7 | 7 | | relating to the Department of Family and Protective Services |

8 | 8 | | reporting certain information regarding youth in the managing |
---|
9 | 9 | | conservatorship of the department who are pregnant or who are |
---|
10 | 10 | | parents. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. Section 264.017(b), Family Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (b) The department shall provide the report required by |
---|
15 | 15 | | Subsection (a) to the legislature and shall publish the report and |
---|
16 | 16 | | make the report available electronically to the public not later |
---|
17 | 17 | | than February 1 of each year. The report must include, with respect |
---|
18 | 18 | | to the preceding year: |
---|
19 | 19 | | (1) information on the number and disposition of |
---|
20 | 20 | | reports of child abuse and neglect received by the department; |
---|
21 | 21 | | (2) information on the number of clients for whom the |
---|
22 | 22 | | department took protective action, including investigations, |
---|
23 | 23 | | alternative responses, and court-ordered removals; |
---|
24 | 24 | | (3) information on the number of clients for whom the |
---|
25 | 25 | | department provided services in each program administered by the |
---|
26 | 26 | | child protective services division, including investigations, |
---|
27 | 27 | | alternative responses, family-based safety services, |
---|
28 | 28 | | conservatorship, post-adoption services, and transitional living |
---|
29 | 29 | | services; |
---|
30 | 30 | | (4) the number of children in this state who died as a |
---|
31 | 31 | | result of child abuse or neglect; |
---|
32 | 32 | | (5) the number of children described by Subdivision |
---|
33 | 33 | | (4) for whom the department was the children's managing conservator |
---|
34 | 34 | | at the time of death; |
---|
35 | 35 | | (6) information on the timeliness of the department's |
---|
36 | 36 | | initial contact in an investigation or alternative response; |
---|
37 | 37 | | (7) information on the response time by the department |
---|
38 | 38 | | in commencing services to families and children for whom an |
---|
39 | 39 | | allegation of child abuse or neglect has been made; |
---|
40 | 40 | | (8) information regarding child protection staffing |
---|
41 | 41 | | and caseloads by program area; |
---|
42 | 42 | | (9) information on the permanency goals in place and |
---|
43 | 43 | | achieved for children in the managing conservatorship of the |
---|
44 | 44 | | department, including information on the timeliness of achieving |
---|
45 | 45 | | the goals, the stability of the children's placement in foster |
---|
46 | 46 | | care, and the proximity of placements to the children's home |
---|
47 | 47 | | counties; |
---|
48 | 48 | | (10) the number of children who suffer from a severe |
---|
49 | 49 | | emotional disturbance and for whom the department is appointed |
---|
50 | 50 | | managing conservator, including statistics on appointments as |
---|
51 | 51 | | joint managing conservator, due to an individual voluntarily |
---|
52 | 52 | | relinquishing custody of a child solely to obtain mental health |
---|
53 | 53 | | services for the child; |
---|
54 | 54 | | (11) the following information regarding [number of] |
---|
55 | 55 | | children who are pregnant or who are parents [a parent] while in the |
---|
56 | 56 | | managing conservatorship of the department: |
---|
57 | 57 | | (A) the number of pregnant female children in the |
---|
58 | 58 | | managing conservatorship of the department who are at least 13 |
---|
59 | 59 | | years of age but younger than 18 years of age compared to the total |
---|
60 | 60 | | number of female children in the managing conservatorship of the |
---|
61 | 61 | | department who are at least 13 years of age but younger than 18 |
---|
62 | 62 | | years of age; |
---|
63 | 63 | | (B) the number of female children in the managing |
---|
64 | 64 | | conservatorship of the department who are at least 13 years of age |
---|
65 | 65 | | but younger than 18 years of age and who have given birth to a child |
---|
66 | 66 | | compared to the total number of female children in the managing |
---|
67 | 67 | | conservatorship of the department who are at least 13 years of age |
---|
68 | 68 | | but younger than 18 years of age; |
---|
69 | 69 | | (C) the number of pregnant female youth in the |
---|
70 | 70 | | managing conservatorship of the department who are younger than 22 |
---|
71 | 71 | | years of age and the following information for each youth: |
---|
72 | 72 | | (i) the youth's age; |
---|
73 | 73 | | (ii) the youth's race and ethnicity; |
---|
74 | 74 | | (iii) the youth's county of residence; |
---|
75 | 75 | | (iv) the time the youth has been in |
---|
76 | 76 | | substitute care; and |
---|
77 | 77 | | (v) the type of substitute care in which the |
---|
78 | 78 | | youth is placed; |
---|
79 | 79 | | (D) the number of youth in the managing |
---|
80 | 80 | | conservatorship of the department who are younger than 22 years of |
---|
81 | 81 | | age and who are parents and the following information for each |
---|
82 | 82 | | youth: |
---|
83 | 83 | | (i) the youth's gender; |
---|
84 | 84 | | (ii) the youth's age; |
---|
85 | 85 | | (iii) the youth's race and ethnicity; |
---|
86 | 86 | | (iv) the youth's county of residence; |
---|
87 | 87 | | (v) the time the youth has been in |
---|
88 | 88 | | substitute care; and |
---|
89 | 89 | | (vi) the type of substitute care in which |
---|
90 | 90 | | the youth is placed; |
---|
91 | 91 | | (E) the number of youth in the managing |
---|
92 | 92 | | conservatorship of the department who are parents of a child who is |
---|
93 | 93 | | also in the managing conservatorship of the department and the |
---|
94 | 94 | | following information for each youth: |
---|
95 | 95 | | (i) the type of substitute care in which the |
---|
96 | 96 | | youth is placed; and |
---|
97 | 97 | | (ii) whether the youth and the child are |
---|
98 | 98 | | placed together; |
---|
99 | 99 | | (F) for youth described by Paragraphs (C) and (D) |
---|
100 | 100 | | who exit the department's conservatorship, the following |
---|
101 | 101 | | information for each youth: |
---|
102 | 102 | | (i) whether the youth is adopted, reunited |
---|
103 | 103 | | with the youth's family, or emancipated; |
---|
104 | 104 | | (ii) the youth's age on the date the youth |
---|
105 | 105 | | exited the department's conservatorship; and |
---|
106 | 106 | | (iii) the time the youth spent in |
---|
107 | 107 | | substitute care; |
---|
108 | 108 | | (G) the number of children in the managing |
---|
109 | 109 | | conservatorship of the department who are at least 11 years of age |
---|
110 | 110 | | but younger than 18 years of age and who are pregnant or who are |
---|
111 | 111 | | parents at the time the child enters the conservatorship of the |
---|
112 | 112 | | department; and |
---|
113 | 113 | | (H) the number of children in the managing |
---|
114 | 114 | | conservatorship of the department who are at least 11 years of age |
---|
115 | 115 | | but younger than 18 years of age and who become pregnant or who |
---|
116 | 116 | | become parents while in the conservatorship of the department [and |
---|
117 | 117 | | the number of the children born to a parent in the managing |
---|
118 | 118 | | conservatorship of the department who are placed in the managing |
---|
119 | 119 | | conservatorship of the department]; |
---|
120 | 120 | | (12) the number of children who are missing from the |
---|
121 | 121 | | children's substitute care provider while in the managing |
---|
122 | 122 | | conservatorship of the department; and |
---|
123 | 123 | | (13) the number of children who were victims of |
---|
124 | 124 | | trafficking under Chapter 20A, Penal Code, while in the managing |
---|
125 | 125 | | conservatorship of the department. |
---|
126 | 126 | | SECTION 2. This Act takes effect September 1, 2019. |
---|
