated in this chapter.
104112 Sec. 3986.0109. COMPLIANCE WITH AND ENFORCEABILITY OF
105113 MUNICIPAL CONSENT AGREEMENT, ORDINANCE, OR RESOLUTION. (a) The
106114 district shall comply with all applicable requirements of any
107115 ordinance or resolution that consents to the creation of the
108116 district or to the inclusion of land in the district.
109117 (b) Any agreement between the district and a municipality
110118 related to the municipality's consent to the creation of the
111119 district, including a development agreement, is valid and
112120 enforceable.
113121 SUBCHAPTER B. BOARD OF DIRECTORS
114122 Sec. 3986.0201. GOVERNING BODY; TERMS. (a) The district is
115123 governed by a board of five directors who serve staggered terms of
116124 four years.
117125 (b) Four directors must be elected in the manner provided by
118126 Subchapter D, Chapter 49, Water Code.
119127 (c) One director must be appointed by the governing body of
120128 the city from a list of persons recommended by the preceding board.
121129 Sec. 3986.0202. COMPENSATION; EXPENSES. (a) The district
122130 may compensate each elected director in an amount not to exceed $150
123131 for each board meeting. The total amount of compensation for each
124132 director in one year may not exceed $7,200.
125133 (b) An appointed director is not entitled to compensation
126134 for service on the board.
127135 (c) An elected or appointed director is entitled to
128136 reimbursement for necessary and reasonable expenses incurred in
129137 carrying out the duties and responsibilities of the board.
130138 Sec. 3986.0203. INITIAL DIRECTORS. (a) The initial board
131139 consists of the following directors:

144152 (b) Of the initial directors, the terms of directors
145153 appointed for positions one through three expire June 1, 2021, and
146154 the terms of directors appointed for positions four and five expire
147155 June 1, 2023. The initial directors in positions one through four
148156 are replaced by directors elected under Section 3986.0201(b), and
149157 the initial director in position five is replaced by a director
150158 appointed under Section 3986.0201(c).
151159 SUBCHAPTER C. POWERS AND DUTIES
152160 Sec. 3986.0301. GENERAL POWERS AND DUTIES. The district
153161 has the powers and duties necessary to accomplish the purposes for
154162 which the district is created.
155163 Sec. 3986.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
156164 district, using any money available to the district for the
157165 purpose, may provide, design, construct, acquire, improve,
158166 relocate, operate, maintain, or finance an improvement project or
159167 service authorized under this chapter or Chapter 375, Local
160168 Government Code.
161169 (b) The district may contract with a governmental or private
162170 entity to carry out an action under Subsection (a).
163171 (c) The implementation of a district project or service is a
164172 governmental function or service for the purposes of Chapter 791,
165173 Government Code.
166174 Sec. 3986.0303. NONPROFIT CORPORATION. (a) The board by
167175 resolution may authorize the creation of a nonprofit corporation to
168176 assist and act for the district in implementing a project or
169177 providing a service authorized by this chapter.
170178 (b) The nonprofit corporation:
171179 (1) has each power of and is considered to be a local
172180 government corporation created under Subchapter D, Chapter 431,
173181 Transportation Code; and
174182 (2) may implement any project and provide any service
175183 authorized by this chapter.
176184 (c) The board shall appoint the board of directors of the
177185 nonprofit corporation. The board of directors of the nonprofit
178186 corporation shall serve in the same manner as the board of directors
179187 of a local government corporation created under Subchapter D,
180188 Chapter 431, Transportation Code, except that a board member is not
181189 required to reside in the district.
182190 Sec. 3986.0304. LAW ENFORCEMENT SERVICES. To protect the
183191 public interest, the district may contract with a qualified party,
184192 including the city, to provide law enforcement services in the
185193 district for a fee.
186194 Sec. 3986.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
187195 The district may join and pay dues to a charitable or nonprofit
188196 organization that performs a service or provides an activity
189197 consistent with the furtherance of a district purpose.
190198 Sec. 3986.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
191199 district may engage in activities that accomplish the economic
192200 development purposes of the district.
193201 (b) The district may establish and provide for the
194202 administration of one or more programs to promote state or local
195203 economic development and to stimulate business and commercial
196204 activity in the district, including programs to:
197205 (1) make loans and grants of public money; and
198206 (2) provide district personnel and services.
199207 (c) The district may create economic development programs
200208 and exercise the economic development powers provided to
201209 municipalities by:
202210 (1) Chapter 380, Local Government Code; and
203211 (2) Subchapter A, Chapter 1509, Government Code.
204212 Sec. 3986.0307. PARKING FACILITIES. (a) The district may
205213 acquire, lease as lessor or lessee, construct, develop, own,
206214 operate, and maintain parking facilities or a system of parking
207215 facilities, including lots, garages, parking terminals, or other
208216 structures or accommodations for parking motor vehicles off the
209217 streets and related appurtenances.
210218 (b) The district's parking facilities serve the public
211219 purposes of the district and are owned, used, and held for a public
212220 purpose even if leased or operated by a private entity for a term of
213221 years.
214222 (c) The district's parking facilities are parts of and
215223 necessary components of a street and are considered to be a street
216224 or road improvement.
217225 (d) The development and operation of the district's parking
218226 facilities may be considered an economic development program.
219227 Sec. 3986.0308. ADDING OR EXCLUDING LAND. If the governing
220228 body of the city approves an addition or exclusion of land by
221229 affirmative vote, the district may add or exclude the land in the
222230 manner provided by Subchapter J, Chapter 49, Water Code, or by
223231 Subchapter H, Chapter 54, Water Code. The district may add land
224232 only if the land is located in the city's corporate limits.
225233 Sec. 3986.0309. DISBURSEMENTS AND TRANSFERS OF MONEY. The
226234 board by resolution shall establish the number of directors'
227235 signatures and the procedure required for a disbursement or
228236 transfer of district money.
229237 Sec. 3986.0310. DIVISION OF DISTRICT. (a) The district may
230238 be divided into two or more new districts only if:
231239 (1) the district has no outstanding bonded debt;
232240 (2) the district is not imposing ad valorem taxes; and
233241 (3) not more than four new districts are created by the
234242 division.
235243 (b) This chapter applies to any new district created by the
236244 division of the district, and a new district has all the powers and
237245 duties of the district.
238246 (c) Any new district created by the division of the district
239247 may not, at the time the new district is created, contain any land
240248 outside the area described by Section 2 of the Act enacting this
241249 chapter.
242250 (d) The board, on its own motion or on receipt of a petition
243251 signed by the owner or owners of a majority of the assessed value of
244252 the real property in the district, may adopt an order dividing the
245253 district.
246254 (e) An order dividing the district must:
247255 (1) name each new district;
248256 (2) include the metes and bounds description of the
249257 territory of each new district;
250258 (3) appoint initial directors for each new district;
251259 and
252260 (4) provide for the division of assets and liabilities
253261 between or among the new districts.
254262 (f) On or before the 30th day after the date of adoption of
255263 an order dividing the district, the district shall file the order
256264 with the commission and record the order in the real property
257265 records of each county in which the district is located.
258266 (g) Municipal consent to the creation of the district and to
259267 the inclusion of land in the district acts as municipal consent to
260268 the creation of any new district created by the division of the
261269 district and to the inclusion of land in the new district.
262270 (h) A new district created by the division of the district
263271 must hold an election as required by Section 3986.0501 to obtain
264272 voter approval before the district may impose a maintenance tax or
265273 issue bonds payable wholly or partly from ad valorem taxes.
266- Sec. 3986.0311. RESIDENTIAL PROPERTY NOT EXEMPT FROM
267- CERTAIN REQUIREMENTS. Sections 375.161 and 375.164, Local
268- Government Code, do not apply to the district.
269- Sec. 3986.0312. NO EMINENT DOMAIN POWER. The district may

