410 AN ACT
511 relating to the powers and duties of the Fort Bend County Levee
612 Improvement District No. 7.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 7808.001(3), Special District Local Laws
915 Code, is amended to read as follows:
1016 (3) "Reuse project [Project]" means a facility,
1117 improvement, appliance, appurtenance, land, interest in property,
1218 participation right, contract right, practice, technique, or
1319 technology that:
1420 (A) facilitates the recycling and reuse of water,
1521 wastewater effluent, or other water or wastewater by-product; and
1622 (B) results in additional water supplies for
1723 future or alternative uses.
1824 SECTION 2. Subchapter B, Chapter 7808, Special District
1925 Local Laws Code, is amended to read as follows:
2026 SUBCHAPTER B. REUSE PROJECT POWERS AND DUTIES
2127 Sec. 7808.151. ACQUISITION OF REUSE PROJECT. The district
2228 may acquire a reuse project, including by purchase or lease.
2329 Sec. 7808.152. CONSTRUCTION, MAINTENANCE, AND OPERATION OF
2430 REUSE PROJECT. The district may construct, rehabilitate, repair,
2531 improve, enlarge, operate, and maintain a reuse project.
2632 [Sec. 7808.153. DELIVERY METHOD. The district may use
2733 alternative delivery methods under Chapter 2267, Government Code,
2834 as added by Chapter 1129 (H.B. 628), Acts of the 82nd Legislature,
2935 Regular Session, 2011, for a project, in addition to any method
3036 provided by Chapters 49 and 57, Water Code.]
3137 Sec. 7808.154. CONVEYANCE OF REUSE PROJECT. If the board
3238 considers the terms appropriate and favorable to the district, the
3339 district may convey a reuse project to a:
3440 (1) municipality in whose extraterritorial
3541 jurisdiction all or part of the district is located; or
3642 (2) political subdivision located wholly or partly in
3743 the district.
3844 Sec. 7808.155. USE OF REUSE PROJECT WATER. If the board
3945 considers the terms appropriate and favorable to the district, the
4046 district may:
4147 (1) use the water from a reuse project; or
4248 (2) sell or otherwise provide the water to:
4349 (A) a homeowners' or property owners' association
4450 located in the district; or
4551 (B) with the prior consent of a municipality
4652 described by Section 7808.154(1), any person located in the
4753 extraterritorial jurisdiction of that municipality, including a
4854 political subdivision, private entity, and individual.
4955 Sec. 7808.156. REUSE PROJECT FINANCING. The district may
5056 finance a reuse project with property taxes, mandatory fees, or
5157 voluntary contributions.
5258 Sec. 7808.157. REUSE PROJECT BONDS. The district may issue
5359 bonds or other obligations for a reuse project in the manner
5460 provided by Subchapter G, Chapter 57, Water Code.
5561 Sec. 7808.158. JOINT REUSE PROJECT. The district may act
5662 jointly in regard to a reuse project under an agreement or contract
5763 with any person, including a political subdivision, private entity,
5864 or individual.
5965 Sec. 7808.159. MUNICIPAL APPROVAL. (a) The plans and
6066 specifications for the construction or modification of a reuse
6167 project are subject to:
6268 (1) the review and approval of any municipality in
6369 whose extraterritorial jurisdiction all or part of the district is
6470 located; and
6571 (2) any ordinance, regulation, or standard criteria a
6672 municipality described by Subdivision (1) may adopt relating to the
6773 construction or operation of similar reuse projects in its
6874 corporate limits or extraterritorial jurisdiction.
6975 (b) The approval required by Subsection (a) must be in the
7076 form of an ordinance or resolution adopted by the governing body of
7177 the municipality. Approval for subsequent modifications,
7278 extensions, or repairs of a reuse project may be given in the manner
7379 the municipality customarily uses for other water supply
7480 improvements in its corporate limits or extraterritorial
7581 jurisdiction.
7682 SECTION 3. Chapter 7808, Special District Local Laws Code,
7783 is amended by adding Subchapter C to read as follows:
7884 SUBCHAPTER C. CONTRACTS
7985 Sec. 7808.201. DELIVERY METHOD. Notwithstanding the
8086 limitations provided by Sections 2269.003 and 2269.352, Government
8187 Code, for the design and construction of erosion control facilities
8288 located in or adjacent to the Brazos River and any related facility
8389 or improvement, the district may use a delivery method described
8490 by:
8591 (1) Chapter 2269, Government Code; or
8692 (2) Subchapter I, Chapter 49, Water Code.
8793 SECTION 4. This Act takes effect immediately if it receives
8894 a vote of two-thirds of all the members elected to each house, as
8995 provided by Section 39, Article III, Texas Constitution. If this
9096 Act does not receive the vote necessary for immediate effect, this
9197 Act takes effect September 1, 2019.
