55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the Department of Family and Protective Services
88 reporting certain information regarding youth in the managing
99 conservatorship of the department who are pregnant or who are
1010 parents.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 264.017(b), Family Code, is amended to
1313 read as follows:
1414 (b) The department shall provide the report required by
1515 Subsection (a) to the legislature and shall publish the report and
1616 make the report available electronically to the public not later
1717 than February 1 of each year. The report must include, with respect
1818 to the preceding year:
1919 (1) information on the number and disposition of
2020 reports of child abuse and neglect received by the department;
2121 (2) information on the number of clients for whom the
2222 department took protective action, including investigations,
2323 alternative responses, and court-ordered removals;
2424 (3) information on the number of clients for whom the
2525 department provided services in each program administered by the
2626 child protective services division, including investigations,
2727 alternative responses, family-based safety services,
2828 conservatorship, post-adoption services, and transitional living
2929 services;
3030 (4) the number of children in this state who died as a
3131 result of child abuse or neglect;
3232 (5) the number of children described by Subdivision
3333 (4) for whom the department was the children's managing conservator
3434 at the time of death;
3535 (6) information on the timeliness of the department's
3636 initial contact in an investigation or alternative response;
3737 (7) information on the response time by the department
3838 in commencing services to families and children for whom an
3939 allegation of child abuse or neglect has been made;
4040 (8) information regarding child protection staffing
4141 and caseloads by program area;
4242 (9) information on the permanency goals in place and
4343 achieved for children in the managing conservatorship of the
4444 department, including information on the timeliness of achieving
4545 the goals, the stability of the children's placement in foster
4646 care, and the proximity of placements to the children's home
4747 counties;
4848 (10) the number of children who suffer from a severe
4949 emotional disturbance and for whom the department is appointed
5050 managing conservator, including statistics on appointments as
5151 joint managing conservator, due to an individual voluntarily
5252 relinquishing custody of a child solely to obtain mental health
5353 services for the child;
5454 (11) the following information regarding [number of]
5555 children who are pregnant or who are parents [a parent] while in the
5656 managing conservatorship of the department:
5757 (A) the number of pregnant female children in the
5858 managing conservatorship of the department who are at least 13
5959 years of age but younger than 18 years of age compared to the total
6060 number of female children in the managing conservatorship of the
6161 department who are at least 13 years of age but younger than 18
6262 years of age;
6363 (B) the number of female children in the managing
6464 conservatorship of the department who are at least 13 years of age
6565 but younger than 18 years of age and who have given birth to a child
6666 compared to the total number of female children in the managing
6767 conservatorship of the department who are at least 13 years of age
6868 but younger than 18 years of age;
6969 (C) the number of pregnant female youth in the
7070 managing conservatorship of the department who are younger than 22
7171 years of age and the following information for each youth:
7272 (i) the youth's age;
7373 (ii) the youth's race and ethnicity;
7474 (iii) the youth's county of residence;
7575 (iv) the time the youth has been in
7676 substitute care; and
7777 (v) the type of substitute care in which the
7878 youth is placed;
7979 (D) the number of youth in the managing
8080 conservatorship of the department who are younger than 22 years of
8181 age and who are parents and the following information for each
8282 youth:
8383 (i) the youth's gender;
8484 (ii) the youth's age;
8585 (iii) the youth's race and ethnicity;
8686 (iv) the youth's county of residence;
8787 (v) the time the youth has been in
8888 substitute care; and
8989 (vi) the type of substitute care in which
9090 the youth is placed;
9191 (E) the number of youth in the managing
9292 conservatorship of the department who are parents of a child who is
9393 also in the managing conservatorship of the department and the
9494 following information for each youth:
9595 (i) the type of substitute care in which the
9696 youth is placed; and
9797 (ii) whether the youth and the child are
9898 placed together;
9999 (F) for youth described by Paragraphs (C) and (D)
100100 who exit the department's conservatorship, the following
101101 information for each youth:
102102 (i) whether the youth is adopted, reunited
103103 with the youth's family, or emancipated;
104104 (ii) the youth's age on the date the youth
105105 exited the department's conservatorship; and
106106 (iii) the time the youth spent in
107107 substitute care;
108108 (G) the number of children in the managing
109109 conservatorship of the department who are at least 11 years of age
110110 but younger than 18 years of age and who are pregnant or who are
111111 parents at the time the child enters the conservatorship of the
112112 department; and
113113 (H) the number of children in the managing
114114 conservatorship of the department who are at least 11 years of age
115115 but younger than 18 years of age and who become pregnant or who
116116 become parents while in the conservatorship of the department [and
117117 the number of the children born to a parent in the managing
118118 conservatorship of the department who are placed in the managing
119119 conservatorship of the department];
120120 (12) the number of children who are missing from the
121121 children's substitute care provider while in the managing
122122 conservatorship of the department; and
123123 (13) the number of children who were victims of
124124 trafficking under Chapter 20A, Penal Code, while in the managing
125125 conservatorship of the department.
126126 SECTION 2. This Act takes effect September 1, 2019.