270275 not exercise the power of eminent domain.
271276 SUBCHAPTER D. ASSESSMENTS
272277 Sec. 3986.0401. PETITION REQUIRED FOR FINANCING SERVICES
273278 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
274279 service or improvement project with assessments under this chapter
275280 unless a written petition requesting that service or improvement
276281 has been filed with the board.
277282 (b) A petition filed under Subsection (a) must be signed by
278283 the owners of a majority of the assessed value of real property in
279284 the district subject to assessment according to the most recent
280285 certified tax appraisal roll for the county.
281286 Sec. 3986.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
282- Except as provided by Section 3986.0504(b), the board by resolution
287+ Except as provided by Section 3986.0503(c), the board by resolution
283288 may impose and collect an assessment for any purpose authorized by
284289 this chapter in all or any part of the district.
285290 (b) An assessment, a reassessment, or an assessment
286291 resulting from an addition to or correction of the assessment roll
287292 by the district, penalties and interest on an assessment or
288293 reassessment, an expense of collection, and reasonable attorney's
289294 fees incurred by the district:
290295 (1) are a first and prior lien against the property
291296 assessed;
292297 (2) are superior to any other lien or claim other than
293298 a lien or claim for county, school district, or municipal ad valorem
294299 taxes; and
295300 (3) are the personal liability of and a charge against
296301 the owners of the property even if the owners are not named in the
297302 assessment proceedings.
298303 (c) The lien is effective from the date of the board's
299304 resolution imposing the assessment until the date the assessment is
300305 paid. The board may enforce the lien in the same manner that the
301306 board may enforce an ad valorem tax lien against real property.
302307 (d) The board may make a correction to or deletion from the
303308 assessment roll that does not increase the amount of assessment of
304309 any parcel of land without providing notice and holding a hearing in
305310 the manner required for additional assessments.
306311 SUBCHAPTER E. TAXES AND BONDS
307312 Sec. 3986.0501. TAX ELECTION REQUIRED. The district must
308313 hold an election in the manner provided by Chapter 49, Water Code,
309314 or, if applicable, Chapter 375, Local Government Code, to obtain
310315 voter approval before the district may impose an ad valorem tax.
311- Sec. 3986.0502. TAX LIMITATION. An ad valorem tax imposed
312- by the district may be used only for a purpose authorized under:
313- (1) Chapter 49 or 54, Water Code;
314- (2) Section 52, Article III, Texas Constitution; or
315- (3) Section 59, Article XVI, Texas Constitution.
316- Sec. 3986.0503. OPERATION AND MAINTENANCE TAX. (a) If

325329 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
326330 terms determined by the board.
327331 (b) The district may issue bonds, notes, or other
328- obligations payable wholly or partly from:
329- (1) impact fees, revenue, contract payments, grants,
330- or other district money, or any combination of those sources of
331- money, to pay for any authorized district purpose;
332- (2) ad valorem taxes for a purpose authorized under
333- Section 3986.0502; and
334- (3) assessments only to finance a major public
335- infrastructure improvement project that serves a majority of the
336- district.
337- (c) The district may issue, by public or private sale,
332+ obligations payable wholly or partly from ad valorem taxes, impact
333+ fees, revenue, contract payments, grants, or other district money,
334+ or any combination of those sources of money, to pay for any
335+ authorized district purpose.
336+ (c) The district may issue bonds, notes, or other
337+ obligations payable wholly or partly from assessments only to
338+ finance a major public infrastructure improvement project that
339+ serves a majority of the district.
340+ (d) The district may issue, by public or private sale,
338341 bonds, notes, or other obligations payable wholly or partly from
339342 assessments in the manner provided by Subchapter A, Chapter 372,
340343 Local Government Code, if the improvement financed by an obligation
341344 issued under this section will be conveyed to or operated and
342345 maintained by a municipality or other retail utility provider
343346 pursuant to an agreement with the district entered into before the
344347 issuance of the obligation.
345- Sec. 3986.0505. BONDS SECURED BY REVENUE OR CONTRACT
348+ Sec. 3986.0504. BONDS SECURED BY REVENUE OR CONTRACT
346349 PAYMENTS. The district may issue, without an election, bonds
347350 secured by:
348351 (1) revenue other than ad valorem taxes, including
349352 contract revenues; or
350353 (2) contract payments, provided that the requirements
351354 of Section 49.108, Water Code, have been met.
352- Sec. 3986.0506. BONDS SECURED BY AD VALOREM TAXES;

353356 ELECTIONS. (a) If authorized at an election under Section
354357 3986.0501, the district may issue bonds payable from ad valorem
355358 taxes.
356359 (b) At the time the district issues bonds payable wholly or
357360 partly from ad valorem taxes, the board shall provide for the annual
358361 imposition of a continuing direct annual ad valorem tax, without
359362 limit as to rate or amount, for each year that all or part of the
360363 bonds are outstanding as required and in the manner provided by
361364 Sections 54.601 and 54.602, Water Code.
362365 (c) All or any part of any facilities or improvements that
363366 may be acquired by a district by the issuance of its bonds may be
364367 submitted as a single proposition or as several propositions to be
365368 voted on at the election.
366- Sec. 3986.0507. CONSENT OF MUNICIPALITY REQUIRED. (a) The

367370 board may not issue bonds until each municipality in whose
368371 corporate limits or extraterritorial jurisdiction the district is
369372 located has consented by ordinance or resolution to the creation of

371374 (b) This section applies only to the district's first
372375 issuance of bonds payable from ad valorem taxes.
373376 SUBCHAPTER I. DISSOLUTION
374377 Sec. 3986.0901. DISSOLUTION. (a) Except as limited by
375378 Subsection (b), the board shall dissolve the district on written
376379 petition filed with the board by the owners of:
377380 (1) 66 percent or more of the assessed value of the
378381 property subject to assessment by the district based on the most
379382 recent certified county property tax rolls; or
380383 (2) 66 percent or more of the surface area of the
381384 district, excluding roads, streets, highways, utility
382385 rights-of-way, other public areas, and other property exempt from
383386 assessment by the district according to the most recent certified
384387 county property tax rolls.
385388 (b) The district may not be dissolved if the district:
386389 (1) has any outstanding bonded or other indebtedness
387390 until that bonded or other indebtedness has been repaid or defeased
388391 in accordance with the order or resolution authorizing the issuance
389392 of the bonded or other indebtedness;
390393 (2) has a contractual obligation to pay money until:
391394 (A) that obligation has been fully paid in
392395 accordance with the contract; or
393396 (B) another political subdivision assumes the
394397 obligation; or
395398 (3) owns, operates, or maintains public works,
396399 facilities, or improvements unless, before the district dissolves,
397400 the district contracts with another party for the ownership and
398401 operation or maintenance of the public works, facilities, or
399402 improvements.
400- (c) Section 375.262, Local Government Code, does not apply
